Abstract

Abstract A law must have a historical until it’s applied in life. The importance of a banking activity that affects the pattern of people's lives, especially Islamic banking which is increasingly in Indonesia. So this article will describe the history of the development of Sharia Banking Law in Indonesia and the implications of its development in the Practice of National Banking. The method used in this case uses a descriptive analysis approach. A qualitative method with library studies in the existing problems. Then, it can be seen that the regulations concerning banking have undergone several amendments which in the end of Law Number 21 Year 2008 has become the basis of applicable law. In its implications, there are also three stages, namely the stages of recognition, recognition and purification. So that as a legal practitioner in Islamic banking, it is necessary to carry out a continuous review to monitor banking activities in accordance with Islamic principles. And to improve knowledge and understanding so that the existing guidelines are not just regulations but are truly implied in accordance with applicable law.Keywords: history; Islamic banking; implications Abstrak Suatu hukum pasti memiliki perjalanan historis hingga diterapkannya dalam kehidupan. Melihat pentingnya suatu akivitas perbankan yang mempengaruhi pola kehidupan masyarakat, khususnya perbankan syariah yang semakin hari semakin bertambah di Indonesia. Maka artikel ini akan memaparkan sejarah perkembangan Hukum Perbankan Syariah di Indonesia dan implikasi perkembangannya dalam Praktik Perbankan Nasional. Metode yang digunakan dalam hal ini menggunakan pendekatan deskriptif analisis. Sebuah metode kualitatif dengan kajian- kajian kepustakaan dalam pemaparan permasalahan yang ada. Dengan ini dapat dilihat bahwa peraturan tentang perbankan mengalami beberapa amandemen yang pada akhirnya UU Nomor 21 Tahun 2008 menjadi dasar dalam hukum yang berlaku. Dalam implikasinya juga mengalami 3 tahapan, yaitu tahapan pengenalan, pengakuan dan pemurnian (Introduction, Recognition, Purification). Sehingga sebagai praktisi hukum dalam perbankan syariah perlu dilakukan penelaahan secara terus menerus untuk mengawasi kegiatan perbankan agar sesuai dengan prinsip Islam. Dan untuk meningkatkan ilmu pengetahuan serta pemahamannya agar pedoman yang ada tidak hanya sekedar peraturan namun benar-benar diimplikasikan sesuai dengan hukum yang berlaku.Kata Kunci: Sejarah; perbankan Syariah; implikasi

Abstract

This study aims to determine the waqf management in Gontor, especially in the waqf of rice fields. Pondok Modern Darussalam Gontor (PMDG) is one of the educational institutions in Indonesia that was donated in 1958. Gontor has several waqf lands that continue to grow every year. Its management is essential to know so that it can be imitated by those who need it. The Foundation of Waqf Preservation and Development of Pondok Modern Gontor (YPPWPM) manages Gontor's waqf assets in all its management. PMDG has a land area of 16.258.598 m2 or about 1.626 ha, spread throughout Indonesia. The rice fields have the most significant portion of their utilization, including the agricultural sector. This research is a descriptive study and the data comes from interviews and literature related to the waqf of Gontor. The results showed that the management of the waqf of rice fields owned by Gontor was managed by using a profit-sharing and rental system (ijarah). The waqf of rice fields in Ponorogo, Madiun, Kediri, Nganjuk, and Jember are operated by using a rental system. Whereas, waqf lands located in the Mantingan area are managed by utilizing a profit-sharing scheme. Hopefully, the study is able to enrich the literature on productive waqf land management.
