Abstract

This article is a case study on the legal issues surrounding beatings and torture suffered by rape offenders incarcerated in the Wirogunan Prison, Yogyyakarta.  Purpose of this research is to identify profile of perpetrator and determinate what factors are behind this deviant behaviour.  This research uses a criminological method or approach. Data has been obtained from direct observation, expert interviews and literature review.  One of the important findings is that beatings and torture of rape offenders are justified by the general inmates on the basis of negative labelling given toward the offender and his crime.

Abstract

Gender Gender and corruption are the recent problems in the anti-graft issue. This research is aimed at understanding the profile and gender equality influence in the corruption eradication attempts in DPRD Kota Yogyakarta. The research uses the combination method between quantitative and qualitative data. The result of the research shows that: First, the aspects of values, state governance ethics, attitude guidance and accountability of women are better than those of men. Women have nine indicators of excellence, while male members of the legislatives only have seven indicators of excellence. However, there is a gender inequality in DPRD Kota Yogyakarta. The large gap of inequality occurs in the control of and benefit for the women in each activity they follow. Second, the superiority of woman in the corruption eradication attempt will not be meaningful without gender equality.

Abstract

This research discusses: first, the tendency of judges to impose imprisonment without considering any additional criminals in the form of counseling as a criminal sanction in KDRT (domestic violence); second, effective applicable policies in the implementation of Criminal Counseling. This research used normative approach with empirical data. The method of data collection was interview to judges to obtain primary data. The finding of this research shows: first, based on the existing facts, judges have never implemented any additional criminal in the form of counseling because it has not been well-known in court; there has not been any prosecution using Article 50 of UU PKDRT; the institution for counseling has not been established yet. Second, in the implementation of additional criminal counseling, efficient applicable policies in the future should refer to the idea of double track system, by optimizing both types of sanctions in a proportional manner (criminal sanctions and measures). Revision for stipulation in Article 50 point b is needed, so that it is more understandable and can soon be implemented by judges. In addition, the arrangement of standard operating procedure is needed for the implementation, supervision, and report of counseling process for the subject of domestic violence.

Abstract

Giving the criminal sanction, specialiy the gift of sanction with tradition fine in the cases of vioience, iike" Blood Fine" is valid to the citizens who have local law and the other ethnics who are loyal. "Blood Fine" can be a payment for fine, the assistance of financial on medical treatment and apologize. The judge in taking his decision must consider the local criminal law, more special the custom fine, but in the cases ofviolence on womanpositive law ignore the local law.

Tapi dalam ajaran agama Islam yang menghargai kehidupan manusia bagaimana kedudukan euthanasia itu sendiri. Apakah Islam akan membiarkan atau melarangnya secara tegas; dan tulisan ini akan memberikan sebuah pembahasan.

Abstract

The increase in criminal acts of women's violence during the Covid-19 pandemic has an impact on the difficulty of access to advocacy, on the contrary, the provision of advocacy service institutions is limited plus the lack of legal aid resources. This paper aims to analyze the typology of women victims of violence in using access to advocacy rights and fulfillment of advocacy for women victims violence through the legal education clinical model. The theoretical basis used in this paper is the theory of women's advocacy and clinical legal education theory. By using a normative approach through tracing primary legal materials, this paper shows that first, there are at least six groups of women in understanding the knowledge of access to advocacy, namely groups of women who do not know their right to protection; women's groups see their rights but don't know where to go to access justice; women's groups who know where to go and have the right to access justice but do not have the financial means or capacity to access justice; A group of women who learned helpness and apathy with this condition accepted them as victims; a group of women who fear that perpetrators will apologize if they seek legal help. 6. Women's groups who have high awareness and seek to find out solutions to the violence they experience. Second, efforts to fulfill women's advocacy rights through the development of a legal education clinical model can be achieved with a live client clinic model and a street law clinic with a basic curriculum model based only on law but on a sense of community justice.

Abstract

Law No. 23 of 2004 on the Elimination of Domestic Violence (UU PKDRT) explains that domestic violence (KDRT) is an act against a person - especially a woman - which results in physical, sexual, psychological, and/or neglect of the household including threats to commit acts, coercion or deprivation of liberty unlawfully and within the scope of the household. Thus UU PKDRT is a guarantee offered by the state to prevent, protect, and follow up on perpetrators of domestic violence, but it is not effective. This research aims to examine the ineffectiveness and seek the appropriate reformulation of the articles. This is a juridical-sociological research using the analysis approach on UUKDRT. The results of this study indicate that there are inefficiencies in the articles contained in the UUPKDRT, especially in terms of protection caused by several factors both from the community itself and from law enforcement officials.

Abstract

The disclosure of digital development and the openness of many online transactions often lead to data leakage. Furthermore, digital development on the one hand, provides benefits to the digital economy and at the same time also led to the new impact or threat to the conventional economy from the aspect of cyber-security vulnerabilities to harm customer information and challenge the concept of privacy. The lack of government consents the data protection against the 1945 Constitution. This study aims to propose accelerating the Indonesian Personal Data Protection Bill by The House of Representative Council (DPR). This study uses a normative juridical method with a statute approach, the data used is secondary data consisting of primary and secondary legal material. The result shows the urgency of designing new regulation prior to tackling the issue on data leakage and maintaining the confidentiality of the personal data of Indonesian citizens. Through the enacting PDP Law will benefit the stakeholders, the data owner and further recognition by other countries.

Abstract

Money laundering is regarded as one of the very serious white-collar crimes in this country is. A lot of people are involved in the debate on this topic, and nowadays people in this country are in the big spirit to always criticize every single aspect of the law enforcement in this case. This because, as has been commonly understood, money laundering happens is huge number of money. To be sure, the ratification of U.N. Convention Against Illicit Trafficking in Narcotic Drugs arid Psychotropic Substances 1988 gives promise to diminish this kind of crime.
