Abstract

Based on Article 363 paragraph (1) of the 4th Criminal Code, people who commit theft carried out by 2 persons together or more are threatened with a maximum imprisonment of 7 years. Therefore the Case of Crime of Theft with Violence using Firearms based on Decision Number: 42 / Pid.B / 2016 / PN.Swl and Decision Number: 43 / Pid.B / 2016 / PN. 1 (one) year and 10 (ten) months, charge the Defendant to pay a court fee of Rp. 5,000.00 (five thousand rupiah) and pay attention to Article 365 paragraph (2) of the 2nd Book of the Criminal Law. The specification of this research is descriptive analytical. While the approach method used is normative juridical. The data source used is secondary data. The data obtained were analyzed qualitatively and presented descriptively analytically. Based on the results of research and discussion, it can be concluded; First, the application of a criminal against a member of the National Police who commits a crime of theft with violence using firearms in the decision number: 42 / Pid.B / 2016 / PN.Swl and Decision Number: 43 / Pid.B / 2016 / PN.Swl are: Article 365 paragraph (2) of the 2nd Criminal Code, namely: "A maximum sentence of twelve years imprisonment, is imposed, (2nd) if the act is carried out by two people together or more", with the elements of criminal charges of the Prosecutor General, namely: Whose element of goods; Take something; Elements that are entirely or partially owned by others; Elements With the intention to be owned illegally; Elements That are carried out preceded by, accompanied by, or followed by violence or threats of violence, against a person with a view to preparing or facilitating theft, or in the event of being caught red-handed, to allow themselves to escape or other participants, or to retain possession of stolen property; Elements are carried out by 2 (two) people or more together. Secondly, the consideration of the judge in the application of the criminal to a member of the police who committed a crime of theft with violence using firearms in the decision Number: 42 / Pid.B / 2016 / PN.Swl and Decision Number: 43 / Pid.B / 2016 / PN. Swl are: juridical considerations: prosecutor's indictment, witness testimony, defendant's testimony, evidence. considerations that are non-juridical: the background of the defendant and the religion or belief held by the defendant, the physical and spiritual condition of the defendant, as a result of the defendant's actions

Abstract

The use of firearms for police personnel has been regulated in Article 8 paragraph (1) Perkapolri Number 1 Year 2009 and Article 45 Perkapolri Number 8 Year 2009. Firearms for members of the Police who carry out the function of law enforcement is to make a forced effort through the action of paralyzing, stopping, inhibits the actions of a person or group of people. However, in practice there is still a misuse of the use of firearms carried out in the execution of tasks and outside the execution of duties. The results showed that the use of firearms to improve performance in the prevention of crime in Polresta Padang ranks has been effective because with the many personnel but who have few firearms and only two members who do the misuse of firearms of service not for the benefit of the service and the tendency of decreasing the number of criminal acts.

Abstract

Narapidana mempunyai hak-hak yang harus dilindungi dan diayomi. Hak antara narapidana pria, narapidana wanita dan narapidana anak berbeda-beda. Sudah menjadi kodrat wanita mengalami siklus menstruasi, hamil, melahirkan dan menyusui yang tidak dipunyai oleh narapidana lain, sehingga sudah menjadi suatu kewajaran bahwa narapidana wanita mempunyai hak-hak khusus dibandingkan dengan narapidana lain. Penelitian ini dilakukan diLembaga Permasyarakatan Klas II A Padang dengan teknik wawancara. Dari hasil penelitian dapat diketahui bahwa pelaksanaan perlindungan hukum terhadap narapidana wanita di Lembaga Pemasyarakatan Klas IIA Padang belum dilaksanakan secara optimal. Hal ini disebabkan beberapa kendala yaitu : pertama, kendala internal yang berupa: kurangnya kualitas dan kuantitas pembina/pembimbing, sarana dan prasarana yang masih kurang, anggaran/dana yang masih kurang dan kedua, kendala eksternal yang berupa kurangnya partisipasi atau dukungan masyarakat.

Abstract

Kewenangan penyidikan tindak pidana perikanan dilakukan oleh Penyidik Pegawai Negeri Sipil (PPNS) dan Penyidik Angkatan Laut serta Penyidik Kepolisian Perairan. Sebagai salah satu subsistem peradilan pidana dalam pemberantasan tindak pidana perikanan Ditpolair Polda Sumbar diberikan kewenangan untuk melakukan penyidikan tindak pidana perikanan yang terjadi di wilayah perairan Sumatera Barat. Kewenangan yang diberikan kepada penyidik dalam melakukan penyidikan adalah penggunaan upaya paksa, namun demikian dalam pemberantasan tindak pidana perikanan masih menemukan kendala.Salah satu kendalayang dihadapi adalah terjadinya tumpang tindih kewenangan dan lemahnya koordinasi antar instansi dalam menjalankan tugas dan wewenang masing-masing penyidik sehingga pemberantasan tindak pidana perikanan belum optimal.

Abstract

Meskipun prosedur penggunaan senjata api oleh anggota Polri yang diatur dalam Perkap Nomor 1 Tahun 2009 namun penyalahgunaan senjata api masih ada saja dilakukan anggota Polri karena disebabkan faktor psikologis dan kurangnya pengawasan dari pimpinan di bidang kepolisian. Permasalahan yang dibahas tentang pelaksanaan prosedur kepemilikan senjata dan penggunaan api bagi anggota Polri, dan kendala-kendala dalam menerapkan aturan penggunaan senjata api, serta bentuk pertanggung jawaban pidana dan kode etik terhadap anggota Polri yang melakukan penyalahgunaan senjata api. Penelitian ini merupakan penelitian deskriptif analisis dengan pendekatan yuridis normative sebagai pendekatan utama dan yuridis empiris sebagai pendukung pendekatan utama. Hasil penelitian menunjukkan pertama, Prosedur kepemilikan senjata api adalah mengikuti tes psikologis, harus melalui izin Kasatker tempat personil bertugas, minimal berpangkat Bripda, Lulus Ujian menembak, Lulus tes kesehatan, Izin rekomendasi dari Propam dan Izin dari detasemen markas. Kedua kendalakendala penggunaan senjata api yaitu adanya perlawanan perlawanan fisik dari tersangka, perlawanan pasif oleh tersangka dan adanya sikap perlawanan aktif dengan menunjukan sikap yang berlawanan dan memolototi polisi, Ketiga bentuk pertanggung jawaban pidana penyalahgunaan senjata api berupa sanksi pidana dengan melakukan proses penyidikan terhadap anggota Polri tersebut hingga diproses sampai ke pengadilan, dan dalam bentuk pelanggaran berupa sanksi kode etik dengan penurunan pangkat atau yang paling tinggi adalah PTDH (Pemberhentian tidak dengan hormat).

Abstract

The offense of incitement is regulated in Article 160 and Article 161 paragraph (1) of the Criminal Code as an act whose offensive is directed to public order in which the regulation of this criminal act is intended to protect the legal interest of public order. The occurrence of an anarchist rally originated from the incitement of the suspect by inciting the masses, so that the words and sentences made by the suspect at the time of the mass rally became brutal and anarchic. Against the instigating action that resulted in anarchism, the mass of the investigator requested responsibility through the investigation process by applying the elements of the provision so that it could be qualified as a criminal act to incite others.

Abstract

Act Number 22 Year 2001 on Oil and Natural Gas regulated on prohibited and threatening acts with criminal sanctions for anyone who violates them. One of the prohibited acts is to commit criminal misuse of subsidized fuel oil (BBM). To be able to qualify such action, the police as investigator must pay attention to the elements of the provisions of Article 23 and Article 53 letter b and Article 55, so that will realize the effectiveness of law enforcement on the crime of misuse of subsidized fuel through the process of investigation with all the constraints faced in law enforcement.

Abstract

Article 75 of Law Number 35 of 2009 concerning Narcotics regulates the authority of police investigators and the National Narcotics Agency to conduct urine tests on narcotics crimes. The urine test test is intended to ensure the perpetrators consume narcotics so that they can be determined as suspects in criminal acts of narcotics abuse. The role of urine test results in an effort to apply the elements of the article and to prove a narcotics case is very important to be carried out in order to assist investigators in the inspection process and determine someone who is suspected of using narcotics as investigators of the West Sumatra Regional Police Directorate of Investigation cases of narcotics abuse committed by individual members of the National Police.

Abstract

The crime of rape of a child is part of a sexual crime, provided for in act No. 35 of 2014 on Amendment to act No. 23 of 2002 on Child Protection, which in the law regulates about sexual intercourse committed against children is contained in clause 81. Cases of child intercourse is one of the cases that became the scourge for the community and entered the stage of concern, because every day the crime rape involving children as victims we often hear and we know from various mass media. This happens not only in the school environment, home environment (neighbors), even in the family environment.Based on the above background, the authors formulate the problem as follows: First, how the implementation of legal protection for children victims of criminal rape in Polres Solok Kota? Second, what are the constraints faced in implementing legal protection for child victims of crime of rape and how to overcome these obstacles by Polres Solok Kota?The research that the authors do is an analytical descriptive study that describes the data as it is to then performed an analysis of the data based on relevant rules. The approach method used is the normative juridical approach that is a study that emphasizes or refers to the legal norms contained in legislation relating to diversion. This approach is also supported by an empirical juridical approach, namely by looking at how legislation is applied in field practice. The data source used is primary data and secondary data. The data obtained were analyzed qualitatively and presented in analytical descriptive form.Based on the results of research and discussion, it can be concluded that the legal protection provided by the investigators Polres Solok Kota in the form of the application of criminal provisions in accordance with the law of child protection and attention to the rights of children, providing easy access to information about the development of the case, public and safety assurance to child victims. The obstacles encountered by Solok Kota police investigators are first, from the victim's own children who feel shame, trauma and fear, overcome by providing understanding and assistance by parents / guardians / trusted people during the examination. Secondly, from uncooperative family side, so the investigator Polres Kota Solok provide legal understanding to the victim's child's family first. Thirdly, unlike the perception of law enforcement officers, regular coordination is required. Fourth, facilities and infrastructure in the area are still limited, so the government should try to equip all facilities and infrastructure needed for legal protection of children.

Abstract

Crime of theft that has a loss value of under two million five hundred rupiahbased on Article 1 and Article 2 of the Supreme Court Regulation Number 2 of 2012concerning Adjustment of Light Tipring and the Amount of Fines in the Criminal Codequalify as a misdemeanor. As a misdemeanor, the investigation and trial process iscarried out with a quick event. However, in practice, problems and constraints faced bylaw enforcement officers who are members of the criminal justice system arise,especially the police as investigators who are authorized by law to implement theprovisions of the Regulation as happened in the investigation of criminal cases of theftin the Resort Police Criminal Investigation Unit Padang City.
