Abstract

Banks have an important role in realizing SDGs, therefore the Bank must continue to develop its products and services to be directed towards sustainable economic activities and not too exploring resources. Based on The Appendix of the President Decree No. 59/2017 the Indonesian government directed the global target of economies inclusive regarding the participation of the financial services sector. The Banks will support the priority economic sectors development such as agriculture, processing industries, and infrastructure, Micro, Small, Medium Enterprises and Energy. Banks can participate by using a green loan policy. This research is a normative legal research, which focuses on examining the application of the rules or norms in positive law. The result is the Banks play a key role in society, banks have purpose to help develop sustainable economies and to empower people to build better futures. When banks will give a credit to those who have a business that has a direct impact to the environment, bank also can be offer a position as a manager of environmental recovery guarantee funds. In other side, Banks can provide green development, in a process of giving credit to the debtor; banks need to pay attention to the business legality of prospective debtors. Banks are required to ensure that prospective customers have a legal business and comply with all relevant laws and regulations.

Abstract

ABSTRAKRegulasi usaha pergadaian berkembang seiring dengan perkembangan kebutuhan alternatif pembiayaan, khususnya bagi masyarakat menengah ke bawah, serta pelaku usaha mikro, kecil dan menengah. Berlakunya Peraturan Otoritas Jasa Keuangan Nomor: 31/POJK.05/2016 tentang Usaha Pergadaian menjadi landasan hukum pengembangan layanan jasa usaha pergadaian dan membuka kesempatan bagi usaha pergadaian swasta. POJK ini bertujuan meningkatkan inklusi keuangan bagi masyarakat menengah ke bawah serta kemudahan akses terhadap pinjaman bagi masyarakat menengah ke bawah dan usaha mikro, kecil dan menengah. PT Pegadaian (Persero) akan mengembangkan layanan usahanya dengan menggagas gadai sertifikat tanah untuk memberikan akses pada petani mendapatkan akses pembiayaan modal kerja yang murah. Penelitian bersifat deskriptif analitis dengan menggunakan pendekatan yuridis normatif. Data yang digunakan adalah data sekunder dan diperoleh melalui penelitian kepustakaan, baik berupa bahan hukum primer, sekunder, dan tersier. Data sekunder dianalisis secara yuridis kualitatif. Hasil penelitian menunjukkan perkembangan regulasi pergadaian bertujuan menyediakan akses pembiayaan untuk menciptakan iklusi keuangan dengan memperhatikan perlindungan hukum bagi masyarakat. Perluasan objek gadai melalui gadai sertfikat tanah hanya dapat dilakukan berdasarkan prinsip syariah melalui akad rahn tasjily. Diperlukan dukungan hukum, khususnya kedudukan surat kuasa dalam eksekusi gadai sertifikat tanah.Kata kunci: gadai sertifkat tanah; usaha pergadaian; perkembangan regulasi ABSTRACTThe development of regulation of the pawn business are developing with alternative financing needs, especially for the lower middle class, as well as the micro, small and medium enterprises. The issuance of POJK Number: 31/POJK.05/2016 regarding Pawnshop Business which will become the legal basis for development of the business services of pawnshops and opens opportunities for private pawn business. The POJK aims to improve financial inclusion for lower to middle-income class and the ease of access to loans for the lower and middle-income class also for micro, small and medium enterprises. PT Pegadaian (Persero) develops its business services by pawning land certificates to give farmers access to cheap working capital. This Research was conducted by using the normative juridical method with an analytical descriptive approach. The data used are secondary data obtained through library research, whether in the form of primary legal materials, secondary, and tertiary. Secondary data are analyzed by qualitative juridical. The results show the development of regulation of pawnshop aims to provide access to finance to create financial inclusion with due attention to legal protection for the community. The extension of pawning objects through the pledge of land certificates can only be done based on sharia principles through the rahn tasjily agreement. Abstract

Rape, a violent act involving coerced sexual intercourse, necessitates the provision of emergency contraception services to prevent unwanted pregnancies. Competent and authorized healthcare professionals are responsible for delivering these services, which are governed by government regulations in accordance with the health law. Thus, the author explores the legal protection that emergency contraception services offer to both rape victims and healthcare providers, highlighting the underlying principles of this implementation. This research employs a descriptive analysis using a normative juridical approach. Findings indicate several barriers to service provision, including limited doctor knowledge, inadequate standard operating procedures, and exclusion from the hospital's essential medicine formulary. Emergency contraception services are legally regulated as part of the Health Law, as they fulfill the legal needs of rape victims, surpassing the hierarchy of Government Regulations. By preventing unwanted pregnancies without the need for complicated procedures like abortion, emergency contraception services significantly enhance the protection of rape victims and healthcare workers. However, the current regulations lack provisions mandating the provision of information and emergency contraception services to rape victims by healthcare providers. Consequently, not all healthcare workers are willing to offer these services due to the absence of legal obligations. To ensure the availability of emergency contraception services, legislative changes should be made by introducing new articles into the health law, explicitly stating the obligation of healthcare providers to offer emergency contraception services to rape victims.

Abstract

The rise of exchange rates other than the official state currency in the digital world raises its own problems. The development of the digital economy that is currently developing is supported by digital economic infrastructure, one of which is the official state medium of exchange. Therefore, this is a demand for the public's need for official state exchange instruments that can apply in the digital world. This was then answered by Bank Indonesia through the concept of Digital Rupiah and its derivatives in various Bank Indonesia Regulations. However, there are problems regarding the Digital Rupiah policy and the implementation of secure use of the Digital Rupiah sistem. This research was conducted using a normative juridical method, and the writing stage was carried out through a literature search which was carried out by examining secondary data including primary legal materials, literature, articles, opinions and teachings of experts and their implementation in laws and regulations. Based on the discussion, it can be concluded that policies related to Digital Rupiah as a modernization of financial market infrastructure are still contained in various regulations, including Law Number 4 of 2023, Bank Indonesia Regulation Number 23/11/PBI/2021, and Bank Indonesia Regulation Number 23/10 /PBI/2021. Digital Rupiah security arrangements in Indonesia refer to Bank for International Settlements (BIS) guidelines and include secure technology infrastructure, cloud-based cybersecurity services, risk management and compliance sistems, as well as application and infrastructure security integration through DevSecOps. Reliability certificates are regulated in Government Regulation Number 71 of 2019.
