Abstract

The frightening global situation due to the COVID-19 pandemic has caused various problems related to health conditions, including mental health crisis. The fulfillment of mental health as part of human rights is a logical consequence of the ratification of the International Convention on Economic, Social, and Cultural Rights by Indonesia. The State as the duty bearer is obliged to fulfill, protect and respect every existing human right, including the right to health. This research aims to examine the relation between the regulation of the human right to health and the right to mental health and the State’s responsibility through the implementation of the fulfillment of mental health rights. The method used is doctrinal legal research. The result of the analysis found that the mental health right is an integrated part of the right to health with the main responsibility for fulfilling it is the State’s obligation according to the current constitution. There are several forms of substantial efforts by the State to fulfill it. Those implementation forms require efforts to increase and equalize facilities by the State to fulfill mental health right maximally.

Abstract

Abstrak: Salah satu upaya memberantas kejahatan perdagangan orang adalah melalui kerangka hukum pidana. Indonesia dan Singapura sama-sama memiliki aturan hukum pidana dalam menangani perdagangan orang, yaitu dalam Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang sedangkan Singapura diatur dalam Prevention of Human Trafficking Act 2014. Penelitian ini bertujuan untuk melakukan perbandingan hukum terhadap pengaturan di kedua negara. Penelitian ini merupakan penelitian hukum normatif yang bersifat preskriptif, menggunakan pendekatan perbandingan dan pendekatan perundang-undangan. Bahan hukum yang digunakan merupakan data sekunder terdiri atas bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier yang dihimpun melalui studi kepustakaan kemudian dianalisis dengan metode silogisme yang bersifat deduktif. Hasil penelitian menunjukkan bahwa pengaturan tindak pidana perdagangan orang di Indonesia dan Singapura memiliki persamaan diantaranya diatur dalam lex specialis, dan memiliki pengaturan delik pemanfaatan korban maupun delik penyertaan sedangkan perbedaannya adalah bentuk subjek pelaku, bentuk pemidanaan, serta beda dalam menentukan batas anak sebagai korban. Perbedaan pengaturan kedua undang-undang dapat dijadikan bahan pembaharuan hukum di masa mendatang.Kata Kunci: Perbandingan Hukum; Tindak Pidana Perdagangan Orang; Indonesia; Singapura.Abstract: One of the efforts to overcome the crime of trafficking in persons is through the criminal law framework.. Indonesia and Singapore both have criminal law that deals with human trafficking, namely in Law Number 21 of 2007 on Eradication of the Crime of Human Trafficking, while Singapore regulated in the Prevention of Human Trafficking Act 2014. This study aims to conduct a legal comparison of the regulations in the two countries. This research is normative legal research with prescriptive characteristics, using comparative and statutory approaches. The author used secondary data types, consisting of primary, secondary, and tertiary legal materials collected through library research and then analyzed using a deductive syllogism method. The study indicates that the regulation of criminal acts of human trafficking in Indonesia and Singapore has similarities as regulated in lex specialis, has the regulation of offenses for the use of victims and offenses for participation, while the difference is the form of the perpetrator’s subject, the form of punishment, and in determining the child as a victim. The difference in the regulation of the two laws can be used as material for future legal reforms.Keywords: Law Comparison; Criminal Act of Human Trafficking; Indonesia; Singapore
