Abstract

Build Operate and Transfer agreement is the utilization of state property in the form of land by another party by establishing a building and facilities, then utilized within a certain period which has been agreed, for after be handed back the land along with the building or facilities after the expiration of the term. This agreement comes as one of the new development patterns in terms of inviting the private sector to participate in national development and becoming a solution to problems in Indonesia in terms of land and funding. The method used in the writing of this essay is the method of writing normative juridical applying the rules of positive law, in the writing of this essay used several approaches are the approach of legislation, conceptual approach, and case approach. There are three principal in land law that have a role in the implementation of the Build Operate and transfer agreement, there are two ways of acquiring land management rights by investors in Build, Operate and Transfer Agreement, there are through a new concession or bankruptcy auction. Abstract

As the capital of Indonesia, DKI Jakarta is classified as having the highest population density, resulting in emergent problems in transportation- specifically traffic congestion. The use of basements may be a potential alternative in solving congestion problems in DKI Jakarta. In terms of licensing the use of underground space, used by PT Mass Rapid Transit Jakarta (MRT) as the responsibility of MRT infrastructure implementation and procurement, the authorized licensing is governed through regulation. From a legal perspective, a central issue may be the lack of clear legislation regarding the use of the basement. Therefore, an analysis of the governor’s licensing mechanism is required, as well as the governor’s issue of conformity with regulations, in addition to the legislation pertaining to the crypt. With normative juridical research, this article argues that those authorized to grant permits for the use of basements in an area are public officials, rather than the laws and regulations. The results of the study indicate that the mechanism of licensing the use of basements has been in accordance with the laws, as are the regulations through the regional authority to implement the regional autonomy. Abstract

Riau Islands Province is an island-based region consisting of a group of islands. The Province has a very strategic geographic location due to bordering the neighboring countries in Southeast Asia, viz. Singapore, Brunei Darussalam, Malaysia, Cambodia, and Vietnam. It is different from other Island-based provinces, in which it lies in the hub areas of Malacca Strait. It shows that the Province is an important location to trade from America, Europe and Asia, in addition to a plenty of marine resources that will potentially maximize local government’s revenue and prosper society in the province. However, such marine resource has not been well-managed by local government by which in 2013 the figure shows poverty rate remains high. The decline of poverty rate counts only in urban areas where they do not lie in submarine areas, but the poverty has increased and could not be well-resolved. It asserts that the Government of Riau Islands has not maximized local powers to resolve poverty problems in the region. Keywords: Policy, Local Government, National Marine Resources

Abstract

Collecting retribution is a policy from the regional government. The function of it is to improve the regional income where kinds of collecting retribution, one of them are parking retribution in Malang city, the parking retribution has been an amendment to regional law Malang city area number 3 of 2015. it is about public service retribution that is to improve regional income from the parking retribution. The amount of them is great because Malang is a big city. However, the real conditions do not match with the regional law, e.g it happens at some Indomaret or Alfamart minimarkets. The regional law states that at this minimarket, the customers must not pay for the parking retribution because the regional government has accepted a parking tax given by Indomaret or Alfamart's company. Abstract

This paper aims to revisit the procedures for internal dispute resolution of political parties through political party courts. Reformulation is the stage of law enforcement in abstracto by the legislature or is limited to the formulation of provisions and substances that will be regulated in law in accordance with the situation and conditions, both present and future. The political party court is an important institution in the law enforcement process that has a mixed-function, namely as a regulator, administrator, and even adjudicator with a quasi-judicial nature. Internal dispute resolution brought to the political party court is to ensure the freedom of political parties, as well as to limit government interference which can lock in the freedom and role of political parties as one of the institutions needed to exercise people's sovereignty. Thus, it is urgent to have the idea of ​​reformulating the procedural arrangements of the political party court which are in accordance with the principles of justice and can be accounted for. This is an answer to the problems of political party disputes so that these dispute cases can be accommodated through strict and perfect regulations.KEYWORDS: Reformulation, Political Party Court, Dispute Resolution, Political Parties.

Abstract

Di Indonesia sendiri ada 3 (tiga) jenis sistem pemilu yang perlu kita ketahui yaitu sistem pemilu distrik, sistem pemilu proporsional, dan sistem pemilu campuran. Di wilayah Papua khususnya di wilayah pedalaman atau perbatasan cenderung mengikuti pilihan ketua sukunya untuk menentukan pilihan. Dari 29 kabupaten/kota di Papua ada 13 daerah yang diberikan hak khusus (previlege) untuk menggunakan sistem pemilu tersendiri. Sistem khusus tersebut dinamakan sistem noken. Noken dalam bahasa Papua berarti tas atau kantong. Sistem noken tersebut bertentangan dengan Undang-Undang Pemilihan Umum yaitu pada Pasal 1 yang menjelaskan bahwa pemilu adalah sarana untuk melaksanakan kedaulatan rakyat yang dilakukan secara langsung, umum, bebas, rahasia, jujur, dan adil atau biasanya kita menyebut (luber jurdil) berdasarkan UUD NRI 1945. Hal ini menjadi sebuah pro kontra diantara pengamat hukum Indonesia karena ada beberapa pendapat yang mendukung sistem noken dilihat dari perspektif adat dan menolak sistem noken dilihat dari perspektif asas demokrasi dalam pemilihan umum. Sistem noken dalam pemilihan kepala daerah di Papua menurut studi kasus Putusan Mahkamah Konstitusi Nomor: 35/ PHP.BUP-XVI/2018 secara hukum dianggap tidak sah sehingga perlu dilakukan pemilihan umum ulang. Tetapi Mahkamah Konstitusi menetapkan pemungutan suara dengan sistem noken masih dapat dibenarkan, namun hanya berlaku di tempat dan waktu tertentu yang selama ini belum pernah melaksanakan Pemilu dalam bentuk pencoblosan langsung oleh pemilih. Kata Kunci: Noken, Pemilihan Kepala Daerah, Status Hukum.

Abstract

Anak merupakan sumberdaya manusia bagi pembangunan dan penentu suatu bangsa. Berkaitan dengan pemenuhan ruang untuk mendukung minat dan bakat anak ke hal yang lebih positif dan bisa menambah ruang kreatifitas bagi anak tentunya pemerintah juga perlu mendukung tidak hanya berasal dari orang tua saja. Karena dengan adanya dukungan dari seluruh pihak maka minat dan bakat anak bisa berkembang dengan baik didukung dengan berbagai saranan dan prasarana baik yang disediakan oleh orang tua, sekolah, dan pemerintah daerah setempat. Adapun peran yang dapat diberikan oleh pemerintah daerah setempat adalah dengan memberikan ruang bagi seluruh masyarakat diberbagai kalangan, salah satunya ruang terbuka hijau berupa alun-alun, sarana olah raga dan tempat bermain bagi anak yang ramah terhadap anak. Alasan pemerintah daerah memiliki peran dalam pemenuhanhak anak melalui ruang terbuka hijau ini tercantum dalam Undang-undang No. 26 Tahun 2007 tentang Penataan Ruang. Bahwa setidaknya pemerintah bisa memberikan sedikitnya 20% dari luasan wilayahnya untuk pemenuhan ruang terbuka hijau yang bisa digunakan oleh masyarakat dalam beraktivitas secara positif misalnya, di alun-alun kota. Penelitian ni menggunakan metode penelitian legal studies dimana mengungkap masalah yang ada di amasyarakat dengan kemudian memberikan solusi. Pada dasarnya dalam setiap upaya yang telah dilakukan oleh pemerintah telah mengarah pada pemenuhan hak ruang terbuka hijau baik public mapun privat baik berupa regulasi maupun program-program yang pro terhadap kepentingan anak. Namun masih ada beberapa hal yang menjadi kendala dalam melaksanakan program karena masih belum maksimalnya partisipasi dari seluruh stakeholder terutama untuk kondisi di Kabupaten Jember, sedangkan untuk di Kabupaten Banyuwangi secara keseluruhan bisa dikategorikan sebagai pemerintah kabupaten yang secara partifsipatif dalam hal pemenuhan ruang terbuk ahijau bagi anak, karena hampir rata di setiap program yang dilaksanakan selalu melibatkan peran dari seluruh stakeholder terkait.

Abstract

This paper aims to discuss Indonesia's current legal framework of citizenship following its more pervasive demand to adopt dual citizenship. It argues that several issues regarding citizenship law in Indonesia have been relatively problematic, mainly related to the change of citizenship status contentiously experienced by Arcandra Tahar, Gloria Natapraja, and Djoko Tjandra to the increasing demand for dual citizenship. On the other hand, in this context, Indonesia's diasporas have voiced this interest in legal reform, resulting in more flexible opportunities and supporting transboundary businesses, as they have encountered some challenges due to restricted citizenship regulations. Using legal research, this study showed that citizenship had become a strategic issue with far-reaching implications. While Indonesia adopts a limited scale of dual citizenship and the vigour for dual citizenship has increased, the flexibility over dual citizenship requires further study of national security and citizens' loyalty to Indonesia. This paper suggested in adopting India’s OCI model for Indonesia’s citizenship policies as ample opportunities for this country’s citizens with foreign status to continue enjoying and accessing their rights in Indonesia, except in the political field. This measure subsequently would be a step forward to adapt citizenship regulations to globalisation while still paying attention to the nationalism concern.

Abstract

PPAT diberi wewenang dalam membuatnya akta autentik mengenai hak yang dialihkan dikatakan Akta Jual Beli (AJB). AJB yaitu akta yang memberikan bukti sudah terjadi pengalihan hak terhadap pembeli dari penjual. Jual beli prinsipnya bersifat nyata serta tunai, yang mana dua pihaknya setuju dan persetujuan itu dituangkan pada akta autentik yang PPAT buat. Namun sesuatu yang tidak bisa PPAT hindari yaitu saat ada pihak yang dengan disengaja memberitahukan harga berdasar pada pedoman NJOP PBB untuk dicantumkannya pada akta PPAT, dikarenakan nilai yang lebih rendah daripada nilai transaksi yang sebetulnya, bermaksud agar terhindar dari pajak yang lebih banyak jadi terjadinya perbedaan harga transaksi pada AJB. Penelitian ini bertujuan dalam menganalisisnya tanggung jawab hukum bagi PPAT dalam AJB yang terdapat perbedaan harga transaksi dengan harga sebenarnya, untuk menjelaskan akibat hukum dari perbedaan harga transaksi dalam AJB dengan harga sebenarnya didalam sektor perpajakan, dan untuk mengetahui perlindungan Hukum bagi PPAT jika dalam AJB terdapat perbedaan harga transaksi dengan harga sebenarnya. Tipe penelitian ini yaitu yuridis normatif yakni dianalisis serta dikaji peraturan hukum yang sifatnya normal yaitu undang-undang. Pendekatan penelitian yang dipakai yaitu pendekatan undang-undang, konseptual dan kasus. Penulisan ini sumber bahan hukumnya memakai bahan hukum primer dan sekunder. Berdasarkan hasil penelitian tanggung jawab dari PPAT jika ada perbedaan harga transaksi pada akta jual beli yang dibuatnya apabila terbukti PPAT ikut andil dalam penentuan harga transaksi jual belinya yakni pertanggungjawaban baik dengan moral maupun hukum. Pertanggungjawaban secara hukum bisa seperti pertanggungjawaban administrasi (denda serta menjatuhkan sanksi seperti peneguran tertulis, skorsing dan pemecatannya dari jabatan), pertanggungjawaban secara pidana, dan perdata turut ditanggung PPAT apabila terbukti bersalah. Dampak hukum jika para pihak tidak taat pada peraturan hukum mengenai pajak yaitu Direktur Jendral Pajak waktu selama 0 bulan mulai ketika dikatakan utang pajaknya, sehingga surat ketetapan/penagihan BPHTP kurang bayaran akan diterbitkan. Perlindungan hukum terhadap PPAT yaitu mendampingi secara hukum pada proses pengadilan, yaitu membantu hukum kepada PPAT yang terkait pada permasalahan hukum sesuai yang terdapat pada Pasal 50 Peraturan Menteri Kepala Badan Pertanahan Nasional No. 2 tahun 2018.

Abstract

Regional finance is a right and obligation. Rights are regional rights to seek regional revenue sources in the form of collecting regional taxes, regional levies or other sources of revenue in accordance with applicable laws and regulations. Meanwhile, the obligation is the obligation of the region to issue money in order to carry out all regional government affairs. In its implementation, the financial management carried out by each region is accountable to the Supreme Audit Board (BPK). Regions that are categorized as good in financial management will receive an award in the form of an unqualified opinion (WTP). The Principle of Accountability in realizing WTP-based management can be interpreted as an effort to be accountable by creating oversight through the distribution of power in various government institutions so as to reduce the accumulation of power while creating conditions of mutual supervision.
