Abstract

The metraen bhekal bineh tradition in Banyuajuh, Bangkalan, Madura requires prospective husbands to pay zakat fitrah for their prospective wives in the form of money or rice. This study aims to determine the practice of the metraen bhekal bineh tradition and to find out the review of Islamic law on the metraen bhekal bineh tradition in Banyuajuh, Bangkalan, Madura. This research is a field research with qualitative methods and a sociological juridical approach. Sources of data used are primary data and secondary data. Data collection techniques through observation, interviews, and documentation were analyzed using the inductive method. Based on the results of the study, it can be concluded that the metraen bhekal bineh tradition in Banyuajuh, Bangkalan Madura in terms of Islamic law is permissible because it is a tradition that grows and develops with good values ​​in society. The husband's obligation to pay zakat fitrah for his future wife is a customary obligation, not an obligation as required by Islamic law.

Abstract

ABSTRAKHumans as social beings always need help from others. There needs to be a harmonious relationship between human beings for the peaceful life. One way to maintain this condition is to have a sense of empathy and sympathy. A form of good attitude of empathy and sympathy in society which is categorized as legal action is zaakwaarneming. In the Civil Code (KUHPerdata) zaakwaarneming is referred to as a voluntary representative where someone represents someone's interests or carries out the affairs of another person, voluntarily to do the help until the end or until the person those who are managed by their interests are able to do their own business. This paper attempts to discuss zaakwarneming in terms of legal norms, social norms and Islamic norms. ABSTRAKManusia sebagai makhluk sosial selalu membutuhkan adanya bantuan dari orang lain. Diperlukan adanya hubungan harmonis antara sesama manusia agar kehidupan yang tentram dan damai dapat terwujud. Salah satu cara untuk menjaga kondisi tersebut adalah dengan memiliki rasa empati dan simpati.Wujud sikap empati dan simpati yang baik dalam masyarakat yang dikategorikan sebagai tindakan hukum salah satunya adalahzaakwaarneming.Di dalam Kitab Undang-undang Hukum Perdata (KUHPerdata)zaakwaarnemingdisebut sebagai perwakilan sukarela dimana seseorang mewakili kepentingan seseorang ataumelakukan pengurusan suatu urusan orang lain, secara sukarela baik dengan sepengetahuan maupun tanpa sepengetahuan yang diwakili, terikat untuk melakukan perbuatan itu sampai selesai atausampai orang yang diurus kepentingannya mampu untuk melakukanurusannya sendiri.Paper ini berusaha membahas mengenai zaakwarneming dalam pandangan norma hukum, norma sosial dan norma agama Islam. Keyword:Zaakwaarneming, Ta'âwun, Islam.

Abstract

Education is one of the instruments in realizing family resilience in supporting national development. For the Madurese community in general, religious education has very strong roots. This research was conducted in order to identify the level of family resilience through religious education, which functions as a measurable and structured aspect of family welfare for salt farmers. This qualitative research uses interviews, observation and documentation as data collection instruments. The results showed that the level of family resilience from the economic, social and cultural side shows the Resistance index for the whole family, on the other hand, for single families it shows the index of less resistance, this also has an impact on the sustainability of Islamic religious education for children in salt farmer families; namely family expectations, availability of sources and internalization of religious values in the life of whole families and single families. For nuclear families, the fulfillment of the variable of family resilience development has a role in supporting the continuity of religious education for children, such as the facilities and attention that leads to the emergence of children's habits within the scope of salt farming families.

Abstract

Undang-Undang Nomor 33 Tahun 2014 tentang Jaminan Produk Halal mengamanatkan bahwa seluruh produk yang dipasarkan di Indonesia wajib bersertifikat halal. Berdasarkan ketentuan pada UUJPH menunjukkan bahwa pelaku usaha seharusnya tahu bahwa dilarang memperdagangkan barang yang tidak mengikuti syariat Islam dan harus bertanggungjawab atas produk yang diperdagangkan. Tetapi pada kenyataannya masih ditemukan adanya produk dan makanan yang tidak memiliki sertifikat/label  halal atau bahkan mencantumkan label halal palsu. Pencantuman label halal pada produk berfungsi untuk memberikan kenyamanan dan keamanan konsumen dalam menggunakan maupun mengkonsumsi produk tersebut. Eksistensi label halal ini dianggap penting bagi konsumen muslim sebagai informasi mengenai komposisi produk. Artikel ini bermaksud untuk menilik lebih lanjut mengenai perlindungan konsumen terhadap produk berlabel halal palsu.

Abstract

Abstrak Badan Penyelenggara Jaminan Produk halal (BPJPH) Kementrian Agama menargetkan semua produk yang tempat pemasarannya di Indonesia harus memiliki sertifikat halal di tahun 2019. Tujuan penelitian ini adalah (1). Mengetahui tingkat pemahaman konsumen terhadap sertifikasi halal; (2) Mengetahui persepsi konsumen; dan (3) Menganalisa hubungan tingkat pendidikan, pendapatan. Teknik penelitian yang digunakan dalam penelitian ini adalah survey yang mengambil sampel dari suatu populasi dan menggunakan kuisioner sebagai alat pengumpul data yang pokok. Analisis pengukuran terhadap perspektif konsumen terhadap sertifikasi halal dilakukan dengan metode statistic deskriptif. Analisis hubungan tingkat pendidikan dan tempat belanja konsumen dengan pemahaman tentang sertifikasi halal menggunakan analisa Pearson Correlation melalui program SPSS. Hasil pengolahan data menunjukkan bahwa mayoritas responden mengganggap produk pangan bersertifikat halal memiliki added value daripada produk pangan non label halal. Berdasarkan nilai korelasi dengan menggunakan Pearson Correlation, terdapat korelasi antara tingkat pendidikan dan pengetahuan responden terhadap pengetahuan mereka tentang sertifikasi halal. Abstract The Ministry of Religion's Halal Product Guarantee Agency (BPJPH) targets all products that have marketing places in Indonesia to have halal certificates in 2019. The objectives of this study are (1). Knowing the level of consumer understanding of halal certification; (2) Knowing consumer perceptions; and (3) Analyzing the relationship between education level, monthly income. The research technique used in this study is a survey that takes samples from a population and uses questionnaires as a basic data collection tool. The measurement analysis of the consumer's perspective on halal certification is done by descriptive statistical methods. Analysis of the relationship between education level and consumer shopping place with an understanding of halal certification using Pearson Correlation analysis through the SPSS program. The results of data processing show that the majority of respondents consider halal-certified food products to have added value rather than non-label halal food products. Based on the correlation value using Pearson Correlation, there is a correlation between the level of education and the knowledge of respondents to their knowledge of halal certification. Abstract

Need priority scale arrangement is done to avoid the behavior of irrational consumption. It also must pay attention to the financial capabilities to avoid greater expenditure than income. Therefore, to make the right economic decisions in consuming and avoid luxurious lifestyle, it is necessary for us understanding financial literacy. Financial Literacy is knowledge to manage finance. One of the intelligences that must be possessed by modern men is financial intelligence, namely the intelligence in managing personal assets, especially in managing personal financial assets. The object of research in this paper is students at traditional Muslim School at traditional Muslim at school of Syaichona Kholil Bangkalan District, where students at traditional Muslim School are students who live far apart from parents equipped with knowledge in managing finances and allowance. Are the students at traditional Muslim School able to coordinate his finances in traditional Muslim School? Based on the result of the research, it can be described as follows: the concept of someone's financial literacy can be seen from the his/her cognitive process or knowledge which he has in managing finance, and his/her attitudes toward personal finance that will affect his financial behavior or decision in managing finance. From the existing theory, it is adapted based on basic knowledge as well as financial attitudes for teenagers with age of 13-18 years. A review of financial literacy for students at traditional Muslim School of  Syaichona Kholil Bangkalan District is appraised by simplicity and mutual sharing among fellow who is able to maintain an individual life as a social creature in the environmental diversity of the community. This sense of solidarity and kinship is needed to bring students at traditional Muslim School into real life after they no longer live in traditional Muslim School of Syaichona Kholil Bangkalan Regency. Keywords: Financial Literacy, Traditional Muslim School, Syaichona Kholil

Abstract

The function of approval in an agreement (contract) is as a statement between the two parties on their respective rights and obligations so that if there are parties whose rights are not fulfilled, they can feel protected and demand these rights. Therefore, it is appropriate that an agreement on a contract must be carried out properly so that it can guarantee the rights of both parties. Madura Island is the best salt field in Indonesia, so there are many contracts between farmers and salt landowners. This article discusses the pattern of revenue sharing between farmers and salt landowners in Pamekasan Regency using the schemes of a half to a third and one fifth to two fifths. These revenue sharing patterns have different rights and obligations. The difference is a bigger obligation to those who get half. The author found that the pattern of production sharing agreements made by farmers and salt landowners in Pamekasan Regency according to the Agreement Law and Islamic Law did not meet the basic principles of agreement, because the agreement was made only verbally and there were no witnesses so that it had an impact on the lack of protection for farmers and the absence of witnesses causes no clarity on the boundaries of the contract.

Abstract

Zakat is the main pillar that has a role for the Islamic economy. BAZNAS Malang has a very important role as a means of community welfare. One of them is for the Bandungrejo MSME community by distributing empowerment-based work tools. The research method of this article is qualitative. The main subject of MSMEs in Bandungrejo who received an empowerment program from BAZNAS Malang. Information was obtained through documentation, observation and interview techniques, as well as deductive data analysis techniques. The empowerment of MSMEs in Bandungrejo is carried out continuously. program planning that has been prepared must be able to function as a driving force so as to create a holistic community empowerment program. The existence of this program is also in line with the Islamic law, Law Number 23 of 2011 about Zakat Management and Government Regulation Number 14 of 2014 about Implementation of Law Number 23 of 2011 about Zakat Management which prioritizes the utilization of zakat for the welfare of the people and poverty alleviation. The economic empowerment of the people has been achieved based on the right and good goals and objectives. The author suggest for developing community resource training programs and special assistance so that the empowerment program runs optimally because cooperation from all elements of the government, private sector and community is able to maximize the welfare of the community.

Abstract

Halal food is a profitable business not only among Muslim-majority countries but also non-Muslim countries. Indonesia is a country with the largest Muslim population in the world, but Indonesia's position is only limited to the market and has not yet become an actor. The industry is the result of the development of a halal supply chain where the production of goods or services from upstream to downstream has halal standards and certification. In Indonesia, the number of halal certifications does not match the number of MSMEs in Indonesia, for example in Bangkalan district. No less than 166,768 units of micro, small and medium enterprises are located in Bangkalan by absorbing a workforce of approximately 210,003 people. The applicable procedure in granting this halal label permit is based on the halal certificate issued by the MUI. Many products of Micro, Small and Medium Enterprises include a halal label without having a halal certificate. This study aims to find out the factors that cause MSME producers of processed food in Bangkalan Regency to not have halal certification and identify the legal responsibility of packaged processed food MSME producers for halal labeling. The research was conducted by observing primary data in Bangkalan district and then interviewing the MSMEs. The implication of this research is that people can know and understand about law and halal labeling in developing their businesses.

Abstract

Wadi’ah Yad adh-Dhomanah is a conract for safekeeping of goods where the recipient of the deposit with or without the permission of the owner of the goods can take advantage of the goods that are deposited and must be responsible for the loss or damage of the goods. All profits obtained by the use of the goods become the right of the recipient of the deposit. This study aims to review the aspects of sharia compliance with the Wadi’ah Yad adh-Dhomanah contract and reward giving to savings products at BMT NU NGASEM. The sharia reference used in this study is the DSN MUI Fatwa NO. 86/DSNMUI/XII/2012 about rewards in Islamic Financial Institution Funds This is a descriptive qualitative research with interview data collection methods and documentation studies. The analysis tool uses a comparative approach. The results of the study found that the majority of Wadi’ah Yad adh-Dhomanah contracts and reward giving to savings products at BMT NU NGASEM have met sharia compliance but there are some points in giving reward s that are not in accordance with the rules of the DSN MUI Fatwa NO. 86/DSNMUI/XII/2012.
