Abstract

Nushūz means a wife do anything against her husband for no reason that can be accepted by Islamic law (wife nushūz), or husband does not carry out its obligations as stipulated in Islamic law (husband nushūz). This article intends to analyze the concept of nushūz according to Islamic law in the perspective of Fakhr al-Dīn al- Rāzī in his Qur’anic commentary (tafsīr). It also discussed about the solutions of nushūz according to the Qur’an. Based on the study of sura al-Nisa verse: 34, 35, and 128 that nushūz can be done even by the wife or the husband. When problems of nushūz already potentially shiqāq, it is advisable to appoint a ḥakam (mediator), both from husband’s families and wife's families.Nushūz berarti seorang istri melakukan perbuatan yang menentang suami tanpa alasan yang dapat diterima oleh hukum Islam, atau sebaiknya suami tidak menjalankan kewajibannya sebagaimana ketentuan hukum Islam. Artikel ini bermaksud untuk menganalisis konsep nushūz menurut hukum Islam dalam perspektif Fakhr al-Dīn al-Rāzī dalam kitab tafsirnya. Selain itu juga dibahas tentang bagaimana tawaran solusi nushūz menurut al-Qur’an berdasarkan kajian terhadap surat al-Nisā’ ayat 34, 35, dan 128 bahwa nushūz bisa dilakukan oleh istri maupun suami. Ketika permasalahan nushūzsudah mengkhawatirkan sehingga berpotensi shiqāq, maka dianjurkan untuk mengangkat seorang ḥakam (mediator), baik dari keluarga suami maupun keluarga istri.

Abstract

The research formulates the problem of how the position of the MUI’s recommendation in the legal system, the position of the MUI in the Muslim community and the MUI’s recommendation answers to the contemporary problems of Muslims in Indonesia. This study uses qualitative methods for data collection techniques, analysis and reports. The research findings show that in the legal system in Indonesia the MUI’s recommendation does not meet the elements as a statutory regulation. Where, the MUI’s recommendation is not generally binding and is not made by an institution authorized to stipulate laws and regulations, so that the MUI’s recommendation does not have binding legal force, has no legal sanctions, is an appeal and information, and as a legal reference for the Muslim community, MUI’s recommendation and The MPU differs from its enactment. Other findings show that for the Muslim community in Indonesia the position of the MUI’s recommendation is very urgent and important because it is the foundation of the religious community and the MUI’s recommendation is seen as knowledge that can educate the community. So that the MUI’s recommendation is seen as being able to answer and be a solution for all contemporary problems of Muslims in Indonesia. Keywords: Recommendation of MUI, Contemporary problem, Islamic Society in        Indonesia.

Abstract

The number of cases of violence against children that occur is considered as one indicator of the poor quality of child protection in Indonesia. The existence of children who have not been able to live independently certainly needs people as a place of refuge. The efforts to protect children's rights are a very important and urgent matter to discuss. Important and urgent considering that in recent years we have often been treated to various news and information about various acts of violence against children carried out by people who should be responsible for protecting these children.Islamic discourse and family law literature on the protection of children's rights is still very little to be found.  Islamic Compilation of Law (KHI) and Indonesian Marriage Law No. 1 of 1974 does not explicitly discuss the protection of the rights of children to legal sanctions for violators of children's rights in their articles.Likewise with some classical Jurisprudence literature does not concretely discuss the protection of children's rights and legal sanctions for violators of children's rights. This certainly has an impact on understanding and practices that occur in the community towards the pattern of protection of children's rights.This study will look at the concept and the development of child rights protection in Islamic family law and it’s concrete effort of Islamic family law in the protection of children's rights.This qualitative research method is a socio-legal study  with a case approach.The findings of this study are in fact, many children are neglected in their lives, both in families who are still intact, father and mother, especially in families whose parents are separated (divorced). Child protection in Indonesia has not been comprehensively accommodated, this is because many children still do not get their rights. The factors include the lack of the role of parents regarding their obligations related to the rights of their children

Abstract

The role of ulama or religious teachers are fully controled to internalize the values of Islam into Langkat societies. The role of ulama in Langkat in the past was very large and influenced compared with the present time. The shift position and the role of the ulama now is increasingly complex related to the change and the development of the society. In its popularity and development, ulama now not only rules in religious affair but also hasarole offered to the public affair related to the religious agenda of social change. Ulama now contributed in all issues interpretated to religion and public affair, such as teacher on religious references, give concrete evidence agenda of social change and cultural, economic guidance, and guide the behavior of religious people and even involvement in politics in society. Keywords: Role, Position, Ulama, Indonesia Society Abstrak Peran ulama atau guru agama dikendalikan sepenuhnya untuk menginternalisasi nilai-nilai Islam kepada masyarakat Langkat. Peran Ulama di Langkat dimasa lalu sangatlah besar dan berpengaruh, dibandingkan dengan saat ini. Pergeseran posisi dan peran ulama sekarang semakin kompleks terkait dengan perubahan dan perkembangan masyarakat. Dalam perkembangannya saat ini ulama tidak hanya berperan dalamhalkeagamaanmelainkanjugamemilikiperanmenawarkan kepada masyarakat berkaitan dengan agenda perubahan sosial keagamaan, baik menyangkut masalah interpertasi agama, cara hidup berdasarkan rujukan agama, memberi bukti kongkrit agenda perubahan sosial dan budaya masyarakat, melakukan pendampingan ekonomi, maupun menuntun perilaku keagamaan masyarakat dan bahkan keterlibatan dalam percaturan politik di masyarakat. Abstract

Unregistered divorce cases, i.e. -the divorce without wife’s consent as well as court’s trial- is still widely founded in society. The provisions stipulate that the divorce can only be valid if declared in front of the courtroom. This is as contained in article 39 of the Marriage Law No. 1 of 1974, which states that: Paragraph 1. Divorce can only be decided by an authorized court session but after the Court in concerned has tried and failed to reconcile the two parties; Paragraph 2. In order the divorce can be executed, there must be sufficient reasons, of which the husband and wife are not more able to live in a marriage as husband and wife in harmony. Paragraph 3. The detail of procedure for divorce before a court session is regulated in its own statutory regulations.Unregistered Divorce has caused many problems, including a). No marital status or, exactly, illegal perceived relation between husband and wife. This, in the next, generates problem when they separate with the fact that the husband committed to unregistered marriage usually just go and leave without permission of his ‘perceive’ family. How can the husband be brought to court to force him to pay the cost for Living of his ‘perceived’ wife and children. Other problem is about the legal status of his ‘perceived’ children. It is very often that the pairs of unregistered marriage avoid their obligations as parents since both parties are now in quarrelling. And least but not less is the existence of violence and abuse against wives and families.

Abstract

Polygamy is permissible in Islam. However, an absolute requirement of polygamy applies for a husband. It is allowed only if the husband could deal justly with his wives. If he is unable to act justly, then he is obliged to have only one wife.The provisions on polygamy in Indonesia have been regulated by Law No. 1 Year 1974 on marriage, and as a form of positive response to regulate a man who wants to marry more than one woman. Likewise, Compilation of Islamic Law (Kompilasi Hukum Islam-KHI) also regulates the polygamy’s terms and conditions for Muslims.Ideally, the two regulations - Law No. 1/1974 and KHI-- aim to provide terms and conditions of a man who wants to have next marriage. The provision is aimed to reduce men’s (husbands) arbitrariness on women (wives). Also, it helps in the creation of happy, prosperous, and peaceful family.

Abstract

The aim of this study is to see the divorce between a couple without court process decision as a crucial issue in Indonesian Marriage Act No. 1/1974. In an article 39 of the Marriage Act No. 1/1974 paragraph (1) mentioned:Divorce can only be done in front of a competence court and through the trial court after the Court tried and failed to reconcile the two sides. Even though Indonesian marriage act had reformed as a unity handbook for all Indonesian people, but in fact, its presence has not been received as positive response in terms of implementation and practice. For the majority of Malay community in the District of Tanjung Pura, the divorce can only be done in front of the judge and through the trial, as stated in article 39 of the Marriage, is relatively large wedge. Many factors causing its objections are: Fiqh oriented, internal judiciary, lack of legal awareness, and many factors related to facilities and infrastructures.

Abstract

Abstrak: Baiknya pondasi sebuah rumah tangga secara tidak langsung berpengaruh terhadap jatuh bangunnya sebuah negara, dan sebaliknya rusaknya pondasi sebuah keluarga berpengaruh terhadap merosot dan berkembangnya sebuah negara. Beberapa tahun belakangan ini jumlah permintaan gugat cerai istri terhadap suami mengalami peningkatan terutama dari isteri yang berkarir. Penelitian ini melihat permasalahan yang dibangun dengan menggunakan pendekatan kualitatif fenomenologis untuk melihat dan memahami faktor perceraian wanita muslimah berkarir di kota Medan berdasarkan fenomena, fakta dan data yang peneliti temui di lapangan. Berdasarkan temuan penelitian didapat bahwa untuk menegakkan konsep ideal sebuah keluarga sangat sulit untuk dilakukan pada masa sekarang. Kondisi perkawinan sekarang sangat berbeda dengan masa dahulu dalam pemaknaan relasi suami isteri. Dahulu pernikahan memiliki posisi sangat sakral, pernikahan dianggap sebagai ibadah, sehingga orang takut untuk bercerai, karena cerai dianggap aib dan dosa.Abstract: Women Prosecute: A Study of Divorce in Careered-Muslim Women in Medan City. The good foundation of a household indirectly affects the rise and fall of a country, and vice versa, the damage to a family’s foundation affects the decline and development of a country. In the last decade, the number of divorce petition against husbands has increased, especially from careered-wives. This paper attempts to study the problems using a phenomenological qualitative approach to thoroughly comprehend the factors of divorce of careered-Muslim women in Medan city based on the phenomena, facts and data that researchers encountered in the field. This study finds that to enforce the ideal concept of a family is not an easy task to do at present. The current condition and perception of marital tie within the society is very different from the past. At the early stage of development of human history, marriage were regarded as inherent in religious observance, and thus, people were reluctant to divorce since it was a disgrace and sin.Kata Kunci: gender, feminisme, cerai, wanita karir, Muslimah

Abstract

Abstract: Islam and Democracy: Relationship and Compatibilities. In recent years, Islam and democracy have often been characterized as polar opposites. Democracy is seen as modern and forward-looking, whereas Islamic ideas have been portrayed as idealizing a fossilized past and unresponsive to change. This paper presents a discussion of interrelationship between Islam and democracy. Thus it is fair to say that some of the Islamic tenets are in line with the principles of democracy, and perhaps that are potential contradiction of democratic values. Kata Kunci: Islam, demokrasi, politik, Indonesia
