Abstract

The religion and science debate seem unrelenting. Science and technology are key element in the progress of human civilization towards the established of a knowledge-based society. But, science without religion is lame; religion without science is blind. The human life need direction and guidance. Science does notconflict with Islam, because the philosophy and theoretical foundations as well as the formula used by science turned out to be derived from the Koran and Hadith. Koran and Hadith are the main principle for developing the science and application of science through technology. In this paper the author triesto discuss the study of religion and science in which the author examines the book by Nidhal Guessoum, then analyzed with a phenomenological approach.Keywords: Religion, Science, Phenomenology.

Abstract

Abstract: This article analyzes the concept of good governance from the perspective of contemporary thought of Islamic law. Good governance is a new concept in islamic legal discourse, but an important one for preventing abuse of power. Good governance is understood to be applied in government and bureaucracy. Clean government should be effective, efficient, transparent, honest and accountable. This can be executed by using all available resources (human, social, culture, politics and economy) for the welfare of the community. Because of this noble goal, good governance is a must, from the perspective of Islamic law. The effort to realize welfare for the community by the state is in line with Islamic law. On the other hand, there is arguably no corresponding textual references from al-Qur’an or Hadith on the issue of good governance. Therefore the concept of mashlahah mursalah is employed since it highly built upon the accommodation of human welfare as it is the main mission of Islam. Abstrak: Tulisan ini menguraikan upaya good governance dengan sudut pandang hukum Islam kontemporer. Good governance merupakan gerakan ijtihâdiyyah dalam mewujudkan pemerintahan yang baik untuk menegasikan penyalahgunaan kekuasaan yang terjadi di dunia, khususnya di Indonesia. Good governance diartikan sebagai tata kelola pemerintahan yang bersih dan baik. Pemerintahan yang bersih adalah pemerintahan yang efektif, efisien, transparan, jujur, dan bertanggung jawab, sedangkan pemerintahan yang baik adalah pemerintahan negara yang berkaitan dengan sumber sosial, budaya, politik, serta ekonomi diatur sesuai dengan kekuasaan yang dilaksanakan pada masyarakat. Berdasarkan hukum Islam kontemporer, penerapan good governance di Indonesia harus dilakukan. Metode pencapaian kesejahteraan dalam bernegara dengan berbagai pemasalahan kontemporer yang timbul menyertainya harus disikapi secara hukum. Di sisi lain, secara tekstual, nas-nas syariat tidak menyikapi semua permasalahan yang timbul tersebut secara spesifik, maka mashlahah mursalah dapat dipertimbangkan sebagai salah satu metode ijtihad kontemporer untuk mengakomodasi kemaslahatan manusia dalam penerapan good governance, karena Islam datang sebagai rahmat bagi alam semesta.

Abstract

Fundamentalism Shari’ah or violence on the name of religion at this current, seem to still continue to do the whole group of Indonesian society or another. Even in some cases there are a strong shades to perpetuate such desecration. Exclusive religiousness with truth claims unilaterally still to show existence strong enough among religious groups, Muslims especially. They consider their religious understanding that they follow is a truth that is undeniable, and is considered a definite reflection from the source of religious teaching (narsisism). It is thus delivering religious communities to life of conflict vulnerable among humans, fellow adherents of religious different streams, and fellow people of different religion. in addition, understanding this model that will make the people of religion into understanding extreme religious. Religion understood as dogmas die and just take care of the afterlife and the divinity that does not have the ability to provide solutions that delight in solving problems of humanity manifested in contemporary life. This article tries to analyze the problems above by using the approach of phenomenology in sociology so that the readers able to see these problems with an objective view without losing common sense.

Abstract

This paper attempts to unravel the concept study of Maṣlaḥah posed by al-Būṭī, in this case he also proposes clear boundaries about Maṣlaḥah aligned with the Syarī’ah Islāmiyyah. Maṣlaḥah was a pleasure, therefore, all things are dangerous must be avoided. Requirements proposed al-Būṭī, started the benefit included on Syāri’goal embodied in Islam universal basic principles five, not contrary with the alQur’an), not contrary with al-Sunnah, not contrary with Qiyas, until its existence not negate another benefit that important more or equivalent. All this suggests caution al-Būṭī in offering Maṣlaḥah concept that he woke up so it is not contrary with religious rules. The benefit must have two footing. First, will of God and secondly, human interests, both of these things as contrary, but when examined more deeply has the estuary, that is human happiness in this world and hereafter
