Abstract

The community service program (PPM) is the third Dharma college that must be implemented by all lecturers. The method used is generally in the form of technology transfer, either through training, education or hands-on practice. The technology applied must be a proven technology, no longer trial and error. The success of a university in carrying out PPM will be reflected in the performance achieved each year. The first year of research was focused on examining the research scheme managed by LPPM Unsoed with BLU funds for 2017-2019; the amount of funded research in the Soshum field and its suitability with TKT. The method used is a metaanalysis with a systematic review model, which is followed by FGD. The data and information obtained were analyzed thoroughly with an inductive approach based on the results of observations, interviews, discussions and secondary data to compile a descriptive abstraction with the stages of data reduction, data presentation and conclusion drawing. The results showed that there were 6 (six) research schemes that were always held by LPPM Unsoed in 2017-2019, namely: International Research Collaboration (IRC), Unsoed Leading Research, Unsoed Institutional Research, Competency Improvement Research, Beginner Lecturer Research and Special Task Facilities Professor. The number of Leading Research Development which was funded for the 2017-2019 period, in the Soshum field was 37 titles and Applied Leading Research which was funded for the 2018-2019 period, as many as 28 titles. Leading Research Development that has been carried out has conformity with TKT levels 7 and 8, while Applied Leading Research has conformity with TKT level 5 and level 6 with indicators for each Level of Technology Readiness (TKT) of Social Humainora and Education Types, according to Permenristekdikti 42/2016.

Abstract

The organizational structure of the MPR based on the amendments to the 1945 Constitution consists of members of the DPR and members of the DPD. Membership of the MPR is similar to the membership of Congress in the United States, which consists of the House of Representatives (lower house) and the Senate (high house). The authority of the MPR after the amendment of Article 3 of the Constitution of the MPR is no longer the highest state institution, but is a state institution whose position is equal to other state institutions. The purpose of this paper is to examine the changes in the organizational structure and authority of the People's Consultative Assembly after the amendment to the 1945 Constitution and what are the implications for changes in the organizational structure and authority of the MPR after the amendment. This research uses a statue approach. Data sourced from primary and secondary legal materials were analyzed using qualitative normative analysis methods. The results of the study found that after the amendment to the 1945 Constitution, the concept of the MPR as the holder of people's sovereignty was abolished. The MPR no longer holds the highest power in the state administration system in Indonesia. The implications of changes after the amendment to the Constitution, the role of the MPR is only limited to carrying out the task of socializing the results of the amendments to the 1945 Constitution and inaugurating the President and Vice President.Keywords:  Organizational structure, Authority, MPR

Abstract

Kebijakan Penyederhanaan Birokrasi adalah salah satu kebijakan prioritas dalam periode kedua pemerintahan Presiden Joko Widodo yang diimplementasikan dengan cara memangkas jabatan administrasi dan di disetarakan menjadi jabatan fungsional. Mekanisme pelaksanaan kebijakan ini diatur dalam Peraturan Menteri Pendayagunaan Aparatur Negara dan Reformasi Birokrasi Republik Indonesia Nomor 28 Tahun 2019 Tentang Penyetaraan Jabatan Administrasi Ke Dalam Jabatan Fungsional dan Peraturan Menteri Pendayagunaan Aparatur Negara dan Reformasi Birokrasi Republik Indonesia Nomor 42 Tahun 2018 Tentang Pengangkatan Pegawai Negeri Sipil Dalam Jabatan Fungsional Melalui Penyesuaian/Inpassing. Penelitian ini bertujuan untuk menganalisis bagaimana bentuk kebijakan pemerintah terhadap penyederhanaan Birokrasi di instansi pemerintah dan implikasi hukum yang timbul dengan adanya kebijakan penyederhanaan birokrasi terhadap penataan jabatan menurut Undang-Undang Nomor 5 Tahun 2014 Tentang Aparatur Sipil Negara. Metode penelitian yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif. Data yang digunakan adalah data sekunder. Data-data tersebut diperoleh dianalisis dan dijabarkan berdasarkan norma hukum yang berkaitan dengan objek penelitian. Analisis penelitian dilakukan dengan normative kualitatif dan menggunakan penafsiran hukum gramatikal. Berdasarkan hasil penelitian, dapat disimpulkan bahwa kebijakan ini berlaku bagi intansi pemerintah pusat dan daerah dengan cara menyetarakan jabatan administrator, pengawas dan pelaksana menjadi jabatan fungsional dan menimbulkan implikasi hukum terhadap Undang-Undang Nomor 5 Tahun 2014 Tentang Apartur Sipil Negara yang termasuk didalamnya perubahan terhadap tunjangan kinerja, jabatan dan pengembangan karier PNS yang jabatannya disetarakan.Kata Kunci : Kebijakan, Birokrasi, Pegawai Negeri Sipil

Abstract

Penulisan hukum dengan judul Kebijakan peralihan status pegawai non PNS menjadi Pegawai Pemerintah dengan Perjanjian Kerja (PPPK) berdasarkan PP 49 Tahun 2018 Tentang Manajemen Pegawai Pemerintah dengan Perjanjian Kerja. Penelitian ini bertujuan untuk menganalisis kebijakan peralihan pegawai non PNS menjadi PPPK dan untuk menganalisis standar dan kriteria menjadi PPPK. Penelitian ini menggunakan tipe penelitian yuridis normatif, dengan pendekatan perundang-undangan (StatuteApproach), pendekatan konseptual (Conceptual Approach). Dalam penelitian ini sumber bahan hukum yang dilakukan adalah data primer dan sekunder dan analisis data dilakukan secara normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan, peralihan status pegawai non PNS menjadi PPPK berdasarkan PP 49 Tahun 2018 tentang Manajemen Pegawai Pemerintah dengan Perjanjian Kerja pengangkatan secara otomatis pegawai non PNS menjadi PNS sudah tidak berlaku lagi, sehingga pegawai non PNS tersebut harus memenuhi syarat dan lolos seleksi administrasi, kompetensi, dan wawancara yang pelaksanaannya mirip dengan seleksi CPNS.Kata Kunci : Kebijakan, Pegawai Pemerintah dengan Perjanjian Kerja, Pegawai Non PNS

Abstract

Era globalisasi ditandai dengan kemajuan di berbagai bidang membawa dampak semakin berkembangnya kebutuhan manusia. Perselisihan yang dilakukan pekerja/buruh yaitu sakit berkepanjangan pengusaha melakukan pemutusan hubungan kerja dengan alasan sakit maka pekerja /buruh pasti akan melakukan penyelesaiaan non litigasi dan litigasi untuk mendapatkan hak-haknya. Permasalahan skripsi ini tentang bagaimana pertimbangan hukum hakim dan implikasi hukum dikeluarkannya Putusan Nomor 67/Pdt.Sus-PHI/2018/PN.Pbr. Metode pendekatan yang digunakan dalam penelitian ini adalah metode yuridis normatif. Data yang digunakan adalah data sekunder. Spesifikasi penelitian yang digunakan adalah preskriptif analisis. Metode analisis data yang digunakan adalah normatif kualitatif. Berdasarkan hasil penelitian dan pembahasan maka dapat disimpulkan bahwa pertimbangan hukum hakim telah menyatakan pemutusan hubungan kerja yang dilakukan oleh PT Hoki Sejahtera terhadap pekerja yang sakit dinyatakan batal demi hukum, karena pemutusan hubungan kerja belum memperoleh dari lembaga penyelesaiaan hubungan industrial dimana pengugat berhak atas uang pesangon, uang penghargaan, uang masa kerja, uang penggantian perumahan serta pengobatan dan uang perawatan sehingga telah sesuai dan menerapkan Pasal 156 Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan. Implikasi hukum yang timbul dengan dikeluarkannya putusan tentang pemutusan hubungan kerja pekerja/buruh terhadap pekerja sakit pekerja mendapatkan hak-haknya yang wajib dibayarkan oleh pengusaha sesuai Pasal 156 Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan.Kata Kunci : Pemutusan Hubungan Kerja, Hubungan Industrial, Sakit Berkepanjangan

Abstract

Penerapan Asas Freies Ermessen Dalam Pengambilan Kebijakan Oleh Administrasi Negara Berdasarkan Hukum Administrasi Negara  Merupakan  suatu kebebasan yang diberikan kepada tata usaha negara dalam melakukan penyelenggaraan pemerintahan. Sehingga Freies Ermessen merupakan kemerdekaan bertindak atas inisiatif dan kebijakan sendiri dari administrasi negara. Keberadaanya  yang lain karena adanya suatu peningkatan akan  tuntutan pelayanan publik yang harus di berikan tata usaha negara terhadap kehidupan sosial ekonomi pada warga memiliki keberagaman, dan untuk menyelesaikan persoalan-persoalan yang mendesak yang belum ada aturannya  dan harus dapat dipertanggungjawabkan secara hukum dan moral.

Abstract

Mutasi Pegawai Negeri Sipil merupakan salah satu bagian dari proses Manajemen Pegawai Negeri Sipil, tidak terkecuali di Kabupaten Purbalingga. Dalam hal pelaksanaan mutasi jabatan struktural Eselon II ke bawah dalam satu Instansi Daerah di Kabupaten Purbalingga diindikasikan terjadi ketidak- proporsionalan dalam hal pelaksanaannya sehingga terjadi jabatan yang tidak sesuai dengan kompetensi yang dimiliki. Dengan demikian dibutuhkan penilaian yang objektif berdasarkan kriteria dan prosedur yang tepat dalam pelaksanaan mutasi untuk mendukung hal tersebut. Permasalahan dalam penelitian ini adalah bagaimana kriteria dan prosedur penilaian kinerja Pegawai Negeri Sipil dalam pelaksanaan mutasi di Kabupaten Purbalingga. Metode penelitian yang digunakan dalam penelitian ini adalah pendekatan yuridis normative. Data yang digunakan adalah data sekunder. Data-data tersebut diperoleh dianalisis dan dijabarkan berdasarkan norma hukum yang berkaitan dengan objek penelitian. Analisis penelitian dilakukan dengan normative kualitatif. Berdasarkan hasil penelitian bahwa pelaksanaan mutasi jabatan struktural Eselon II ke bawah dalam satu Instansi Daerah di Kabupaten Purbalingga mempertimbangkan kriteria khusus dan kriteria umum berdasarkan sistem merit yaitu kualifikasi, kompetensi, kinerja dan non diskriminasi yang telah ditentukan oleh Baperjakat. Hasil temuan lain menunjukan bahwa prosedur pelaksanaan mutasi jabatan struktural Eselon II ke bawah dalam satu Instansi Daerah di Kabupaten Purbalingga mengacu pada Peraturan Badan Kepegawaian Negara Nomor 5 Tahun 2019 tentang Tata Cara Pelaksanaan Mutasi, sedangkan prosedur penilaian kinerja Pegawai Negeri Sipil masih berdasarkan Peraturan Pemerintah Nomor 46 Tahun 2011 tentang Penilaian Prestasi Kerja Pegawai Negeri Sipil.Kata Kunci : Penilaian Kinerja, Mutasi, Pegawai Negeri Sipil
