Abstract

The inconsistency of law enforcement in implementing the substance of the narcotics law has led to a polemic in the community, especially against cases of drug abuse committed by minors, it becomes unclear, the approach method used in this study uses a normative juridical approach. The research found that children as perpetrators of narcotics crimes, if they are not proven to be dealers, which can be dangerous as a basis for imprisonment for children, it is necessary to be rehabilitated as regulated in the narcotics law. Considering that children who are perpetrators of narcotics crimes are only users and are affected by bad environmental conditions both in the family and the environment. Narcotics in the Islamic perspective is analogous to the prohibition of drinking alcohol. This prohibition is carried out because narcotics cause hatred, hostility, disaster and dangerous disasters, both for users, families, communities and the nation and state. Narcotics are prohibited in Islamic law and producers, dealers and users will be subject to Had or Ta’zir sanctions.

Abstract

This study aims: (1) To find out PP No.25 of 2011 regulates rehabilitation in the Therapeutic Community approach, (2) To find out Therapeutic Community at the Mutiara Abadi Binjai Rehabilitation Center based on PP No.25 of 2011, (3). To find out the Therapeutic Community at the Mutiara Abadi Binjai Rehabilitation Center in terms of Maqashid Al-Syari'ah. This research is a field research that uses empirical juridical methods. This research approach is statutory, case approach, conceptual approach. The sources of this research are primary data sources obtained directly from the original sources in the form of interviews, opinion polls from individuals or groups (people) and secondary data obtained through intermediary media or indirectly in the form of books, notes, existing evidence, or archives, both published and unpublished. The results of this study are the results of assessments and Ministerial Regulations", almost all of which are used as a reference by the Therapeutic Community as a method in the rehabilitation process such as the initial stage (induction) after undergoing detoxification, the primary stage (a social rehabilitation program of about 4 months), the re-entry stage. (facilitating residents to be able to socialize with outside life for 3-6 months. It's just that there are programs that are typical of the Therapeutic Community, namely the after care stage (friendship among former residents outside the orphanage), Therapeutic Community which is held at the Mutiara Abadi Rehabilitation Center Binjai also does not deviate from the provisions of the articles contained in PP No. 25 of 2011, such as the pattern of resident coaching, availability of infrastructure, medical and social rehabilitation, the Therapeutic Community approach at the Mutiara Abadi Binjai Rehabilitation Institution from the perspective of Maqashid Al-Syari' Ah, all achieved in terms of benefit as discussed in Maqashid Al-Syari'ah, especially on the five main principles that must be realized such as, hifzh ad-dn (maintaining religion), hifzh an-nafs (maintaining), hifzh al-'aql (maintaining reason), hifzh an-nasl (maintaining offspring), and hifzh al-ml (maintaining wealth).

Abstract

Indonesia's political chaos starting from corruption, collusion, and nepotism is an unresolved problem and there is no clear point until now. There is no proper formula and solution to solve this problem. Like a building, Indonesia is a strong country but very easily collapsed due to political problems, starting from individuals and groups. Therefore it is necessary to have a strong and sturdy construction to support the building so that it does not collapse easily. The reconstruction that was built by M.Iqbal with khudi gave birth to a healthy and dynamic politics. As for things that can strengthen khudi: Love, Faqr, courage or enthusiasm, tolerance, lawful business, and honest and creative work. This can be used as a reconstruction in contemporary Indonesian politics. A sense of love and full responsibility will color individuals who are involved in politics. Khudi as a philosophical thought serves to strengthen the foundation of Indonesian politics which is easily shaken. The type of research used in this research is descriptive analysis research in which in this case the political reconstruction will be based on M.Iqbal's theory, namely khudi. library research method. As a recommendation to address solutions to various contemporary Indonesian political problems, the political reconstruction offered by M.Iqbal with his khudi is considered necessary and able to answer these political problems.

Abstract

Classical theology is a legacy from past theologies in the span of Islamic history and has apologetic characteristics (long debates on the area of mortal sin, eschatology, heaven and hell and the eternity of the Qur'an) and romantic remembers and longs for the greatness and excellence of past theologians without filling and preparing for global competition to be faced, while the style of modern theological thinking is to prioritize substance rather than form, and function Islamic values to overcome concrete community problems such as ignorance, poverty, unemployment, and social backwardness and develop science and science within the framework of prosperity and the peace of mankind on this earth. The two theological styles that exist in society make the color of the paradigm of Islamic theology must be able to be dialecticized by adherents of more moderate theology, so that abandoning classical theology does not mean leaving totality but changing the construct of thinking towards the substance of ijtihad in accordance with messages of humanist values.

Abstract

Point inertia classical Islamic theology thought would appear in the realm of reality if the thought process faced with the reality or the reality of empirical social human life is always growing and developing in line with the growth of science and technology. Mohammed Arkoun is Algerian intellectuals who tried to reread the building of Islamic thought in comprehensive both involving thought kalam (theology), Sufism, jurisprudence, ethics and interpretation. In the Indonesian context, Arkoun thought first recognized in 1987 in a discussion on Empathy Foundation. Muhammad Nasir Tamara, who introduced first by writing an article entitled Mohammed Arkoun and Applied Islamology. In some writings about modernity, Arkoun does not explicitly formulate the constraints of modernity, let alone challenge under him. According to Arkoun, modernity can be divided into two groups, namely, modernity "material" and modernity "intellectual" or "cultural". The former means that much progress has occurred in the outer frame of the human form, while the latter includes the methods, analysis tools, and intellectual siakp which gives the ability to better understand the reality. One anxiety Arkoun against Islamic theological thought is the separation between Islam and Islam actual or conceptual separation between theory and practice which he said is the legacy of Descartes. Grounding Islamic theology in the context of modern life does require accurate strategies and methodologies. Abstract

Polarisasi politik muncul setiapkali kontestasi politik dimulai dan proses demokratisisi Indonesia mengalami polemik seputar isu tersebut, tidak saja di tingkat elit, tapi merambah pada konstituen di akar rumput. Kekhawatiran banyak pihak, polarisasi dapat membelah dan menciptakan segregasi sosial, hal itu dianggap menghambat kemajuan bangsa yang majemuk. Penelitian ini bertujuan memberikan pandangan objektif seputar isu polariasi dalam persepektif akademis sebagai dasar pertimbangan politik, bagi multikulturalisme Indonesia dengan pilihan politik yang sangat multidimensional. Studi pustaka, questioner, dan investigasi mendalam digunakan sebagai metode untuk mengumpulkan data primer dan sekunder melalui analisis konprehensif, terutama berbedaan motif dan orientasi politik dari aspek sosiologis. Hasilnya secara lebih objektif polarisasi dianggap tidak berbahaya bagi keutuhan, masa depan bangsa dan demokrasi Indonesia. Kesimpulannya bahwa polarisasi merupakan bagian tidak terpisahkan dari proses demokratisasi dengan paradigma beragam seperti: gagasan,  ideologi, kebijakan, dan teori politik berbeda. Heterogenitas pilihan politik elit dan konstituen mengkonseptualisasikan konsolidasi demokrasi dalam suksesi kekuasaan.

Abstract

Abstrak: Stunting merupakan suatu kondisi yang ditandai dengan kurangnya tinggi badan anak apabila dibandingkan dengan anak-anak seusianya, adapun hal ini disebabkan karena kurangnya nutrisi selama masa pertumbuhan anak. Di Indonesia anak yang menderita risiko stunting mencapai angka 21,6%, maka karena hal ini pemerintah melalui BKKBN membuat sebuah aplikasi Elsimil (Elektronik Siap Nikah, Siap Hamil) guna untuk mencegah dan menurunkan angka stunting. Yaitu dengan menjadikan sertifikat Elsimil sebagai salah satu syarat mendaftarkan pernikahan di Kantor Urusan Agama. Maka pada penelitian ini penulis ingin meneliti lebih dalam mengenai apakah ketentuan ini bertentangan dengan maqashid syari’ah ataukah sejalan, pada penelitian ini juga penulis melakukan studi lapangan di Kantor Urusan Agama Kecamatan Medan Tembung untuk mengetahui apakah aplikasi ini sudah di Implementasikan ataukah belum. Penelitian ini termasuk ke dalam penelitian yuridis empiris dengan menggunakan dua sumber data yaitu primer dan juga sekunder. Serta dalam pengumpulan data ini penulis menggunakan buku-buku dan literatur, serta melakukan wawancara terhadap beberapa narasumber. Adapun hasil dari penelitian ini adalah di Kantor Urusan Agama Kecamatan Medan Tembung penggunaan Elsimil sebagai salah satu syarat pendaftaran pernikahan belum terimplementasi secara keseluruhan, ada yang sudah menggunakan dan ada juga yang sama sekali belum mengetahui terkait keberadaan Elsimil ini. Menurut perspektif maqashid syari’ah penerapan sertifikat Elsimil sebagai salah satu syarat untuk mendaftarkan pernikahan dipandang sejalan dengan tujuan yang ada dalam maqashid syari’ah yaitu untuk melindugi 5 hal dasar berupa, agama, akal, jiwa, harta dan juga keturunan. Kata kunci : Stunting, Elsimil, Implementasi, KUA Abstract: Stunting is a condition characterized by a child’s lack of height when compared to children of his age, while this is due to a lack of nutrition during the child’s growth period. In Indonesia, the risk of stunting is 21.6%, so because of this the government, through the BKKBN, has created an Elsimil application (Electronic Ready to Marry, Ready to Get Pregnant) to prevent and reduce stunting. Namely by making the Elsimil certificate one of the requirements for registering a marriage at the Office of Religious Affairs. So in this study the authors wanted to examine more deeply about whether this provision contradicts the maqasid shari’ah or is it in line, in this study the authors also conducted a field study at the Medan Tembung District Office of Religious Affairs to find out whether this application had been implemented or not. This research is included in empirical juridical research using two sources of data, namely primary and secondary. As well as in collecting this data the author uses books and literature, and conducts interviews with several informants. The results of this study are that in the Office of Religious Affairs in Medan Tembung District, the use of Elsimil as one of the requirements for marriage registration has not been fully implemented, some have used it and some have not even known about Elsimil’s existence. According to the maqashid syari’ah perspective, the application of the Elsimil certificate as a condition for registering a marriage is seen as being in line with the objectives contained in the maqasid syari’ah, namely to protect 5 basic things in the form of religion, mind, soul, property and also offspring.
