Abstract

The issue of multi-party presidential governance in Indonesia remains an unfinished homework to date, many political experts and Constitutional Law have inferred the ineffectiveness of presidential systems in multi-party models. On the other hand, our Constitution has affirmed through its characteristics that Indonesia embraces a presidential government system, but it is applied in multiparty political construction. Since the beginning of the general election, Indonesia still uses the proportional system with various color additions district. Because of the proportional success that has been used since the first election, it may be necessary to try new things by using the district system with a variety of variations so as not to undermine democracy. The parliamentary threshold model and the tightening of conditions for parties to follow the election will slowly simplify the party. Nevertheless, the high standard of parliamentary threshold creates much criticism, the small party feels aggrieved and says it is against democracy.

Abstract

This article discusses the General Principles of Good Governance (AAUPB). It has a long journey from the beginning of its coming in the Netherland to its application in Indonesia today. AAUPB, which previously was only in theoretical realm, it changes into Law No. 30 of 2014 today. The principles contained in the law are legal certainty; expediency; impartiality; accuracy; not to abuse authority; openness; public interest; and good service. In addition to these principles, we can also use other principles as far as they become the basis for the judges' judgments that have permanent legal force. In various cases, the basis of the claim of AAUPB does not stand alone but it is also juxtaposed with violations of statutory regulations. The Supreme Court verdict has become a jurisprudence between Suhaili Saun (shareholder in PT Volex Batamindah) and the Chairman of BKPM, although the plaintiff also argued that violating the AAUPB namely the principle of legal certainty, the defendant also violated article 2 letter b of Law No. 1 of 1967 about Foreign Investment. In the case of the dismissal of Bripda Helga Musa Sitepu by the Head of the North Sumatra Regional Police, the decree has violated article 2 paragraph 2 letter d and article 11 paragraph 1 of KAPOLRI regulation No. 8 of 2006 and was contrary to the principle of the district.

Abstract

Abstract: This article discusses the analysis of the prohibition of analogy in the Draft Bill. The majority of the experts of jurisprudence against analogy. The author does not agree with the ban on using the analogy in the Draft Bill, but justifies the analogy with the record, the judge must be competent and with integrity. If the judge is unable to make analogy, then he could use self-interpretation to find a legal decition. The argument of usage of analogy is to seek substantial justice for the people without setting aside the individual’s rights, because by using the analogy, the rule of law will remain unfulfilled. It is because the crime, in its various forms, is still contrary to morality even though it is not written, and even if the crime has an impact to the public. In Islamic law, the method of qiyâs compiled by Imam Shafi’i in may be used as a good analogy, because qiyâs method has been tested by producing many laws.Keywords: Analogy, draft bill, the criminal code. Abstrak: Artikel ini membahas tentang analisis terhadap larangan analogi dalam RUU KUHP. Mayoritas para ahli ilmu hukum menentang analogi. Penulis tidak sepakat dengan larangan menggunakan analogi dalam RUU KUHP, tetapi membenarkan analogi dengan catatan, hakimnya harus kompeten dan berintegritas. Jika hakimnya memang tidak mampu untuk beranalogi, maka ia masih bisa menggunakan interpretasi untuk menemukan hukumnya.   Argumen diperbolehkannya analogi adalah untuk mencari keadilan substansial bagi masyarakat tanpa menyampingkan perlindungan individu, sebab dengan menggunakan analogi kepastian hukum akan tetap terpenuhi. Karena kejahatan, dalam berbagai bentuknya, tetap saja bertentangan dengan kesusilaan meskipun ia tidak tertulis, apalagi jika kejahatan tersebut membawa pengaruh kepada masyarakat luas. Dalam hukum Islam, metode qiyâs yang disusun oleh Imam Syafi’i dalam berijtihad mungkin dapat digunakan sebagai proses analogi yang baik, sebab metode qiyâs ini sudah teruji dengan memproduksi banyak hukum. Kata Kunci: Analogi, Rancangan Perundang-undangan, KUHP.

Abstract

Constitutional Court Decision No. 46 / PUU-VIII / 2010 raise the pro and contra in the society. The pro side considers the Constitutional Court decision gives justice for women who are victims of fraud or sirri wedding, and for the children born from this relationship. On the other hand, the contra side argues that the decision of the Constitutional Court has strayed far from the Islamic law; even they consider it as legalizing adultery. In this research, writer uses a qualitative approach. The writer deciphers Constitutional Court Decision No. 46 / PUU-VIII / 2010 and then analyzes those using concepts laqith and wasiat wajibah in the Islamic law. The concept of laqith can be used to justify the obligation of biological father toward his children, and wasiat wajibah can be used as a way out for inheritance for children born outside wedlock. From these results, it can be concluded that the court decision number 46 / PUU-VIII / 2010 does not contradict with the Islamic law.
