Abstract

Abstrak Narkotika dan obat berbahaya atau lebih dikenal dengan istilah dalam masyarakat yaitu “narkoba” merupakan bahan berbahaya hal mana bagi pengguna, pengedar, yang memproduksi dan menyimpan dapat dikenakan sanki pidana. Tidak tanggung-tanggung sanksi pidana yang dijatuhkan sampai dengan hukuman mati. Kejahatan yang berhubungan dengan narkoba saat ini sudah sampai pada kondisi yang sangat memprihatinkan. Hal mana karena kejahatan ini tidak pandang bulu untuk memilih korbannya dimulai dari segmen atas yaitu masyarakat golongan mampu (pejabat, artis, tokoh masyarakat dan lain-lain) sampai dengan masyarakat pada lapisan bawah. Lebih memprihatinkan lagi sudah masuk dalam segmen anak sekolah, mahasiswa dan golongan terpelajar. Karena kejahatan ini sudah bersifat massif maka sudah dapat dikategorikan sebagai “extra ordinary crime”dan menjadi musuh bersama bangsa ini. Kampanye dan pembentukan opini public tentang bahaya narkoba harus dilakukan secara massif terhadap seluruh lapisan masyarat. Hal ini merupakan bagian dari penanggulangan kejahatan narkoba di Indonesia. Masyarakat harus diberi pemahaman yang benar mengenai dampak negative dari narkoba baik bagi pengguna/pemakai, pengedar, yang meproduksi dan menyimpan. Pemahaman ini dimulai dari beberapa fase yaitu bagaimana fase pencegahan narkoba dalam masyarakat ? bagaimana fase jika memang terlanjur sudah menggunakan narkoba dan mendudukan pengguna narkoba sebagai korban ? bagaimana fase penegakkan hukum terhadap kejahatan narkoba ? Fase-fase ini harus dikampanyekan secara massif agar masyarakat memahami bahwa hal-hal yang berhubungan dengan narkoba lebih banyak dampak negatifnya dibandingkan dengan dampak positifnya. Kata kunci:Kejahatan, Obat Terlarang, Hukuman. Abstract Drugs is a dangerous substance in which for the user, dealers that produce and keep the substance could be penalized with criminal law. Death sentence could be penalized for the subject. Crimes related to drugs have now reached a very alarming condition. This is because the victims of the crime are from both upper class people and lower class people. Even more alarming drugs have reached school students and university students. This crime is already categorized as an “extra ordinary crime” as a result of how massive it is. Campaigns and the formation of public opinion about the dangers of drugs must be done massively on all levels of society. This is the part of approaching drug crimes in Indonesia. The public must be given the right understanding of how drugs will give negative impacts for users, dealers, that keep and produce the substance. Comperhensions started with several phases, how can public prevent the drug use? What we can do if we already use the substance and how to position drug users as victims? How the law enforcement works for drug crimes? These phases must be massively campaigned to the public so people will understand that drugs have negative impacts more than positive impacts. Abstract

Under the provisions of Article 4 of law no.26 of 2000 on Human Rights Court and the duty to investigate and resolve cases of serious Human Rights Violations. Of the provisions of this article means that not all Human Rights violations be tried by a court of Human Rights but is limited to “Serious Human Rights Violations”. Is a grass Human Rights Violations under the provisions of law No. 26 of 2000 is described in chapter 7, which reads as follows: “Serious Human Rights Violations Include: (1) The crime of genocide and (2) Crimes against Human. In addition to the Human Rights Court to investigate and resolve cases of Serious Human Rights Violations that occurred in the Territorial unitary state of Indonesia (Principle Territorialitet). Also to investigate and resolve cases of grass Human Rights Violations commited by Indonesia citizen outside the unitary Republic of Indonesia (Principle Nasinalitet). Besides mechanisms and inter rasional, other mechanism that a new mechanism for justice in cases of human evil is a mixture courts or better known as hybrid tribunal. Model of this trial appeared to be criticism of the weakness of national courts and international courts, as shown in the international criminal tribunal for the farmer Yugoslavia and the International criminal court for Rwanda.Kata Kunci: Implementasi Peyelesaian Pelanggarah HAM Berat

Abstract

The implementation and effectiveness of information legislation and electronic transactions are very weak, within the provisions of article 45, that the sanctions against the offenses were not optimal, because the law does not sanction a minimum, so that the law is legally vague and does not provide legal certainty, thus providing opportunities to abuse and misuse of information and communication technologies or misuse of electronic transactions by taking action so that the court can not apply the law, so it is not effective and is not optimal for violations and abuse of transaction information and communication. Abstract

The 1945 Constitution article 24 paragraph (1) power is exercised by a Supreme Court and others The Judiciary according to the law and the Elucidation of the 1945 Constitution is said: Judicial Power is an independent pow- er, meaning that it is independent of government authority. However, in 32 years the New Order government was in power, the independence of the Supreme Court and judicial authority were put in place, the Supreme Court as a judicial institution in carrying out its duties was always in uenced by the government (in uenced by executive power). Thus what was started in the explanation of the 1945 Constitution above, namely judicial power is an independent power or a power that is independent of government power is not carried out according to the law, but is carried out according to the wishes of the Orde Baru Era. Abstract

Abstract Indonesia has experienced rapid development in the state administration system since the demands for reform were marked by the fall of Soeharto from power in May 1998. Reformation as a form of total correction of the practice of running a centralized state that occurred during the leadership of the Orde Baru Era. The hegemony of the power of the President during the Orde Baru Era placed other state organs in a weak position functionally, including the Indonesian People's Representative Assembly. Since the Soeharto regime ended there was a fairly fundamental ow of change in the life of the Indonesian state administration. Abstract

Abstract At present the need for electronic goods has become a primary need. There is no denying that electronic equipment helps in human life. Some are used as entertainment tools and some are used as work aids. But there are also those that can be used as well as work tools and entertainment, even educational facilities. This need does not mean insignificant, because as a civilized human being, living in a community is in dire need of various other things that are broader and perfect, both regarding the quality, quantity, and type. It is not surprising then that the industry is rapidly advancing because the level of market needs is quite high, but electronic products include products that have specificity so that not all consumers can know the ins and outs, both capabilities, quality, instructions for use, guarantees / guarantees, after sales service and so on. The fact shows that Indonesia has grown and developed many industrial goods and services, both large and small scale, especially since the implementation of national development in stages and planned through a five-year development plan.
