Abstract

Hukum pembangunan ekonomi Indonesia memilki peranan sebagai unsur pembaharuan terhadap arah kebijakan nasional yang harus dirasakan oleh semua masyrakat, Sistem Indonesia yang mengkhendasi negara kesejjateran mentutut agar masyarakat dapat merasakan nilai-nilai kesejahteraan dalam arti sesungguhnya, Namun dengan konsep serta pengakuan otonomi daerah yang memberikan keleluasan daerah dalam mengatur daerahnya tidak sedikit pula ketimpangan kewenangan sehingga dapat dicerminkan adanya sentimental otonomi daerah dalam pembangunan ekonomi, Tentunya dapat menimbulkan permasalahan dan pertanyaan Bagaimanakah aspek hukum otonomi daerah dalam pembangunana ekonomi negera berkonsep kesejahteraan, Metode penelitian ini penulis menggunakan hukum normatif (doctrinal research) yang mengkaji Undang-Undang Dasar 1945 dan Undang-Undang Nomor 23 Tahun 2014 Perubahan Kedua Undang-Undang Nomor 9 Tahun 2015 Tentang Pemerintahan Daerah, Hasil penelitian ini menyebutkan penerapan hukum otonomi daerah dalam pembangunan ekonomi negera berkonsep kesejahteraan yang tidak sedikit mengakibatkan ketimpangan, oleh karena itu pemerintah pusat dan daerah melakukan upaya yang terencana demi mensejahterakan masyrakat yang ada didaerah mengingat system otonomi daerah dalam pembangunan ekonomi mengalami sentimental kewenangan otonomi daerah.

Abstract

In general, there are several factors that led to the occurrence of a crime. The first is the factor that comes to or contained within the offender that predispose a person to commit a crime that arises from within itself the perpetrator based on the heredity and psychological (mental illness). The second factor is the factor that originate or are outside the personal self perpetrator. Such as a person who committed a crime because of the influence of the outside of the perpetrator based on the household and environmental factors. In the legal order of the Republic of Indonesia does not exist that specifically regarding the crime of homosexuals so often the deviation homosexuals do so more and more of the homosexuals themselves.

Abstract

The Article 18 of 1945 Constitution explains about the governance system in Indonesia recognizes the existence of central government and local government. The formation of local governance is based on the conditions of the vast territory of the country. Broad regional autonomy has the elaboration of decentralization in its entirety ideally the implementation in broad regional autonomy must have a principle of Democracy, Justice, Equity, Empowerment and Community Participation focused on increasing Economy in the region Each with the principle of Decentralization, but the implication of this declaration also makes the corruptors in the area more freely covered in a public policy or Public Policy is covered in an idea and the realization of activities in the area.

Abstract

One of the tasks that have to be done in forensic laboratory is the identification of fire victims with physical forms that are no longer recognizable. However, they still could be identified with the help of certificate from DVI (Disaster Victim Identification) and Post Mortem. One of the problems arise is that the family of the victims have no confidence that the victims identified are their family member. Based on the background of the study above, the researcher intended to conduct a study with the title of ’KEKUATAN SURAT KETERANGAN HASIL DVI DAN POST-MORTHEM SEBAGAI ALAT BUKTI KORBAN KEBAKARAN YANG MENGAKIBATKAN MENINGGAL DUNIA DIKAITKAN DENGAN PASAL 184 AYAT 3 KUHPIDANA’’. According to the tittle above, the identification of the problems are: How is the strength of the proof from the forensic laboratory evidence regarding the fire victims in association with Article 184 Section 3 of the constitution about witnesses? How is the strength of a DVI certificate, Post Mortem, and Anti Mortem in positive rules of Indonesia? This research is a normative juridical legal research. It is a study of laws and regulations in terms of the hierarchy of legislation. Article 133 Section (1) of the Criminal Procedure Code authorizes an investigator to submit a request for information to a judicial medical expert if the investigation involves a victim of injury, poisoning, or death. The expert statement request was made in writing form. It becomes the basis that the power of the DVI, Post Mortem, and Ante Mortem letters is very strong based on Article 133 Section 1 of the Criminal Procedure Code. The letter to be examined is the evidence made by the forensic laboratory. According to Article 187 Letter c of the Constitution Number 8 of 1981 concerning the Criminal Procedure Code states that: "A letter from an expert statement contains an opinion based on his expertise regarding something or a condition that was formally requested from him.” Finally, it can be concluded that the strength of the DVI letter, Post Mortem, and Ante Mortem could no longer be doubted because the government and institution have their own authority. However, it refers to the families of individuals who feel that they are not family members of the victims. They have other alternatives, such as rechecking the DNA testing, RNA, or other compatible identity.

Abstract

In a government organization, the expertise of the law making is most accumulated. It enables the law making process to be easily done by law the enforcers. This fact causes the role of government to be central. It also lead to an access of government organizations to become very powerful over the functions of organizations that exist within and outside the government. Therefore, to avoid concentration of power in the hands of government organizations, the idea arises to hold a separation and division of powers. The emergence of a constitutional idea of ​​a rule of law basically changes the power of the government. It makes their existence is not too dominant to see the Indonesian government system recognizing regional government and regional autonomy which are basically capable of impacting in the system of pillars of the democratic legal order. The shift of legislative and executive power within the framework of regional autonomy has indeed occurred with the dynamics of a structurally structured and infrastructural political life. It has an authority over each of the institution's committees. It acts an important function and even considered as the main function of the parliamentary institution. Important function is the legislative institution that is the institution legislators or institutions that determine the making of the law.

Abstract

Kepemilikan Kartu Tanda Penduduk (KTP) dan identitas kependudukan atau kewarganegaraan adalah hak sipil bagi semua warga negara yang telah cukup umur. Meskipun sudah ada ketentuan dalam Undang-Undang Nomor 23 Tahun 2006 Tentang Administrasi Kependudukan Pasal 61 ayat (2) , Namun penerapannya masih belum sesuai dengan Undang-undang yang mengatur perihal tersebut, Hal ini membuat warga negara penghayat aliran kepercayaan atau Komunitas Dayak Hindhu – Buddha Bumi Segandu Indramayu (Dayak Losarang) tidak memiliki identitas kependudukan (KTP) . Alasan yang sering dikemukakan oleh petugas adalah jika diisi dengan menggunakan kepercayaan lain selain agama yang diakui pemerintah atau jika dikosongkan maka database dari pusat tidak dapat membaca dan akan error, sehingga Dayak Losarang gagal memiliki KTP.Penelitian ini bertujuan untuk mengetahui bagaimana implikasi hukum jika kolom agama pada identitas kependudukan tidak di isi atau dikosongkan dan seperti apa kebijakan pemerintah sebagai upaya meniadakan warga negara yang tidak beridentitas kependudukan (KTP) .Guna mencapai tujuan tersebut maka penelitian ini menggunakan metode pendekatan yuridis normatif dan spesifikasi penelitian preskriptif. Lokasi penelitian di Tempat Perkumpulan Komunitas Dayak Hindhu – Buddha Bumi Segandu Indramayu. Sumber data yang digunakan adalah data primer dan data sekunder, yang disusun secara sistematis, logis dan rasional. Data yang terkumpul kemudian diolah, disajikan dan dianalisis secara normatif kualitatif.Hasil kesimpulan ini menunjukan bahwa Akibat Hukum yang timbul, Kartu Tanda Penduduk (KTP) tidak dapat diterbitkan, sehingga terdapat warga negara yang tidak memiliki identitas kependudukan, sebagaimana dituntut oleh Undang-Undang Nomor 23 Tahun 2006 Tentang Administrasi Kependudukan. Diperlukan tambahan variable keterangan mengenai identitas kolom agama, dengan dilengkapi menu pilihan yaitu “lainnya” atau kepercayaan terhadap Tuhan Yang Maha Esa.

Abstract

Undang-undang Nomor 23 Tahun 2014 Tentang Pemerintahan Daerah telah mengatur sebuah kewenangan Pusat, Provinsi dan Daerah telah mengatur sebuah tanggung jawab yang nyata dalam sebuah sistem hukum pemerintahan daerah, Dalam pasal 10 Undang-Undang Nomor 23 Tahun 2014 Tentang Pemerintahan daerah yang mengatur tentang kewenangan pusat yang tidak boleh dilakukan provinsi maupun daerah, hal ini menyoroti terhadap daerah yang dikatagorikan Non State Actors yang melakukan perjanjian Internasional yang masih menjadi titik fokus masalah dasar diperbolehkanya daerah dalam melakukan perjanjian internasional, bahkan tidak hanya sebatas melakuakn perjanjian internasonal akan tetapi merupakan perjanjian internsional yang dilakukan oleh daerah sebagai wujud impelentasi kewenangan daerah dalam sistem pemerintahan daerah. Provinsi atau Daerah dapat menjadi sebuah Non Satae Actors Dalam melakukan perjanjian internasional yang sudah dimanatkan oleh Undang-Undang Nomor 23 Tahun 2014 Tentang Pemerintahan Daerah yang di tegaskan dalam pasal 101 ayat 1 huruf G Dan Pasal 154 Huruf F walapun batasan dalam melakukan sebuah perjanjian yang dilakukan oleh Provinsi atau Daerah belum mendapatkan sebuah kepastian yang konkrit. Pemerintah daerah disini sebagai Non Satae Actor memungkinkan menjadi sebuah penentu kepekatan perjanjian internasional dan daerah sangat memungkinkan mempunyai kewenangan dalam menentukan perjanjian internsional guna meningkatkan dan memajukan daerah otonom tersebut, Mekanisme hubungan dan kerjasama luar negeri atas prakarsa Pihak Indonesia yang dilakukan oleh Pemerintah Daerah atau pihak-pihak lain (non state actors).

Abstract

Population Administration geared to meet the rights of every person in the field of population administration without discrimination through a professional public service. Registration is done by recording biographical data resident population, recording on events reporting population and population census as well as the issuance of citizenship documents.46 Law No. 24 of 2013 concerning changes to law Number 23 of 2006 concerning Population Administration emphasizes that in orderly management of population administration must make a Deed of Liability, Identity Card, And of course the Family Card of course it regulates the orderly administration regardless of their race, culture and class that respect each other's faith as Dayak Budha Bumi Segandu Indramayu Regency who have been discriminatory towards the creation of family cards that still see tribes, customs and traditions of a particular group. The long-term goals and specific targets to be achieved from this study are to provide an understanding of the implications of sanctions if the family card is not accompanied by religion and knowledge of a group of Buddhist dayak tribes and the obstacles and efforts of the Indramayu Regency government in implementing Law Number 24 of 2013 concerning Amendments to Law Number 23 Year 2006 concerning Population Administration. The method that will be used in achieving these objectives is to use normative legal research methods (doctrinal research) which mainly analyze primary legal materials and secondary legal materials equipped with field data. The implementation of the model for the formation of a Family Card registration policy by the Dayak Bumi Budhha Segandhu tribe in Losarang Subdistrict, Puntang Village, Indramayu Regency, adheres to the difficulties of registering a family card or other administration, The findings in the field prove that the people of the Segandhu Buddhist Dayak tribe adherents also have offspring and implementing compulsory schooling for 9 years The implementation is not in line with the Law

Abstract

Law Number 23 Year 2014 concerning Regional Government expressly wants that in this era of centralized regional government system towards decentralization, regional government and the community as well as all stakeholder components. The government must be able to direct various policies in the form of a framework for the implementation of regional autonomy policies at a point of accelerating the welfare of society through improving public services and optimizing the participation of the community in the process of regional autonomy in development.The author in this study wants to examine and analyze further the urgency of regional development planning in the era of regional autonomy and the obstacles and strategies for implementing regional development plans in the era of regional autonomy.The research method used is normative legal research, namely legal research carried out by examining library materials or secondary legal materials while the problem approach is carried out using a legal approach and conceptual approach.Development planning in a country or society that can be cultivated starting from the economy, natural resources. Human Resources and Infrastructure because the output of regional development planning is that local governments must encourage the achievement of a development plan based on regional planning. The preparation of the plan will always face obstacles in the form of unwillingness and the inability of the compiler to capture the philosophy and autonomization of the region.
