Abstract

Currently, the development and growth of Islamic banking show a positive trend that increases every year. This encourages Islamic banks to produce innovative products which customer needs. However, the methods used to develop products differ from one country and another. For Indonesia, one parameter is needed to harmonize all product developments produced by Indonesian Islamic banking. The purpose of this study is to explore the challenges of current Islamic banking in producing products and make a parameter as a reference for developing Islamic banking products with the Maqāsid Sharia approach for the realization of maslahah. To achieve this study using several methods such as interviews, content and descriptive analysis. The results of this study are the parameters that have been applied with the development product in Islamic banking Ponorogo citywith the Maqāsid Sharia approach. A product can produce maslahah if the five elements in Maqāsid shari’a are achieved, namely; (1) Preservation of religion by the basis of the product offered is based on the Al-Qur'an, Sunnah, and DSN-MUI, (2) Preservation of life, it is manifested by the service and supply to customers in accordance with Islamic ethics, (3) Preservation of intellect, with a form of banking business to explain in detail related to products offered to customers in a clear, (4) Preservation of wealth, it is realized with the management of property management client in Islam, (5) Preservation of progeny, by applying the four things previously, to guarantee halal and affect the sustainability of living for the family and the children of clients.

Abstract

This research is aimed at finding the curriculum design of Islamic economic, especially on its epistemological basis, its method of integration and its method of teaching. The object of research is postgraduate program at universities that offer the degree of Islamic Economic. The universities that will be researched represent four outstanding countries that have serious concern on Islamic economic studies. Those universities are International Islamic University Islamabad Pakistan, Istanbul Sabahattin Zaim University, International Islamic University of Malaysia and four Universities of Indonesia i.e. Islamic State University Sunan Kalijaga Yogyakarta, Islamic State University Sunan Ampel, University of Airlangga, and STIE Tazkia. The data will be collected through documentary and interview method. To analyze the data the researchers employs descriptive, compare and contrast, and synthesis method. The curriculum design that includes the vision and mission where epistimological aspects are clearly stated, in most of Islamic economics departments. However, not all departments that state explicity their vision and mission and objective clearly have clear statement on the integration of conventional and Islamic economics. Islamic State University Sunan Kalijaga Yogyakarta, Islamic State University Sunan Ampel, University of Airlangga, STIE Tazkia, and Istanbul Sabbahatain Zaim do not state clearly the vision and mission in relation the program of integration and Islamization. So the epistimological aspect is not taken into serious consideration as the vision and mission of the program. The Universities that clearly state the integration and Islamization are Islamic Science University of Malaysia, International Islamic University of Islamabad, and International Islamic University of Malaysia.

Abstract

Problems related to environmental damage is a hottopic discussed today. Aside from being concerned with thebasic needs of all humanity, environmental degradationgoes hand in hand with economic and technologicaladvancements which are expected to lead to humanbenefit and prosperity. One of the efforts made to provideenvironmental protection is to adopt the application ofStrict Liability in Anglo Saxon countries in solving cases ofenvironmental damage caused by corporations. Accordingto the principle of strict liability, the claim is not basedon an element of error but is based on the impact of thedefendant’s actions. One example of a forest and landfire that was successfully decided based on Strict Liabilityis the decision number: 456 / Pdt.G-LH / 2016 / PNJkt Sel. On the other hand, environmental problems arealso closely related to spiritual issues. As a living solution,Islam provides views through Muslim scholars regardingenvironmental issues with the inception of the idea of Al-Biah Fiqh. The approach taken through Maqasid Syariah,by combining hifdz al-biah as a matter of dharuriyat. Thiswas supported by Mustafa Abu Sway and also Ali Yafie.The results of this study indicate a paradigm differencebetween the more reductionist environmental law and amore holistic environmental law. But even so, Strict Liabilitycan be adjusted with fiqh al-biah with several conditions
