Abstract

Introduction: The nominee agreement in practice is done as legal smuggling against land control for foreigners based in Indonesia, which the Agrarian Principal Law limits. Such restrictions result in foreigners finding a way to obtain property rights under the Nominee Agreement and b the basis of Article 21 paragraph (1) of the fundamental agrarian law of land ownership by foreign nationals with proprietary status contrary to the principle of nationality.Purpose/Objective Study: This research aims to find out how the practice of nominee agreements in land ownership for foreign nationals in Indonesia and the legal consequences of nominee agreements in the application of transfer of property rights to land in Indonesia.Design/Methodology/Approach: This study is normative juridical research beginning on a legal event and then looking for references to a norm system. This legal research is conducted by examining primary and secondary legal materials and non-legal materials relating to nominee contract practice on ownership of foreign national land in Indonesia. In this study, the approach was the statute approach by examining all laws and regulations relating to legal issues and case approach by examining several cases that have a relationship with the legal issues to be discussed.Findings: The result of this study is that the nominee agreement made to transfer ownership of property rights to Foreign Nationals contrary to Article 26 paragraph (2) of the Agrarian Principal Law, based on Article 1320 of the Civil Code, does not meet the objective requirement that lawful clause. The agreement becomes null and void and has no binding power and cannot be used for the basis of rights in obtaining ownership of land for Foreign Nationals in Indonesia.Paper Type: Research article

Abstract

Pengabdian ini bertujuan untuk memberikan solusi terhadap rendahnya keikutsertaan Keluarga Berencana atau angka partisipasi aktif Keluarga Berencana di Desa Seloharjo. Adapun angka partispasi masih dibawah rata-rata. Tingkat kelahiran bayi mencapai 14 anak perbulan, sedangkan tingkat kematian bayi mencapai 0. Sehingga pertambahan penduduk sangat signifikan. Tujuan program ini adalah menjadikan mitra sebagai Desa Sadar Keluarga Berencana sehingga kualitas penduduk akan semakin meningkat baik dari aspek kesejahteraan, kehidupan sosial, ekonomi maupun pendidikan. pemberdayaan masyarakat (partisipasi aktif) sebagai inti gerakan Desa Seloharjo sebagai Desa Sadar Keluarga Berencana, Pengabdian ini bertujuan untuk memberikan solusi terhadap rendahnya keikutsertaan Keluarga Berencana atau angka partisipasi aktif Keluarga Berencana di Desa Seloharjo. Abstract

Legal certainty for land ownership in the form of a certificate has been regulated in Government Regulation Number 24 of 1997 jo. Government Regulation Number 18 of 2021, but not all certificates provide legal certainty, as in civil case No. 282/PDT.G/2020/PN SMG, namely land ownership disputes, namely the existence of multiple certificates of land rights on the same plot of land. The research is to find out how legal protection is related to legal certainty for holders of proof of ownership of land rights based on Government Regulation Number 24 of 1997 jo. PP Number 18 of 2021 concerning Land Registration by disclosing facts according to the conditions and realities that exist in society. The method used is normative. Legal certainty regarding land ownership is evidenced by a certificate that has been made in accordance with applicable procedures. The inhibiting factor for the government in the land registration process so that the products issued do not cause administrative defects is the existence of socialization from the government, in this case ATR/BPN, for all processes and documents that need to be considered in the land registration process.

Abstract

Inside Pasar Swadaya Jembrana have at least 23 gold shops. In practice, the process of gold transactions does not always run smoothly. The making of gold have an obstacle in the gold sale and purchase agreements, gold's proprietor sometimes does not include purchase notes. Then brings discourse to legal issues, namely looking at the validity of the sale and purchase agreement and seeing whether the price set imposed on the store owner is by the process and mechanism that is not contrary to the law. This Research uses normative-empirical methods and qualitative with a constructivist paradigm. Found the validity of a gold jewellery sale and purchase agreement without a purchase note can be notarized as valid if it refers to Article 1320 KUHPer by not violating the provisions of that article. The determination and cut in the price of gold jewellery inscribed by the latter has the consequence that increasing the number of gold rebates to be sold, is based upon defaults made by the party (gold owner). The pricing is not done haphazardly, but with a negotiation process, until an agreement is reached, the calculation necessary is inseparable from the "package" that has been carried out in the world of gold jewellery transactions.
