Abstract

This present study aims to explain the perspectives of sharia economiclaw on the contract of employment at PT Primatexco Indonesia,Batang. The Law Number 13 of 2003 on Manpower constitutes theprotection of labor that is intended to guarantee the basic rights ofworkers/labor. The emergence of the Law is expected to be able torealize the welfare of workers/labor as well as their families bypaying great attention to the development and growth of business. Itwas field research by employing a qualitative study design, and thesetting was at PT. Primatexco Indonesia, Batang. The researchfindings promote that even though there has been the Law concerningManpower, this law has not run in accordance with the stipulatedrules. It illustrates that the content of the Law has not accommodatedthe stipulation of the existing Law yet, and even the content issometimes unclear, which is stated in the Article 54 of the Law onManpower. The fiqh (Islamic jurisprudence) scholars agree that acontract possesses the force of law caused by syara’ (Islamic law),instead of the actions performed by the two parties make the contract.Likewise, the actions play a role as a cause for the effect of thecontract. It suggests that no one is not able to do arbitrarily in terms ofthe requirements they provide in the contract of employment so thatall people’s actions are based on the law of Allah. Abstract

This study will explain about the optimization of the socio-economic role of waqf from waqf assets, because so far people think that waqf is still functioned as a means of worship only. Law Number 41 of 2004 is the starting point for the management of waqf in Indonesia. That the law provides an understanding that the management and development of waqf assets can be carried out productively to improve the social and economic welfare of the community. This research is a field research which takes place at the Pekalongan City Muslimin Foundation (YMKP) with the type of qualitative research. This study states that the management of the waqf assets of the Pekalongan City Muslimin Foundation has economic benefits for the community, although not optimally. To optimize the role of waqf in the Pekalongan City Muslimin Foundation, it is necessary to optimize the role of Nazhir because Nazhir has a very strategic function in managing waqf assets so that coordination between Nazhir and the Indonesian Waqf Board (BWI) is necessary as a guidance function and the Office of Religious Affairs (KUA) as Officials. The maker of the Wakaf Pledge Deed (PPAIW) as a control function. So that waqf can function as an alternative to improve the social and economic welfare of the community

Abstract

This article aims to find out the contribution of mass organization to the improvement of SME business in KJKS Ankasa GP. Ansor of Pekalongan Regency. This study was a qualitative research with case study approach. The subject of research was Sharia-based Financial Service Cooperatives (Koperasi Jasa Keuangan Syariah, thereafter called KJKS) Ankasa, while the object was GP Ansor of Pekalongan Regency. The result of research showed that GP Ansor of Pekalongan Regency can empower the existing economic potency of members, by means of developing pro-people economy, establishing KJKS. The presence of KJKS can reduce unemployment rate, by providing funding help. The fund grant is given to the members having expertise (skill) but having no capital. To the public, this KJKS Ankasa is a means of providing capital, particularly to small-to-medium scale employers that facilitates them in the term of financing. To GP. Ansor, the presence of KJKS is beneficial to the distribution of fund for social activity (social service) purpose. KJKS Ankasa’s business activity includes financing, investment, and saving corresponding to profit sharing (sharia) pattern and aiming to achieve organizational independency.

Abstract

Penelitian ini membahas tentang kedudukan anak angkat dalam pembagian warisan di Pekalongan Barat dengan perspektif hukum Islam dan KUH Perdata. Jenis penelitian yang digunakan adalah penelitian lapangan (field research). Dari hasil penelitian diketahui bahwa kedudukan anak angkat menurut hukum Islam dan KUHPerdata bahwa antara keduanya terjadi perbedaan, dalam hukum Islam, pengangkatan anak tidak membawa akibat hukum dalam hal hubungan darah, hubungan wali-mewali dan hubungan waris mewaris dengan orang tua angkat. Ia tetap menjadi ahli waris dari orang tua kandungnya dan anak tersebut tetap memakai nama dari ayah kandungnya. Kedudukan anak angkat menurut KUHPerdata adalah bahwa anak status anak yang diangkat maka berubah menjadi seperti seorang anak sah. Hubungan keperdataan dengan orang tua kandungnya menjadi putus sama sekali dan menimbulkan akibat hukum secara hukum memperoleh nama dari bapak angkat, dijadikan sebagai anak yang dilahirkan dari perkawinan orang tua angkat dan menjadi ahli waris orang tua angkat. Pembagian harta peninggalan di Kelurahan Tirto dari orang tua angkat kepada anak angkatnya didasarkan pada wasiat dan dengan cara musyawarah mufakat internal keluarga dengan pertimbangan bahwa anak angkat telah merawat orang tuanya. setelah diadakan pembagian harta waris kepada yang berhak, kemudian masing-masing dari saudara pewaris yang mendapatkan harta waris memberikan harta tersebut dengan akad hibah.
