Abstract

Technological advances have helped in the discovery of the latest medicines, this has further strengthened healthcare providers. However, this is not the case with consumers (patients). Consumers are less aware of their rights as users of goods and services so that which ones are good and which are bad, and which are really needed, consumers leave completely to competent health workers. This study aims to explain the legal protection of drug consumers for pharmaceutical services and to explain the liability of pharmaceutical companies regarding the losses suffered by drug consumers. This research used empirical law. Primary data sources were obtained by conducting field research with interview techniques and secondary data obtained by library research consisting of primary and secondary legal materials. The results showed that the legal protection of drug consumers in pharmaceutical services, which contains the rights and obligations of consumers as well as the rights and obligations of pharmaceutical companies as business actors. In principle, consumer legal protection is regulated in Law Number 8 of 1999 concerning Consumer Protection, in practice in pharmacies, legal protection for drug consumers is in accordance with applicable regulations and has been effective and conducive, then the responsibility of pharmaceutical companies for consumer losses drugs have provided compensation for material and immaterial damages when consumers are harmed.

Abstract

Fiduciary is one of the efficient guarantees for people who need funds amid the Covid-19 pandemic as is known the impact of this pandemic can be seen in the economic sector in Indonesia Banks are an effective intermediary institution as a channel for funds for productive financing activities which will encourage economic growth itself In this study discusses how PT Bank Mayapada Internasional Denpasar Branch provides policies in the midst of a pandemic like this then regarding the implementation of providing credit with fiduciary guarantees during the Covid-19 period as well as regarding the settlement of defaults related to providing credit with fiduciary guarantees during the Covid-19 period The type of research used is empirical legal research Based on the results of the study it is concluded that the implementation of the provision of credit during this pandemic begins with submitting a restructuring application then conducts analysis such as cash flow latest financial report checking account for the last three months collateral condition debtor s business visit and finally a new agreement is made Then the settlement of default is done by restructuring then mediation and finally by bringing the guarantee to the auction body.

Abstract

Copyright gives an exclusive title to the work of the author which is granted by law as an award. The copyright function protects creators from copyright infringement. This study aims to explain the form of legal protection for music and song copyright owners in royalty payments by the Indonesian copyright works foundation and to describe what factors influence royalty payments and dispute resolution efforts faced by music and song copyright holders in royalty payments by the Karya Foundation. Indonesian copyright. This type of research is an empirical legal research with a conceptual approach to legal issues of fact and sociology. The data sources used were primary and secondary legal materials. The results of the study indicated that copyright is regulated in Law Number 28 of 2014 concerning Copyright. The form of copyright law protection, namely legal protection of moral rights and legal protection of economic rights. Creators and the KCI Foundation have rights and obligations, in the process of paying royalties experiencing several obstacles and supporters experienced by the KCI Foundation creators and copyright users. Dispute settlement efforts through alternative arbitration and court dispute resolution.

Abstract

This study aims to analyze and describe banking crimes, as well as how legal protection given to customers who are concerned about the existence of a criminal act of false recording in banking documents. With the increasing number of activities that banks carry out, with that many individuals or groups have intentions that are contrary to applicable law, whether it be with anything, such as false records. The problems discussed are how to overcome banking crimes, as well as how legal protection given to customers regarding the existence of fraudulent recording crimes in banking documents. This research is a type of normative legal research to explore it. From the results of the study, it was shown that the handling of banking crimes had been going well, it was shown by Bank Indonesia having implemented preventive measures, namely by increasing working relations with relevant agencies, as well as repressive efforts, namely by conducting investigations on the basis of related laws. Regarding legal protection that must be carried out by banks, it is divided into indirect protection in the form of the bank using the principle of prudence in the implementation of banking activities, as well as direct protection in the form of a deposit insurance institution where this institution will guarantee customer deposits of a maximum of two billion rupiah if this occurs. things that are detrimental to customers.

Abstract

This study aims to analyze and describe the process of providing credit with a creative program and a form of legal protection if the debtor defaults on the creation program at PT Pegadaian Denpasar. Pegadaian was born as the foundation of the high-quality will of the ruler of a country to help many people who need funding solutions. One of the results of PT Pegadaian is creation, the result is a pawn system which is also intended for all of the lenders, both for consumptive and productive needs. The type of research used in this research is empirical legal research. Based on the results of the study, it can be seen that the high rate of default in 2021 occurred at PT Pegadaian Denpasar branch of 205 customers who defaulted as many as 69 people or 33.69%. This has legal implications. Meanwhile, legal protection for creditors refers to the Civil Code, legal protection for parties who have debts in credit agreements and fiduciary dependents very needed to think that the object made mortgage is on the side of the debtor.

Abstract

Perlindungan hukum konsumen showroom mobil bekas dalam hal ini diberlakukan baik terhadap barang atau jasa sejenis maupun yang tidak sejenis. Perlindungan bagi merek mobil bekas ini meliputi semua jenis barang atau jasa, sehingga peniruan merek terkenal milik orang lain pada dasarnya dilandasi oleh “itikad tidak baik” dengan tujuan untuk memperoleh keuntungan dengan membonceng keterkenalan suatu merek orang lain sehingga tidak selayaknya mendapatkan perlindungan hukum. Adapun type penelitian yang dilakukan menggunakan penelitian hukum normatif, dengan sumber bahan hukum primer berupa peraturan perundang undangan yang terkait serta sumber bahan hukum sekunder berupa konsep konsep mengambil dari lieratur dan jurnal. Dari hal tersebut bisa diketahui bahwa perlindungan hukum konsumen showroom pada pembelian mobil bekas dapat dilakukan dengan mengadakan pengikatan perjanjian kredit antara konsumen dan pihak showroom agar hak dan kewajiban para pihak jelas kepastian hukumnya.Upaya penyelesaian yang dilakukan untuk melindungi konsumen showroom mobil bekas yang kondisinya tidak sesuai dengan yang ada dalam iklan adalah menerapkan upaya hukum preventif, artinya pada saat membuat perjanjian kredit harus dijelaskan oleh pihak showroom tentang hak, kewajiban dan sanksi ketika konsumen ingkar janji (wanprestasi) serta menerapkan upaya hukum represif artinya apabila ditemukan adanya pelanggaran perjanjian (wanprestasi) maka perusahaan showroom harus menerapkan sanksi yang disepakati dalam perjanjian kredit kepada konsumen. Demikian pula apabila terjadi wanprestasi dilakukan oleh perusahaan showroom, penerapan sanksi hukum terhadap produsen/pelaku usaha showroom mobil bekas yang terbukti melakukan pelanggaran, membayar ganti rugi kepada konsumen sebatas kerusakan mobil yang dibeli, serta pemberhentian produksi untuk sementara waktu sampai masalah terkait diatasi, dan pencabutan izin produksi atau izin usaha.

Abstract

The use of information and electronic technology also plays an important role in trade and national economic growth to realize people's welfare. Such as trading activities that utilize information and electronic technology known as the Marketplace. Various types of payment systems have been provided on the Marketplace, one of which is the payment system through Cash On Delivery (COD). In practice, business actors who provide the COD method often experience defaults by buyers, to the detriment of business actors. Therefore, this study examines how valid the sale and purchase agreement through the COD system on the Marketplace? and how is the legal protection of business actors in the event of default through the COD system on the Marketplace?. This research uses a normative type of research. Providing legal protection to commercial actors aims to provide justice to parties affected by default. So in this case it is necessary to pay attention to the feasibility of sanctioning parties who do not use the COD method.
