Abstract

This paper aims to analyze QS al-Nū/24: 22, from text to context. Historically, the text of QS al-Nū/24: 22came down related to the occurrence of the ḥadīṡ al-ifkī, incident that hit 'Aisyah radiyallahu 'anha. That event predicted by historians took place after the Bani Musthaliq war around 5 or 6 H. Some of the social aspects of Islamic law which contained in this text are ethical principles in social interaction, individual attitudes in dealing with slander or hoaxes, and the legal consequences stipulated by the Shari'a against perpetrators and spreaders of fake news or hoaxes.Keywords: Asbāb Nuzūl, historical context, social law, hoax.

Abstract

Practise of zakah management has developed and changed according to the times. Among the examples of these changes are the type of zakah that aren’t found in Prophet era, dynamic grouping of mustahik which varies from one society to society, and also amil problem in need to new terms and requirement.This paper aims to explore zakah management practise and it development from classic fikih compared to contemporary fikih perspective.

Abstract

Kompleksnya permasalahan dan realitas perempuan di era modern menuntut para ulama untuk menetapkan solusi hukum yang aktual dan realistis. Tulisan ini berangkat dari kenyataan bahwa produk fikih perempuan juga dipengaruhi oleh karakteristik manhaj dan metode ulama dalam menetapkan hukumnya. Melalui kajian studi literatur (riset kepustakaan) dan pendekatan Fikih-Usul Fikih, tulisan ini menemukan bahwa ada tiga karakter metodologi atau manhaj ulama dalam fikih perempuan yaitu al-tasyaddud atau al-iftirati al-tafrit wa al-tahallul, serta al-wast wa al-i'tidal. Adapun dalam menetapkan hukum fikih perempuan kontemporer, para ulama menempuh metode melalui analisis komprehensif terhadap nas-nas hukum, atensi terhadap maqasid al-syari'ah, pertimbangan realitas sosial, dan pertimbangan terhadap perbedaan psikologis dan sosial perempuan. Di Indonesia, realitas aktivitas perempuan telah merambah ke dunia politik praktis sehingga menghasilkan respon pemikiran fikih yang beragam. Di sini terlihat bahwa problematika fikih perempuan kontemporer tidak sepi dari perbedaan pendapat ulama.

Abstract

In comparing the masculine concepts of these two figures, the researcher concluded that the concept of maslahat al-Tufi and al- Syatibi only had differences at the epistemological level. If al-Tufi positions maslahat as a supremacy of the law which is higher than the nas, while al-Syatibi is more careful by trying to combine the text massively and not justifying the reason beyond the limit set. In this concept of maslahah, al-Syatibi excels in elaborating his theory in more detail as the goal of the Shari'ah so that it develops into a whole theory sid, while al-Tufi does not formulate maslahat theory in one form of writing as in al-Syatibi with the book al-Muwafaqat essay.
