Abstract

This study aims to identify and explore the challenges in the implementation of Resolution No. 4/2016 of the ICPO-INTERPOL concerning sharing and exchanging biometric data among the members of ICPO-INTERPOL in order to counter terrorist foreign fighters (FTFs). This research also aims to elaborate and describe the mechanism of collecting, recording, storing, and exchanging biometric data conducted by the Indonesian government.The mechanism of collecting, recording, and storing biometric data works through 3 main doors, namely: 1) in the process of making electronic Resident’s ID Cards (e-ID Cards); 2) in the process of making SKCK (Certificates of Police Record); 3) in the process of making e-Passports. In the implementation of Resolution No. 4/2016 of ICPO-INTERPOL, the most obvious obstacles and challenges are the absence of regulations concerning the protection of personal data, and also the fact that the biometric data system itself is still relatively new and the database is not fully developed. Until today, the INTERPOL National Central Bureau (NCB) for Indonesia does not have its own biometric database system; instead they are using the database that is centralized at Pusinafis Polri (the Indonesian National Police’s Center of Automatic Fingerprint Identification System).The results of the study reveal that the biometric data recorded, collected, and stored are big data, but so far in supporting law enforcement and crime prevention processes the data have only been used as comparative data. In addition, there have also been found indications of violations of personal data and privacy, for example in relation to the absence of mechanism for data retention, consent, processing, notification, and disclosure.

Abstract

Abstract The development of financial technology services has experienced extraordinary growth and can alter as source of fund for the community, especially start-up business or small scale entrepreneur. This development has also followed by negative aspect, namely the growth in the percentage of bad credit or the default rate of loan repayments of more than 90 days (TWP90). This is exacerbated by the absence of a sufficient regulation regarding the settlement of non-performing loans or defaults where this will cause high risk for fin-tech operators and financiers (investors). In fin-tech services, there are 3 legal relationships arise: 1) namely between loan recipients and loan service providers; 2) between service providers and lenders, and 3) between loan recipients and lenders. In addition, the validity of electronic agreements made in fin-tech services does not in conflict with the norms according to article 1320 BW concerning validity of agreement. Legal action that can be taken by fin-tech operators and investors are through litigation or non-litigation procedure respectively mediation, adjudication and arbitration.Keywords: Financial Technology; Fintech; Loans; Debt;Litigation; Non-Litigation.Abstrak Perkembangan layanan teknologi finansial atau yang lebih dikenal dengan financial technology di Indonesia telah mengalami pertumbuhan yang luar biasa dan bisa menjadi alternatif pembiayaan bagi masyarakat khususnya UMKM. Perkembangan ini juga dibarengi aspek negatif yaitu mulai tumbuhnya presentase kredit macet atau tingkat wanprestasi pengembalian pinjaman lebih dari 90 hari (TWP90). Hal ini diperparah belum adanya payung hukum dari regulator terkait penyelesaian pinjaman bermasalah atau gagal bayar dimana hal ini akan menyebabkan resiko yang tinggi bagi penyelenggara tekfin dan pemberi dana (investor). Dalam layanan tekfin terdapat 3 hubungan hukum yang timbul yaitu antara penerima pinjaman dengan penyelenggara layanan pinjaman, antara penyelenggara layanan dengan pemberi pinjaman, dan antara penerima pinjaman dengan pemberi pinjaman. Selain itu keabsahan perjanjian elektronik yang dibuat dalam layanan tekfin tidak bertentangan dengan syarat sah perjanjian menurut pasal 1320 BW. Upaya hukum yang bisa dilakukan oleh penyelenggara tekfin dan investor adalah melalui jalur litigasi atau non litigasi yaitu mediasi, ajudikasi dan arbitrase.Kata Kunci:Tekfin; Pinjaman Bermasalah; Gagal Bayar; Ligitasi; Non Ligitasi.

Abstract

Artikel ini adalah merupakan luaran dari kegiatan pengabdian masyarakat dengan judul Pendampingan Desa Wongsorejo Dalam Pelaksanaan Program Perlindungan Anak Terpadu Berbasis Masyarakat (PATBM) yang dilaksanakan pada tahun 2019. Program pengabdian masyarakat dilaksanakan di Desa Wongsorejo, Banyuwangi. Desa ini dipilih karena mengingat bahwa masyarakat baru mulai memiliki kesadaran akan pentingnya hak anak. Lebih lanjut, upaya perlindungan dan pemenuhan hak anak yang dilakukan di desa masih belum terpadu. Padahal di tahun 2016, Kementrian Pemberdayaan Perempuan dan Anak telah mengeluarkan suatu pedoman Perlindungan Anak Terpadu Berbasis Masyarakat (PATBM). Bentuk kegiatan pengabdian masyarakat ini adalah pendampingan kepada masyarakat Desa Wongsorejo dalam pelaksanaan programPerlindungan Anak Terpadu Berbasis Masyarakat (PATBM) mulai dari tahapan sosialisasi hak-hak anak kepada masyarakat sampai dengan penyusunan model perlindungan anak terpadu dengan melibatkan partisipasi anak dan masyarakat desa. Untuk luaran yang ingin dicapai dalam kegiatan ini adalah publikasi jurnal ilmiah dan media cetak, serta penyusunan model perlindungan anak sesuai dengan aspirasi anak dan masyarakat desa. Hal ini untuk menuju desa ramah anak yang menjamin terpenuhinya hak-hak anak dan berorientasi pada kepentingan terbaik bagi anak.

Abstract

Act is an essential instrument in the rule of law. As the basic for governmental regulation, the accuracy and legality of its drafting process should be placed as the main concern. This article examines such models of delegated legislation. In severe legislation product, some problems regarding the mistaken in the delegation process was still founded. This article recommends the importancy of limiting substance for each level of regulation to avoid redundancy. Regulation synchronization is needed in order to avoid inefficiency and reach the maximum aim of what the regulations is made for.

Abstract

Local authorities can be found in federal and unitary states. It is the spearhead of the states to enhance a more prosperous and democratic society which provides a range of services in the daily basis. This essay attempts to look at how the national government in unitary states designs local bill-drafting process by doing comparative analysis between Indonesia and Philippines using bill drafting process by Seidmans. By looking at the bill drafting process this essay is trying to figure out the variation of coordination between elements in the local government. Philippines, in this comparative study applied a more radical distribution of power than Indonesia. In Indonesia, however, the relation between the local legislative and executive in the bill-drafting process shows a weak separation. This article conclude that by figuring out the variation of coordination between elements in the local government, at least in Indonesia and Philippines it is seen that coordinated activities in the local legislative process reflects the chosen methods of distributing power taken by the states.Keywords: local authorities, government, local legislative, legislative drafting.

Abstract

Getting the public to participate in the government’s policy reflects a sense of control in democracy. However, constructing a mechanism of participation in legal provisions could be dilemma. It is important to realize that involving citizen in local government decision making particularly in law-making process has a fundamental difficulties; the essence of participation itself (openness and transparency) and the need to be efficient. This essay formulated an effective mechanism of public participation by juxtaposing steps in the local legislative process with the criteria of efficiency. This discussion is trying to encompass citizen participation from the initiation of a policy until it is enacted as a local legislation. Then in the next step, it will assess the elements that constitute an efficient drafting process. This article will consider such factors that are; financial cost; human resources or effort; wasted time; risk of failure; progress. The hypothesis is that not all of the means of public participation are efficient. The ideal notion of public participation put weighs on Local Authorities. What is needed to be underlined in this discussion is, to maximize the advantage of citizen involvement, it is important to look at the sequence where it should be held and what is the content. Moreover, the process of public participation should reflects principles namely: discovery, education, measurement, persuasion and legitimization.
