Abstract

Tulisan ini membahas mengenai tidak ditempuhnya rehabilitasi kepailitan yang merupakan upaya hukum untuk memperbaiki nama baik Debitor, serta merupakan upaya hukum yang bertujuan agar Debitor pailit dapat lagi cakap dalam melakukan perbuatan hukum atas hartanya, yang semula kecakapan hukum tersebut hilang akibat putusan kepailitan. Dalam menyusun tulisan ini, digunakan metode penelitian hukum normatif dengan jenis pendekatan perundang-undangan, konseptual, analitism dan pendekatan kasus.  Hasil dari penelitian ini antara lain menjelaskan hal-hal yang mempengaruhi tidak ditempuhnya upaya rehabilitasi oleh Debitor pailit dan akibat hukum tidak ditempuhnya upaya rehabilitasi oleh Debitor pailit.

Abstract

This study aims to analyze the causes of non-fulfillment of life insurance benefit payments at PT. Asuransi Jiwasraya in the perspective of positive law that applies in Indonesia and the efforts taken by PT. Asuransi Jiwasraya in late payment of life insurance benefits. This study uses a normative juridical research method, where the legal problems that occur will be analyzed by the authors using a statutory approach and literature study. The results of this study indicate PT. Asuransi Jiwasraya does not fulfill the benefits of its customers, because it shows that they are in default on the policy agreement that has been agreed upon by PT. Asuransi Jiwasraya with customers, because of their carelessness in investing customer money which resulted in customers failing to get the benefits. The responsibilities carried out by PT. Asuransi Jiwasraya in accordance with the PT. Asuransi Jiwasraya with customers that if there is a dispute, the settlement will be carried out through deliberation, mediation, reporting to the OJK, legal channels or the courts. The settlement efforts did not result in deliberation, failed mediation and no administrative sanctions were imposed by the OJK, and there were also no claims for default from the courts. There is no dispute resolution contained in the policy agreement that brings results to get customer benefits. The solution from the author should be if PT. Asuransi Jiwasraya cannot pay the benefits directly, it can be done in stages with the customer's approval.

Abstract

Abstract Online shop is a popular shopping choice. attractive to consumers without having to visit the store directly, through internet applications can be easily accessed and ordered at a price offer that is sometimes also much cheaper than shopping directly coming to the store. However, the various conveniences offered in reality also cause various problems related to the protection of consumers in transactions at online shops, which oftentimes consumers also experience fraud, whether the goods have not arrived that have been ordered and paid for or the goods arrived but are not in accordance with what was ordered. There are still many cases of online buying and selling fraud, efforts are needed to reformulate existing regulations that have not been able to accommodate the interests of consumers, so it is also necessary to change the Consumer Protection Act which is more secure in providing legal protection to consumers in online buying and selling transactions as well as regulation of business actors. that adapts to the development of information technology and social changes in society. Abstract

Corruption Eradication Commission as Leading in Law Enforcement to fighting corruption in Indonesia named 256 suspects in corruption cases throughout 2018. This number could be increasing because of Corruption often involving family. The corruption that involving family needs particular treatment because of the massive and damaging impact of corruption generates disruption and distrust of state institutions. Family as the smallest unit of society has a role to provide character and moral education for their kids in an earlier stage. The amount of Corruption that involves the family attracts the researchers to conduct deeper research to find the best learning model for parents that can be applied to children and create a system and environment that supports anti-corruption behavior in the society and shaping anti-corruption behavior that applied in the family and school. The method used in this study starts with identified various literature related to the issue of corruption involving the family both in terms of problems and challenges faced by the community. The result of this research is the best way to prevent corruption is through anti-corruption education provided by the family itself and parents and the education from family starts from age 4-year old till 9 years old. The conclusion of this research is the best way to prevent corruption is by providing anti-corruption education to that example given by parents.

Abstract

One of approach used in knowledge asset (knowledge property/asset) assessment and measurement was Intellectual Capital that comprised of 3 main elements of Human Capital, Structural Capital, and Relational Capital. Creative industry is industry with uniqueness and put more emphasize on creativity, innovation and individual talent utilization require maximum management. This research intended to find model, on how correct intellectual capital component would be, and find actual description of Human Capital, Structural Capital as well as Relational Capital principles for creative industry in East Java. Samples in this research were leader/management/owner of 5 creative industry sub-sectors in 9 cities of East Java (Surabaya, Pasuruan, Probolinggo, Mojokerto, Batu, Malang, Kediri, Blitar, and Madiun) with 45 people respondents as samples. Analysis technique utilized in this research was Spider Plot Diagram. Survey and discussion result showed that Intellectual Capital Mapping on 5 (five) creative industry sub-sectors in East Java demonstrated that Relational Capital was more dominant followed by Human Capital, and Structural Capital as the least dominant.

Abstract

The term informed consent or consent for particular medical treatment was familiar in medical world. It brought security for both doctors who did their profession and patients who got information about the illness they were suffering from along with any medical treatment they would have. In fact, there were still many problems issued due to less-well implementation of informed consent. Therefore, this study aimed to analyze the characteristics of informed consent as the legal basis between doctor and patient and verify the establishment of agreement (i.e., consensus) in informed consent. It was a juridical-normative research with conceptual and statute approaches. The result of this study found that informed consent had distinctive characteristics compared with any other common agreements, in particular to its subject, object, and cause. Towards the establishment of consensus, it referred to the doctor’s offering to do any medical treatment and patient’s acceptance to have that treatment.

Abstract

The birth of several non-structural institutions is a sign that the development of Indonesia's state system is a responsibility to existing problems. The Corruption Eradication Commission is one of the institutions that was founded in 2003. This was born because the culture of corruption has spread to state administrators, including the police and prosecutors. The Corruption Eradication Commission has independent characteristics in carrying out its duties, namely it must avoid power intervention by both legislative, executive and judicial powers. Because in essence, the three components of the branch of power are the main components in the administration of the State which are also objects of the supervision of the Corruption Eradication Commission in determining state losses. However, the performance of the Corruption Eradication Commission has not escaped the public scrutiny because it is often considered to be an abuse of power. Law Number 19 of 2019 concerning the second amendment to Law Number 30 of 2002 concerning the Corruption Eradication Commission has created the KPK Supervisory Board which is alleged to be able to carry out the function of checks and balances. This is certainly a new history of the enforcement of corruption laws,, in which the Council has an equal position with the KPK leadership. And the authority given to the Corruption Supervisory Board is also quite central.  This study is a normative juridical research using the statutory approach

Abstract

Adanya permasalahan di taman wisata hingga merugikan pengunjung dengan ini perlu dipertanyakan mengenai perlindungan konsumen dan pertanggungjawaban hukumnya. Tujuan penelitian ini ialah untuk menggali pelaksanaan perlindungan konsumen berupa ganti kerugian sebagai pertanggungjawaban pihak pengelola taman wisata. Tipe penelitian yang digunakan adalah yuridis empiris, dengan pendekatan kualitatif. Studi lapangan dilakukan di taman wisata Kenjeran Park Atlantis Land Surabaya. Hasil penelitian menunjukkan bahwa perlindungan konsumen terhadap pengunjung taman wisata secara preventif belum dapat diwujudkan dengan baik, terbukti adanya fasilitas yang roboh hingga merugikan konsumen. Namun perlindungan secara represif telah diwujudkan dengan baik. Pertanggungjawaban hukum dengan ini telah dilaksanakan dengan baik oleh pihak pengelola taman wisata.

Abstract

Credit in Article 11 of Law Number 10 of 1998 refers to the provision of money or the equivalent thereof in the form of a bill, based on the agreement and mutual understanding between the two parties, namely the Debtor and the Creditor, with the obligation for the Debtor to repay the debt and interest obligations that have been determined. Before credit is granted to the debtor, the creditor will conduct a field survey regarding the debtor's financial activities until all conditions are deemed fulfilled, in order to avoid default issues in the credit agreement between the two parties. There are many ways to resolve default cases, and in BPR Surasari Hutama, resolving default issues in Credit Agreement No. B.28613/2019 that occurred in March 2019 with the guarantee of ownership documents of a 2005 Hyundai Excel motor vehicle was done by providing a multipurpose credit loan of Rp 15,000,000. It can be said that the loan became delinquent because the debtor did not have good intentions to repay the debt, resulting in an outstanding balance of Rp 9,800,000, and fled with the object provided as collateral. This study aims to understand the resolution of default in Multipurpose Credit with Motor Vehicle Ownership Documents as collateral and to determine that the creditor does not immediately execute the object but rather issues verbal or written reminders, such as Collection Letters or Warning Letters, in accordance with Bank Indonesia Circular Letter No. 26/4/BPPP dated May 29, 1993, and adheres to OJK regulations and Bank Indonesia Regulation No. 7/2/PBI/2005 dated January 20, 2005 regarding Restructurable Banking Credit.

Abstract

Perjanjian yang terjadi dalam pinjaman online pun harus didasarkan dengan undang-undang yang berlaku dalam segala aspek yang dilakukannya. Syarat sah suatu perjanjian yang dilakukan dalam transaksi tersebut haruslah sesuai dengan Pasal 1320 KUHPerdata. Sedangkan terkait pinjam meminjam sendiri harus sesuai dengan yang telah diatur oleh Pasal 19 ayat (1) POJK No. 77/POJK.01/2016. Maraknya masyarakat yang menggunakan pinjaman online membuat banyaknya perusahaan-perusahaan pinjaman online yang tersebar di masyarakat menjadikan penyebab dari banyaknya kasus penyalahgunaan kewenangan yang dimiliki oleh perusahaan pinjaman online. Kasus yang marak terjadi akibat pinjaman online illegal ini yaitu adalah ancaman dan juga penyebaran data pribadi. Perlindungan data pribadi itu sendiri telah diatur dalam Pasal 26 UU No. 19 Tahun 2016 Tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi.
