Abstract

Indonesia is a disaster-prone country. The disaster may affect the economy, welfare, and politics of the country. By that reason, the state should protect the people and pay more attention to disaster management through legal instruments. Symptoms in the community are pushing the politics of law in this country by the issuance of legal policy in form of Law Number 24 Year 2007 on Disaster Management. Therefore, it is important to understand about regulatory aspect of disaster management, legal issue in the implementation of disaster management, and problem solving from that legal issue. This study determined that the recent law of disaster management has been well improved following the previous law. In its implementation, there are still problems such as disharmony legislation in disaster management, overlapping authority and lack of inter-institutional coordination followed by overlapping authority, disoriented working procedures of disaster management and disaster management to uncontrolled funding.

Abstract

The Constitutional Court verdict Number 11-12-21-126-136/PUU-VII/2009, dated March 31st, 2010, related to judicial review of Law Number 9 in 2009 on Educational Legal Entity, granted the request of the applicant for the most part. One of the ruling of the Constitutional Court stated that Law Number 9 of 2009 on Educational Legal Entity contrary to the State Constitution of the Indonesia Republic 1945 and has no binding legal force. The Constitutional Court verdict brings implications on education in Indonesia. This essay analyzes the juridical implications of The Constitutional Court verdict Number 11-12-21-126-136/PUU-VII/2009. Juridical implications of the verdict related to the existence of a legal vacuum (rechtvacuum) and the implementation levels of education. Juridical implications influence legislation governing the management and implementation of education, especially the education unit of goverrnance. Therefore, it is necessary immediately to establish a law as a substitute for The Law of Educational Legal Entitiy and do a redesign for the conductor of the educational unit.

Abstract

Health as a development capital, require support from health professional staff, including nurse. Nursing staff is the greatest potential for health human resources, even though its existence has not supported by comprehensive legislation. Nursing staff have no legal certainty, legal protection, not recognizes internationally, and have no challenge to compete in free trade. These consequences caused of the lack of nursing act. The study was conducted to determine the urgency of nursing act and to know the rule of law needs to be regulated in nursing act. Data analysis and interpretation show that the substance of nursing act must be clear and unequivocal establish of nursing education system, the implementation of nursing practice, competence (registration and license), and institutional. Nursing act is indispensable for nursing in Indonesia, therefore the House of Representatives should immediately establish nursing act.ABSTRAKKesehatan sebagai modal pembangunan memerlukan dukungan dari tenaga kesehatan termasuk perawat. Tenaga keperawatan ini merupakan potensi terbesar bagi sumber daya manusia kesehatan, namun eksistensinya belum didukung oleh peraturan perundang-undangan secara komprehensif. Perawat tidak mempunyai jaminan kepastian hukum, perlindungan hukum, tidak diakui secara internasional, dan tidak dapat bersaing dalam perdagangan bebas. Hal ini merupakan konsekuensi belum adanya undang-undang keperawatan. Kajian ini dilakukan untuk mengetahui perlunya undang-undang keperawatan dan mengetahui norma hukum yang perlu diatur dalam undang-undang keperawatan. Analisis data dan interpretasi menunjukkan bahwa muatan materi undang-undang keperawatan harus jelas dan tegas mengatur sistem pendidikan keperawatan, penyelenggaraan praktik keperawatan, kompetensi (registrasi dan lisensi), serta kelembagaan. Undang-undang keperawatan sangat diperlukan bagi keperawatan di Indonesia, oleh karena itu Dewan Perwakilan Rakyat perlu segera membentuk undang-undang keperawatan.

Abstract

Indonesia with the geographical conditions and the potential for natural resources is recognized as an archipelagic state and a maritime country. This also puts Indonesia as the centre of gravity and the global supply chain system. This condition causes the Indonesian suffer threats, harassment, and constraints as a consequence of the condition that has implications for maritime security of the country. This position must be supported with security and defense system strong and changing patterns of national development that is not only oriented dimension of land but also oriented to naval. For it has been established several policies and regulations, but to date these regulations are still sectoral causing disharmony and overlapping rules and authority in maritime security. This also applies to the system of law enforcement and state sovereignty in the sea which are affected by the legislation. On that basis, the regulatory aspects of maritime security and law enforcement needs to be done harmonization of legal systems and legislation, promptly resolve and determine the state borders both on land, sea, and air, and pointed to the Navy’s most responsible for maritime security and serves as a leading sector.ABSTRAKIndonesia dengan kondisi geografis dan potensi sumber daya alamnya diakui sebagai negara kepulauan dan negara maritim. Ini juga menempatkan Indonesia sebagai centre of gravity and the global supply chain system. Kondisi ini menyebabkan Indonesia mengalami ancaman, gangguan, dan kendala yang berimplikasi pada keamanan maritim negara. Kedudukan ini harus didukungdengan sistem pertahanan dan keamanan yang tangguh dan mengubah pola pembangunan nasional yang tidak hanya berorientasi pada matra darat tetapi juga berorientasi pada matra laut. Untuk itu, telah ditetapkan beberapa kebijakan dan regulasi, namun sampai saat ini regulasi tersebut masih bersifat sektoral sehingga timbul disharmoni dan tumpang tindih peraturan dankewenangan dalam keamanan laut. Ini juga berlaku bagi sistem penegakan hukum dan kedaulatan negara di laut yang dipengaruhi oleh peraturan perundang-undangan tersebut. Atas dasar itu, maka keamanan maritim dari aspek regulasi dan penegakan hukum perlu dilakukan harmonisasi sistem hukum dan peraturan perundang-undangan, segera menyelesaikan dan menentukan batas wilayah negara baik di darat, laut, dan udara, serta menunjuk TNI AL yang paling bertanggung jawab terhadap keamanan maritim dan berfungsi sebagai penanggung jawab sektor.
