Abstract

Perjanjian baku dalam transaksi bisnis terjadi bukan melalui proses negosiasi yang seimbang diantara para pihak yang melakukan penandatanganan perjanjian karena hanya salah satu pihak saja yang membuat isi perjanjian. Perjanjian pemberian kredit dapat dikategorikan sebagai kontrak baku. Hal ini dapat dilihat dari bentuk dan format perjanjian kredit yang diserahkan sepenuhnya kepada masing-masing bank. Sehingga, klausula-klausula dalam dokumen perjanjian kredit semuanya dibakukan tanpa pemberian kebebasan untuk menegosiasikan kembali isi klausula kepada pihak nasabah debitur.

Abstract

Indonesia is a culturally megadiverse country, which is a source of Communal Intellectual Property. However, Communal Intellectual Property that has high economic value can lead to the misappropriation and destruction instigated by foreign parties. Thus, a Communal Intellectual Property legal protection is needed in the international and national law. This research aims to describe about communal intellectual property in national and international law. By using normative juridical research, statute approach, conceptual approach, and comparative approach regarding primary and secondary legal materials, it is then analyzed with the findings that Communal Intellectual Property protection in international and national law do not only cover legal protection in the field of Intellectual Property Rights. It also encompasses nonIntellectual Property Rights legal protection, both preventively and repressively (hybrid protection). This research has an essential meaning in the formation of national law on sui generis Communal Intellectual Property by adopting the best practices in the Philippines.Indonesia adalah negara yang kaya dengan keanekaragaman budaya, sebagai sumber Kekayaan Intelektual Komunal. Namun, dalam perkembangannya, Kekayaan Intelektual Komunal yang memiliki nilai ekonomi tinggi menjadi potensi penyalahgunaan dan perusakan oleh pihak asing, sehingga diperlukan perlindungan Kekayaan Intelektual Komunal dalam hukum internasional dan hukum nasional yang memadai. Penelitian ini bertujuan untuk memaparkan perlindungan Kekayaan Intelektual Komunal dalam hukum nasional dan internasional. Dengan menggunakan jenis penelitian yuridis normatif dan pendekatan peraturan perundangan, pendekatan konseptual, serta pendekatan perbandingan dari bahan hukum primer dan bahan hukum sekunder, maka kemudian dianalisis dengan temuan bahwa perlindungan Kekayaan Intelektual Komunal dalam hukum internasional dan hukum nasional tidak cukup hanya dengan perlindungan hukum di bidang Hak Kekayaan Intektual, namun juga meliputi perlindungan hukum non Hak Kekayaan Intelektual baik secara preventif maupun represif (perlindungan campuran). Penelitian ini memiliki arti penting dalam pembentukan hukum nasional Kekayaan Intelektual Komunal secara sui generis dengan mengadopsi praktik terbaik di Filipina.

Abstract

AbstractThis Paper aims to analyze the importance of Indonesian traditional cultural expressionsgoverned by sui generis. To obtain these objectives, this legal research uses statutory approachwith a systematic interpretation. Based on the results, it can be concluded that the regulationof Indonesian traditional cultural expression in Law Number 28 of 2014 about Copyright still cannot realize the protection of Traditional Cultural Expressions due to differences in charateristic between copyright with Traditional Cultural Expression. AbstrakTulisan ini bertujuan untuk menganalisis pentingnya ekspresi budaya tradisional Indonesia diatur secara sui generis. Untuk memperoleh tujuan tersebut, penelitian hukum ini menggunakan pendekatan peraturan perundang-undangan dengan penafsiran sistematis. Berdasarkan hasil pembahasan maka dapat disimpulkan bahwa pengaturan ekspresi budaya tradisional Indonesia dalam Undang-undang Nomor 28 Tahun 2014 tentang Hak Cipta masih belum dapat mewujudkan perlindungan terhadap Ekspresi Budaya Tradisional karena adanya perbedaan karakteristik antara hak cipta dengan ekspresi budaya tradisional.

Abstract

Justice in the field of land as a constitutional mandate is a foundation that must be regulated as contained in the provisions of Article 33 Paragraph (3) of the 1945 Constitution of the Republic of Indonesia which states, "Earth and air and the natural resources contained therein are controlled by the state and be used for the greatest prosperity of the people.”1 In order to achieve justice according to the mandate of the constitution, at least it can be realized through infrastructure development efforts in the national strategic project plan. This is in accordance with one of the priorities on President Joko Widodo's agenda to accelerate and continue infrastructure development. One of the many infrastructures that has become the object of a national strategic project is a network of toll roads or usually called toll roads.

Abstract

This research examines the legal protection of clients when the notary's wherea-bouts are unknown (lost contact).describe and analyze the certainty of legal protection for appearers who are harmed by a notary whose whereabouts are unknown (lost contact) and to analyze and formulate forms of legal protection that can guarantee legal certainty for ap-pearers who are harmed by a notary whose whereabouts are unknown (lost contact).This research is a normative juridical research through literature studyusing statutory approach (statute approach) and conceptual approach (conceptual approach). The main issues were analyzed using primary legal materials includingProvisions of Article 463 in conjunction with Article 467 of the Civil Code, provisions of Article 15, Article 16, Article 17, Article 62, Article 63 Article 67, Article 69 and Article 70 of Law Number 30 of 2004 concerning the Position of Notary Public juncto Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary, Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 15 of 2020 concerning Procedures for Examining the Supervisory Board of Notaries and Notary Code of Ethics. Legal materials were analyzed based on prescriptive analysis and grammatical and systematic interpretation techniques. Based on the research results it is known thatLegal protection for appearers who are harmed by a notary whose whereabouts are unknown (lost contact) based on the analysis of UUJN Amendment) is weak, because basically (“UUJN”) juncto (“UUJN”) Amendment has accommodated arrangements regarding the presence of a notary in the exercise of his office. No matter of how, there are incomplete norms in regulating the absence of a notary in Law Number 2 of 2014 concerning Notary office  (“UUJN”) juncto (“UUJN”) Amend-ment because it cannot accommodate the existence of a notary whose whereabouts are un-known (lost contact), including not being able to guarantee legal protection to appearers who are disadvantaged because the event of absence of a notary is not contained in the provisions in UUJN juncto UUJN Amendment which is used as a guideline results in legal uncertainty which causes legal protection for aggrieved appearers to be also not guaranteed

Abstract

This research is aimed at understanding and analysing the legal protection regarding the absence of product information labels on packaging. As legal protection for consumers is an important issue in the context of safeguarding consumer rights and interests, one frequently discussed aspect is the lack of product information labels on packaging. This disorderliness can pose various risks to consumers, such as difficulties in making informed purchasing decisions, financial loss, health, and safety concerns. This study adopts a Normative Juridical research approach. The analytical technique used in this research is descriptive analysis, examining various regulations and laws that govern consumer protection and product labelling. The research findings indicate that consumers have the right to obtain accurate, clear, and complete information about the products they intend to purchase or consume. The absence of product labelling on packaging can result in consumers' inability to make informed decisions. Therefore, various regulations and laws have been established to mandate businesses to provide accurate and complete information on product packaging. This research concludes that legal protection for consumers concerning the absence of product information labels on packaging is highly significant. Continuous efforts are required to enhance business compliance, effective law enforcement, as well as consumer education and awareness regarding the importance of obtaining accurate information before purchasing products.

Abstract

Kris is an object of Indonesian culture which has beautiful artistic and high economic values. Kris making is still maintained in several areas, one of which is in Sumenep Regency. Since 2014, Sumenep Regency has been recognized by UNESCO as the area that has the most Mpu (makers of heirlooms) in the world and most of them are in Aeng Tong-Tong Village. The tradition of making kris in Sumenep has existed since the time of the Majapahit Kingdom and has continued to this day. The rapid development of the industry and the number of kris makers in Sumenep have made Sumenep the Indonesian Kris City. The aim of this research is to analyze the legal protection of the Aeng Tong-Tong Sumenep Kris based on national laws and international conventions using a statutory approach. The legal protection of the Aeng Tong-Tong Sumenep Kris in national law is contained in Law Number 28 of 2014 concerning Copyright and Law Number 5 of 2017 concerning the Promotion of Culture, while the legal protection of the Aeng Tong-Tong Sumenep Kris in International Conventions is contained in The Convention on the Protection and Promotion of the Diversity of Cultural Expressions 2005, The Convention for the Safeguarding of the Intangible Cultural Heritage 2003, and The Berne Convention for the Protection of Literary and Artistic Work. In realizing optimal legal protection for the Aeng Tong-Tong Sumenep Kris in national law and international conventions, a comprehensive legal protection must be provided including legal protection for Intellectual Property and Non-Intellectual Property. (Keris merupakan benda hasil budaya bangsa Indonesia yang memiliki nilai seni yang indah dan nilai ekonomi yang tinggi. Pembuatan keris tetap dipertahankan di beberapa daerah, salah satunya di Kabupaten Sumenep. Sejak Tahun 2014, Kabupaten Sumenep diakui oleh UNESCO sebagai daerah yang memiliki Mpu (pembuat benda pusaka) terbanyak di dunia dan sebagian besar ada di Desa Aeng Tong-Tong. Tradisi pembuatan keris di Sumenep sudah ada sejak zaman Kerajaan Majapahit dan masih terus bertahan hingga kini. Pesatnya perkembangan industri dan jumlah perajin keris di Sumenep menjadikan Sumenep sebagai Kota Keris Indonesia. Tujuan pada penelitian ini untuk menganalisis perlindungan hukum Keris Aeng Tong-Tong Sumenep berdasarkan hukum nasional dan konvensi internasional dengan menggunakan pendekatan perundangan. Perlindungan hukum Keris Aeng Tong-Tong Sumenep dalam hukum nasional terdapat dalam UU Nomor 28 Tahun 2014 tentang Hak Cipta dan UU Nomor 5 Tahun 2017 tentang Pemajuan Kebudayaan, sedangkan perlindungan hukum Keris Aeng Tong-Tong Sumenep dalam Konvensi Internasional terdapat dalam The Convention on the Protection and Promotion of the Diversity of Cultural Expression 2005, The Convention for the Safeguarding of the lntangible Cultural Heritage 2003, dan The Berne Convention for the Protection of Literary and Artistic Work. Dalam mewujudkan perlindungan hukum yang optimal terhadap Keris Aeng Tong-Tong Sumenep dalam hukum nasional dan konvensi internasional, maka harus dilakukan perlindungan hukum secara menyeluruh meliputi perlindungan hukum atas Kekayaan Intelektual dan Non Kekayaan Intelektual.)

Abstract

The focus of this research is to reveal the extent to which the provisions of Article 18 UUPK have been implemented by tourism businesses to protect consumer rights and security. The research method uses an empirical sociological approach which uses field data as the main data source, such as the results of interviews, observations and documentation. The results provide a comprehensive picture of the practice of implementing Article 18 UUPK in the tourism services sector. These findings involve evaluating the transparency of information, security, and quality of services provided to consumers. That the main obstacles and challenges lie in human resources, and the factor of lack of awareness on the part of tourism actors. It is hoped that this in-depth study can contribute to improving policies and implementation of Article 18 UUPK, as well as increasing consumer protection in the context of tourism services.

Abstract

Legal protection of traditional cultural expressions in Indonesia is paramount to human rights. Indonesia is home to its richness of cultures and tribes, offering economic, social, and cultural values. However, this potential will remain insignificant without proper regulatory provisions in the domains of intellectual property or human rights. Departing from this issue, this research seeks to profoundly analyze the interface between traditional cultural expressions and human rights from the perspectives of either national law or international convention, and this analysis involves the comparison between Kenya and South Africa that appropriately govern legal protection of human rights in traditional cultural expressions. This research aims to elaborate on the interface between human rights and the protection of traditional cultural expressions within the purviews of national law and an international convention. With a legal research method and statutory, conceptual, and comparative approaches, this research finds that there is a close correlation between traditional cultural expressions and human rights, as referred to in international laws in Indonesia, Kenya, and South Africa, and the international convention. This research is expected to serve as a reference for Indonesian national law, in which adopting the best practices in Kenya and South Africa can be taken into account. Perlindungan hukum Ekspresi Budaya Tradisional Indonesia adalah pending untuk diwujudkan sebagai bagian dari hak asasi manusia. Fakta Indonesia sebagai negara yang kaya dengan keanekaragaman budaya dan suku bangsa menjadi potensi luar biasa nilai ekonomi, sosial dan budaya. Potensi luar biasa tersebut tidak dapat diwujudkan tanpa diikuti pengaturan hukum yang memadai baik di bidang hak kekayaan intelektual maupun hak asasi manusia. Atas dasar hal tersebut, menjadi penting untuk menganalisis keterkaitan ekspresi budaya tradisional dengan hak asasi manusia dalam hukum nasional, konvensi internasional, dan perbandingan di negara-negara Afrika, yaitu Kenya dan Afrika Selatan yang telah mengatur dengan baik perlindungan hukum atas hak asasi ekspresi budaya tradisional. Penelitian ini bertujuan untuk memaparkan interface hak asasi manusia dengan perlindungan ekspresi budaya tradisional baik dalam hukum nasional maupun konvensi internasional. Jenis penelitian hukum dengan pendekatan perundangan, konseptual, dan perbandingan maka ditemukan bahwa terdapat hubungan yang erat antara ekspresi budaya tradisional dengan hak asasi manusia sebagaimana terdapat dalam pengaturan di dalam hukum nasional Indonesia, Kenya, Afrika Selatan, dan konvensi internasional. Penelitian diharapkan dapat menjadi rujukan dalam hukum nasional Indonesia dengan mengadopsi praktik terbaik di Kenya dan Afrika Selatan.
