Abstract

Limitations of law in cyberporn law enforcement demands the need for non-penal approach as pre-ventive effort to eliminate causes of Cyberporn crimes. This approach includes crime prevention which aims to prevent a crime from being recurred. This approach can be implemented through situ-ational control by active involvement of cultural roles in community. However, it cannot be separat-ed from observing human life variations including childhood, youth, family, school, gender, peer group which play significant role during productive period. Those variations cane be taken as a theo-retical base for cyberporn crime prevention.Keywords: pornography, internet, crime prevention

Abstract

Regulation No. 2 of 2008 on maintenance of Lampung is a legal Culture Standing for indigenous peoples associated with regional legal instruments. Problems arise, when the shape of local regulatory policies that were originally intended to fight for the achievement of the traditional values and culture of the community is contrary to the spirit of extracting the values that live in the community itself. Article 16 paragraph (1) of Regulation No. 2 of 2008 on Maintenance Culture of Lampung, stating that the existence of Indigenous Culture Lampung about marriage, must be kept, maintained and developed. Larian in Lampung customary marriage is basically not feasible with the social conditions of Lampung today, because there is a change in the meaning of larian, which turned into a violation of law and violations of the constitutional rights of women. Larian marriage forms that ignore the girl's consent, is a violation of human rights and national marriage law. Therefore, the formulation of Article 16 of the Regulation on maintenance culture Lampung is unconstitutional.

Abstract

Indonesia as the largest Muslim country should ideally have a society with good legal culture. Criminal offense or a violation related to cyberporn, does not need to happen. Cyberporn crime is not only a legal issue, but it is more complex. The weakness of the legislation, as well as the technological advances that are supported by the low legal awareness of society, it will difficult to tackle the cyberporn crime. The role of religion is needed as ethical teachings. Indonesia, which recognizes the principle of the Deity as its first principle, mean idealizing the condition of religious society. Awareness of the law will also be easily formed in communities that implement the teachings of their religion well, including public awareness for not accessing the cyberporn. : Indonesia sebagai Negara umat muslim terbesar idealnya memiliki masyarakat dengan budaya hukum yang baik. Tindak pidana atau bentuk pelanggaran yang berkaitan dengan cyberporn tidak perlu terjadi. Kejahatan cyberporn tidak hanya merupakan permasalahan hukum, tetapi lebih kompleks. Kelemahan peraturan perundang-undangan serta kemajuan teknologi yang didukung dengan kesadaran hukum masyarakat yang sangat rendah mengakibatkan akan sulit menanggulangi kejahatan cyberporn. Peran agama dibutuhkan sebagai sebuah ajaran etika. Indonesia yang mengakui sila Ketuhanan sebagai sila pertamanya, berarti mengidealkan kondisi masyarakat Indonesia yang religius. Kesadaran terhadap hukum pun juga akan mudah dibentuk dalam masyarakat yang mengamalkan ajaran agamanya dengan baik, termasuk kesadaran masyarakat untuk tidak mengakses cyberporn.    DOI: 10.15408/jch.v5i1.3509

Abstract

Kerusakan lingkungan merupakan suatu proses yang tidak dapat dihindari, karena manusia hidup berinteraksi dengan alam dan lingkungannya. Sehingga, ikhtiar untuk mengendalikan dampak kerusakan lingkungan tersebut menjadi upaya yang harus selalu diperjuangkan. Penegakan hukum lingkungan hidup secara total enforcement oleh hukum pidana substantive tidak mungkin dilakukan oleh para penegak hukum, khususnya yang berkaitan dengan lingkungan hidup, karena tidak menyentuh akar penyebab kejahatan lingkungan. Tulisan ini mengeksplorasi penegakan hukum lingkungan dengan pendekatan religius. Kajian dalam tulisan ini berdasarkan penelitian kepustakaan dengan pendekatan yuridis normatif. Berdasarkan kajian tersebut, dapat diimpulkan bahwa sebagai bangsa yang religius, penyertaan peran agama dalam penegakan hukum Perlu diberikan ruang yang seluas-luasnya. Penegakan hukum yang selama ini ada cenderung mengabaikan keterkaitan ilmu hukum pidana dengan ilmu ketuhanan berimplikasi kepada terpuruknya keberhasilan penegakan hukum lingkungan. Upaya pencegahan kejahatan lingkungan hidup merupakan bentuk penanggulangan yang efektif, dengan menggunakan pendekatan religius dapat memperbaiki kesadaran masyarakat dan perilaku masyarakat yang taat hukum. This paper is discussing about the damage of ecology as an unavoidable process since human life will always interact with his/her environment and nature. Thus, the initiative to control the damage of ecology becomes the essential effort that must be struggled. The law enforcement on ecology thoroughly supported by the subtantive criminal codes which may not be undertaken individually by the law enforcer, especially when it relates to the ecology, as it does not touch the substantive causes of ecological crime. As a religious nation, the attaching role of religion in law enforcement need wide space. The implementation of law enforcement in the real life tends to ignore the law of crime toward theology which implicates to the declining enforcement of ecological law. The preventive effort toward the ecological crimes will be effective when it includes the religiuos approachment in it, and by implementing the religious approachment, it may improve the social awarnerss and the social obidient of law.
