Abstract

UNCLOS 1982 menyatakan bahwa suatu negara pantai berhak mengklaim landas kontinen lebih dari 200 mil laut dan tidak boleh lebih dari 350 mil laut (landas kontinen ekstensi).Untuk itu negara pantai harus melakukan delineasi batas terluar LKE ini dan mengajukannya kepada Komisi Batas Landas Kontinen (Commission on the Limits of Continental Shelf, CLCS) melalui Sekretaris Jendral Perserikatan Bangsa-Bangsa (PBB). Indonesia merupakan negara pantai yang memiliki potensi untuk mengajukan Landas Kontinen Ekstensi (LKE). Kajian pendahuluan yang dilakukan beberapa pihak menunjukkan adanya kemungkinan Indonesia dapat mengajukan LKE untuk beberapa wilayah maritim. Dalam hal ini yang di analisis, status terkini dan tantangan yang dihadapi oleh Indonesia dalam proses delineasi batas terluar landas kontinen ekstensi dan pengajuan kepada CLCS.UNCLOS 1982 stated that a continental has the right to claim basis continent more than 200 miles from sea and not more than 350 miles from sea (LKE). For that case, continent should make the delineation  the outborder  of this LKE  and propose to the (Commission on the Limits of Continental Shelf, CLCS) through The Secretarial General of United Nations).Indonesiais continental which has potential to propose LKE. The  primary study done by some  parties showed that there is possibility forIndonesiaproposes LKE to have some maritime areas. In that case, it is analized the current status and the obstacle ofIndonesiain facing the process of delineation the out border of LKE and proposal to CLCS.

Abstract

Introduction: The International Labor Organization (ILO) defines a migrant worker as a person who migrates, or has migrated, from one country to another, with the intention of being employed by someone other than himself, including anyone who is regularly accepted, as a migrant, for a job.Purposes of the Research: To find out how international law regulates the protection of migrant workers and how Indonesia is responsible for Indonesian citizens who are migrant workers. Methods of the Research: This research is a normative legal research with analytical descriptive nature. This research was also carried out or only aimed at written regulations or other legal materials.Results of the Research: The results of this study indicate that the regulation on the protection of migrant workers has been regulated in international instruments, including the Maritime Labor Convention 2006. Furthermore, it is regulated in the ILO Convention 188 concerning the Work in Fishing Convention, then namely the International Convention On The Protection Of The Rights Of All Migrant Workers And Members Of Their Families.

Abstract

International Court of Justice Decision established Sipadan and Ligitan islands as a part of Malaysia’s souverign. This decision gives significant influenced for Indonesia and Malaysia, pariculary for Indonesia’s souvereignity. It’s important for Indonesia to made change of the position of archipelagic baselines were previously located for these two island. The changing of basilines position has influenced for Indonesia’s rules of territorial sea boundary, contiguous zone, exclusive economic zone, continental shelf, archipelagic waters and internal waters. Based on UNCLOS 1982, the exact position of each boundaries is still need to resolved further by both countries, because its should not be set unilaterally. Billateral cooperation between these two countries give oppurtunity to solved this problem equally.

Abstract

Introductioan: In fact, what happened in Afghanistan shows that the protection of civilians is not fully guaranteed, and the existing regulations on insurgency and armed conflict have always been entirely by the parties to the insurgency and conflict, indicating that it has not been implemented.Purposes of the Research: This writing aims to analyze and find out international law governing the control of territory by rebels and the legal implications of territorial control by rebels on human rights.Methods of the Research: The type of research used is normative, which is focused on providing explanations that explain a particular category. Approach the problem of the statute approach (statute approach) and the conceptual approach (conceptual approach). The collection of legal materials through primary legal materials is then free from secondary legal materials. The processing and analysis of legal materials is described in a qualitative way with the aim of describing the findings in the field.Results of the Research: Provisions regarding non-international armed conflicts / rebels are regulated only based on Article 3 of the General Articles of the 1949 Geneva Conventions and Additional Protocol II of 1977. There are several conditions that must be met in order for a rebel group to be recognized as belligerent and become a subject in international law. The legal implications of the Taliban's territorial control in relation to hostilities affect not only members of the military but also civilians. Moreover, as the weak and suffering party, civilians are easily the targets of violence with various false claims. Humanitarian law also regulates the protection of the civilian population in Article 27 of Convention IV of 1949. The government or state is obliged to fully enforce the law to protect those who are victims of violations of international humanitarian law. To protect human rights in various situations, legal means are needed to create legal certainty in the implementation of the protection of everyone's rights.

Abstract

This article discusses the legality of using the blockade method in armed conflict and its legal implications as a war strategy according to International Humanitarian Law. The purpose of this paper is to find out how the use of blockades of a legal nature and its implementation in accordance with Humanitarian Law.  As a method of war, blockade is often used in armed conflict to be a method that is not in accordance with international law sources because it can cause losses and casualties. In fact, there are many regulations governing the blockade including the Declaration of Paris 1856 which explains the effectiveness of the blockade, the Declaration of London 1909 which regulates the guarantee of the rights of neutral countries, the 1949 Geneva Conventions which also regulates provisions regarding the delivery of humanitarian aid during the blockade in conflict areas, the 1994 San Remo Manual which regulates the legal conditions for applying the blockade. In addition, this regulation is also often used by legal experts to express their opinions regarding the blockade so that it becomes the primary reference source for judges to find the law. Therefore, to complete the blockade provisions, the role of international organizations is needed to provide supervision, provide strict sanctions and the importance of state party commitments in implementing the blockade method.

Abstract

Introduction: This research discusses about about restrictions on women's rights by the taliban perspective convention on the elimination of all forms of discrimination against women (CEDAW) 1979 relating to cases of discrimination against women by the Taliban in Afghanistan. The Taliban restricts women's rights leading to discrimination against women.Purposes of the Research: This study aims to restore the rights of women who are restricted by the Taliban related to women's rights convention on the elimination of all froms of discrimination against women (CEDAW) 1979. Methods of the Research: This research uses the juridical normative method by using a statutory approach, a conceptual approach, and a case approach.Results of the Research: from the writings of the Taliban who have controlled Afghanistan, the Taliban have restricted women's rights. The rights of women that are limited by the Taliban are the right to get decent work and education. In convention on the alimination of all forms of discrimination against women (CEDAW) 1979 Article 10 regulates education and article 11 regulates employment.

Abstract

Introduction: As a country with many small islands bordering other countries, Indonesia has considerable potential for migrant smuggling practices. The smuggling of illegal immigrants is a type of global crime.Purposes of the Research: aims to identify and analyze international law governing the smuggling of transnational migrants as well as to identify and analyze the accountability of perpetrators who smuggle transnational migrants.Methods of the Research:  This legal research uses normative juridical research, case approach, statutory approach, and conceptual approach, primary and secondary legal materials, legal material procedures using primary legal materials which are then associated with secondary legal materials and processing and analysis of legal materials using qualitative descriptive analysis.Results of the Research: The results showed that the international legal arrangements that regulate migrant smuggling are the Palermo Convention (UN Convention / UNTOC) of 2000 concerning Transnational Crime (People Smuggling), the Migrant Workers Convention (International Labor Organization / ILO) of 1990, the Protocol for the Eradication of Smuggling involving People Smuggling 2000, and the perpetrators' accountability using the National Law or Indonesian Law, namely Law No. 6 of 2011 concerning Immigration.

Abstract

International agreements in relation to the settlement of international disputes that occur in a country is the basis or benchmark in resolving conflicts that occur in a country. Purposes of the Research provide academic input for the development of legal science, especially in the field of International Law, International Treaty Law related to the regulation and legal impact of the peace treaty between the United States and the Taliban on the stability of Afghan state security. The research method used in this research is normative legal research by reviewing legal literature materials through a statutory approach, case approach and conceptual approach. The sources of legal materials used are primary, secondary and tertiary legal materials. The technique of collecting legal materials is carried out by library research using qualitative analysis techniques. The results of the study show that the agreement between the disputing parties is a formal commitment between the opposing parties to end the war, as stipulated in article 33 paragraph (1) of the UN Charter and in article 2 paragraph (1) of the 1969 Vienna Convention on International Agreements. The implication of the peace agreement between the United States and the Taliban is that there will be political and security instability in Afghanistan which has the potential to last for a long time. Where the Taliban have not created a conducive government system and have not received the support of the international community so it still takes time to create stability for the country of Afghanistan.

Abstract

ABSTRACT: The United Nations (UN) is one of the most important international organizations today. A security officer at the UN representative office in Guzara District, Herat Province when the building became the target of an attack in the middle of a battle between the Taliban militia group and Afghan troops. The purpose of this research is to know and analyze the arrangements for UN employees serving on the territory of member countries according to the UN Charter and to find out whether the UN can legally prosecute the killing of UN employees. The method used is a normative juridical research method using a statutory approach, a conceptual approach as well as a case approach. The results of this study explain that the regulation of cases of murder of UN employees serving in an area is the most important matter according to international law, the UN in this case an international organization must guarantee in upholding the case.
