Abstract

Nowadays, awareness of healthy life is increasing tremendously. That makes people try every way to find the best thing for their health. A method that attracts many peoples attention is alternative treatment such as acupuncture. The method developing in acupuncture treatment is maintaining bio-energy balance in human body. This, accordingly has increased the number of acupuncturist. The government in this matter has anticipated with the regulation as stated in UU No. 23 of Health, especially ps. 47 and PERMENKES RI No. 1076/SK/VII/2003 of Traditional Treatment. This is aimed to minimize the unwanted cases.

Abstract

Menghadapi era Masyarakat Ekonomi ASEAN khusus di bidang ketenagakerjan, yaitu dengan masuknya tenaga kerja asing ke Indonesia, itu tidak bisa dihindari dan harus dihadapi dengan kesiapan tenaga kerja Indonesia untuk bersaing di segala bidang, dan hal yang paling mendasar adalah implementasi terhadap peraturan hukum ketenagakerjaan yang harus benar-benar diterapkan terhadap penggunaan tenaga kerja asing. Pengawasan terhadap pelaksanaan Keputusan Menteri Ketenagakerjaan RI sebagai pelaksana Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, merupakan proteksi yang memberi batasan-batasan terhadap jabatan-jabatan tertentu yang dapat diduduki oleh tenaga kerja asing yang bekerja di Indonesia dengan memiliki standar kompetensi dengan batasan jangka waktu bekerja serta wajib ada tenaga pendamping tenaga kerja Indonesia, harus benar-benar selektif mungkin untuk diterapkan sehingga tidak terjadi di lapangan kerja di Indonesia semua pekerjaan dapat dikerjakan oleh tenaga kerja asing, batasan-batasan mengenai pekerjaan dengan jabatan-jabatan tertentu serta batas waktu dengan tujuan memberikan perlindungan kesempatan terhadap tenaga kerja Indonesia.Facing the era of AEC specialized in the field of employment i.e. with the influx of foreign labor to Indonesia, it is inevitable and must be faced with labor Indonesia’s readiness to compete in all areas, and the most fundamental thing is the implementation of regulatory labor laws that should be completely applied to the use of foreign labor. Supervising the implementation of the Indonesia Manpower Minister Decree as the implementation of Indonesia Law No. 13 of 2003 about Labor, is a protection that gives restrictions against certain positions that can be occupied by foreign labor who work in Indonesia to have a standard competencies with limitation periods of work and assisted by Indonesian workers, also it have to be really selective to be implemented so that not all fields of employment may be filled by foreign labor, that’s why restrictions of employment with certain positions, also time limits is necessary in order to provide protection against Indonesian labor opportunities.

Abstract

Doctors who have Practice License are authorized to issue notification letters taking form of healthy letter; sick letter; the letter granting must be in line with medical standards, yet if the letters are made not based on actual conditions and the notification letters can harm other parties, thusly the doctor’s conduct can be sued by any party who suffer the loss, therefore, the doctor can be subject to sanction from Honour Council of Medical Ethical Code and can result in legal consequences either civil or criminal laws.

Abstract

Warga binaan dalam lembaga pemasyarakatan mempunyai kedudukan yang rentan terhadap pelanggaran Hak Asasi Manusia. Oleh karena itu pejabat atau petugas lembaga pemasyarakatan perlu memahami dan mengimplematasikan UU No. 12 Tahun 1995, serta UU No. 39 Tahun 1999. Lembaga pemasyarakatan dalam melaksanakan fungsinya mendasarkan pada asas pengayoman, persamaan perlakuan dan pelayanan pendidikan serta penghormatan harkat dan martabat manusia, karena warga binaan sebenarnya hanya kehilangan kebebasan sementara, tetapi mereka tidak kehilangan hak-hak yang lainnya.Inmates in correctional institutions has a vulnerable position against human rights violations. Therefore, officers or prison officers need to understand and mengimplematasikan Law. 12 of 1995, as well as Law. 39, 1999. Correctional institutions in carrying out its functions based on the principle aegis, equality of treatment and education services as well as respect for human dignity, because the inmates actually lost only temporary freedom, but they do not lose the rights of others.

Abstract

Aborsi adalah masalah klasik dalam dunia kesehatan yang selalu menimbulkan perdebatan sepanjang zaman. Dari segi istilah aborsi berarti pengakhiran kehamilan sebelum janin itu dapat tumbuh diluar tubuh ibunya. Aborsi dibedakan menjadi dua yaitu aborsi spontan dan aborsi buatan. Aborsi buatan dibagi lagi berdasarkan alasannya, yaitu aborsi kriminalis dan aborsi medisinalis. Selama ini aborsi pada kasus korban pemerkosaan dianggap sebagai tindak kejahatan. Namun dengan berlakunya UU No. 36 Thn. 2009 tentang Kesehatan, aborsi bagi korban pemerkosaan telah dilegalisasi. Kembali masalah ini menjadi kontroversi dan menimbulkan pro dan kontra pendapat dalam menyikapinya. Tulisan ini akan membahas tentang aborsi dalam berbagai perspektif yaitu etika profesi kedokteran, hukum Islam dan peraturan perundang-undangan di Indonesia. Dan aborsi bagi korban pemerkosaan memang bagai sembilu bermata dua. Tenaga kesehatan yang dihadapkan pada situasi tersebut akan mengalami dilema. Melakukan aborsi akan dihukum, tidak melakukan aborsi maka jiwa sang ibu hamil yang jadi taruhannya. Dengan memperhatikan bahwa pemerkosaan dapat menyebabkan trauma psikologis bagi korban, maka aborsi dilegalkan dengan memperhatikan pasal 75 ayat (2) huruf b UU No. 36 Tahun 2009 dan harus dilakukan oleh dokter professional sesuai dengan standar profesi serta memperhatikan ketentuan norma-norma dalam agama. Dalam tulisan ini akan dibahas tentang aborsi dalam perspektif etika profesi kedokteran, hukum Islam dan peraturan perundang-undangan dalam hukum positif Indonesia.Abortion is a classic problem in the world of health that has always caused debate throughout the ages. In terms of the term abortion means the termination of pregnancy before the fetus can grow outside the mother’s body. Abortion can be divided into two, namely spontaneous abortion and artificial abortion. Artificial abortion subdivided based on reason, namely abortion and abortion medisinalis criminalist. During this abortion in cases of rape victims are considered as a crime. But with the enactment of Law no. 36 years old. 2009 on health, abortion has been legalized for rape victims. Back problems are a matter of controversy, and raises the pros and cons of opinion in react. This paper will discuss about abortion in a variety of perspectives of professional ethics of medicine, Islamic laws and regulations inIndonesia. And abortion for rape victims is like a double-edged knife. Health workers who are faced with these situations will have a dilemma. Abortion will be punished, not doing abortion is the soul of the pregnant woman is at stake. Noting that rape can cause psychological trauma for the victim, then legalized abortion with respect to Article 75 paragraph (2) letter b Law No.36 of 2009 and should be done by a professional doctor in accordance with professional standards and observe the provisions of norms in religion. In this paper will discuss about abortion in the perspective of professional ethics of medicine, Islamic law and legislation in the positive law ofIndonesia.

Police Department is one part of criminal justice system in conducting police investigation to look for and find the suspects of the criminal then it is given feedback by arresting, jailing, and frisking as well as seizuring. The acts should be based on Decree Number 8 Year 1981 about Law Agenda on Crime to guarantee and protect human basic rights.

Abstract

Pengadilan Hubungan Industrial sebagai pengadilan khusus yang berada pada pengadilan umum mempunyai karakteristik tersendiri dalam penyelesaian sengketa dibandingkan dengan perkara perdata pada umumnya, penelitian ini bertujuan untuk mengetahui dan menganalisis ciri khusus penyelesaian sengketa melalui Pengadilan Hubungan Industrial. Penelitian ini merupakan penelitian normatif. Hasil penelitian ditemukan adanya beberapa karakteristik dalam penyelesaian perselisihan hubungan industrial melalui Pengadilan Hubungan Industrial sebagai berikut: Obyek perselisihannya meliputi di tingkat pertama mengenai perselisihan hak, di tingkat pertama dan terakhir mengenai perselisihan kepentingan, di tingkat pertama mengenai perselisihan pemutusan hubungan kerja, di tingkat pertama dan terakhir mengenai perselisihan antar serikat pekerja dalam suatu perusahaan. Subyek perselisihan meliputi: Pekerja, Pengusaha baik berbentuk Perseroan Terbatas maupun Perorangan, Serikat Pekerja, mengenai lembaga peradilannya meliputi Hakim Karier dan Hakim Ad Hoc, sedangkan mengenai hukum acara adalah hukum acara perdata sepanjang tidak diatur secara khusus oleh Undang-Undang Nomor 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial, dalam pengajuan gugatan wajib dilampiri risalah anjuran baik dari mediasi maupun konsiliasi dan menyangkut kuasa hukum, serikat pekerja/buruh dan asosiasi pengusaha bisa bertindak sebagai kuasa hukum untuk mewakili kepentingan anggotanya, hal-hal tersebut yang membedakan penyelesaian perselisihan hubungan industrial melaui Pengadilan Hubungan Industrial dengan perkara perdata pada umum.The Industrial Relations Court as a special court in a public court has its own characteristic in dispute resolution compared to general civil cases, this study aims to identify and analyze the specific characteristics of dispute resolution through the Industrial Relations Court. This research is a normative research. The results of the research found that there are several characteristics in the settlement of industrial relations disputes through the Industrial Relations Court as follows: The object of the dispute covers the first level concerning the rights disputed, the first and final level is the interest disputes, the first level is the dismissal disputes, the first and the final dispute is between trade unions within a company. The subject of the dispute shall include: Workers, Entrepreneurs in the form of Limited Liability Companies and Individuals, Trade Unions, on judicial institutions including Career Judges and Ad Hoc Judges, whereas the procedural law is a civil procedure law insofar as it is not specifically regulated by Law Number 2 Year 2004 about Industrial Relations Disputes Settlement, in the forming of a lawsuit shall be accompanied by a recommendation note of both mediation and conciliation and concerning legal representation, trade unions and employers’ associations may act as a legal representative to represent the interests of its members, those which distinguish the settlement of industrial relations disputes through Industrial Relations Court with common civil case.

In the purpose of providing protection on the work forces, then it is founded a social insurance program for employees that provide protection or assurance including on workplace accidents, health service insurance, death fund and retired fund. It is the responsibility of employers to support the employees to participate in Jamsostek program because the program basically is the right of employees to be the member of the program conducted by the Jamsostek Ltd.

Abstract

National development is carrying out with final goal to achieve fair and prosperous. We for all Indonesian people. Worker; no exceptions, has an important role in national development. Therefore, the manpower development would also be an crucial thing to do, in order to get higher quality of skilled and trained worker; and to assure their normative rights, such as: the rights to get proper wages and leave, and also health and safety rights. These points has been regulated in UU No. 13 Th. 2003, Lembaran Negara Republik Indonesia Th. 2003 No. 39.
