Abstract

ABSTRACT Developing the role of research in agrarian, spatial planning, and land policies requires qualified human resources in their fields. HR Researcher and Policy Analyst (HR P and AK) as the “pioneer” in providing recommendations for policy development by the Center for Development and Standardization of Agrarian, Spatial, and Land Policy (PPSK-ATP) at the the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency (Ministry of ATR/BPN). However, the recommendations could not be able to be carried out efficiently due to the limitations of human resources. The purpose of this study is to describe the importance of human resource availability as a researcher to carry out the task of research and analysis to formulate the suitable policy for the Ministry of ATR/BPN. The methode was conducted to investigate existing documents related to the existence of PPSK-ATP in carrying out their duties and activities as a work unit that develops and evaluates agrarian, spatial planning, and land policies. The findings of this study show that PPSK-ATP has to take various initiatives to strengthen the role of evaluation in policy making, including: conduct out the hiring process in accordance with the required credentials, focused on capacity building in accordance with their fields, establish an environment that is conducive to learning. Keywords: Research, Human Resources, Policy ABSTRAK Peningkatan peranan pengkajian dalam kebijakan agraria, tata ruang dan pertanahan membutuhkan sumber daya manusia yang unggul di bidang pengkajian. SDM Peneliti dan Analis Kebijakan (SDM P dan AK) adalah “ujung-tombak” pada Pusat pengembangan dan Standarisasi Kebijakan Agraria, Tata Ruang dan Pertanahan (PPSK-ATP) dalam menyusun rekomendasi perumusan kebijakan Kementerian Agraria dan Tata Ruang/Badan Pertanahan Nasional. Namun, hal itu belum dapat diperankan dengan efektif mengingat berbagai keterbatasan yang melekat di dalamnya, seperti sumber daya manusia yang masih sangat terbatas. Tulisan ini bertujuan mendeskripsikan urgensi ketersediaan SDM Pengkajian untuk dapat mengemban tugas pengkajian (penelitian dan kajian) yang berkualitas dalam menghasilkan rekomendasi kebijakan yang efektif di Kementerian ATR/BPN. Metode dilakukan dengan menganalisis dokumen yang pernah ada berkaitan dengan eksistensi PPSK-ATP dalam melaksanakan tugas dan fungsinya sebagai unit kerja yang melakukan pengembangan dan pengkajian kebijakan agraria, tata ruang, dan pertanahan. Hasil telaah menunjukkan bahwa terdapat beberapa langkah yang perlu dilakukan PPSK-ATP untuk meningkatkan peran pengkajian dalam perumusan kebijakan yaitu rekruitmen yang serius, peningkatan kapasitas yang fokus, dan menciptakan atmosfir pengkajian yang kondusif. Abstract

The purpose of this research was to exemine the principle of rechtsverwerking  were formulated in the national land law, primarily  on the Government Regulation concerning land registration and it aplication on the Court’s desicition.Rechtsvewerking is a principle in adat law which states that owner ofa parcel of land that leaves his land abandoned in certain period of time and lets otherpeople to occupy andtake advantage will cause the original owner to lose his right ofthe land, is established to overcome the weakness of the land registration system.  This study uses normative legal research methods, with  statute approach, and consepual approach. Legal materials were analyzed by syllogism of induction, deduction and interpretation.  The results showthe principle of rechtsverwerkingis embodied in the regulation of land registraion called GR No. 24 of 1997. The Regulation provide that the issuance of a certificate for an applicant who has mastered the ground in a certain period of time has been acquired in good faith and registered in his name, then others who feel have an interest, then by law only given the opportunity during the time period of five years.However in law enforcement inside the court this principle tends to be deserted therefore creates an certainty in law and unfairness to people who have occupied a land in a longperiod oftime.

Abstract

Abstract: The legal relations of land tenure, ownership, usage and utilization of agrarian resources still require furtherrestructurization. The economic development during the New Order era abandoned the necessity of the legal differences of landtenure and land ownership, with the legal relations of the collection and utilization of agrarian resources excluding land. Consequently,there are misleading in interpreting the right and permission as a form of legal relationship. These misleading should berectified in the land law draft which will be drafted. The future land law should be able to clearly regulate the legal relations of landtenure, and should be consistently built since the early tenure in the form of occupation, possession, and ownership by the Ministryof Agrarian and Land Use Planning/NLA. Land tenure relationship is mentioned by the concept of land right. Furthermore, it shouldbe confirmed in the Land Law Draft that the relationship between collection and utilization of natural resources are confirmed aspermit, and should not be considered as the basic of land utilization as earth surface. Reclamation set up by the concession holdersfor mining area recovery should not be considered as an “entry point” to legalize land rights.Keywords: legal relation, right, licenseIntisari: Hubungan hukum penguasaan dan pemilikan serta penggunaan dan pemanfaatan Sumberdaya Agraria masih memerlukanpenataan. Perkembangan ekonomi selama era Orde Baru mengabaikan pentingnya pembedaan hubungan hukum tenurial penguasaandan pemilikan tanah dengan hubungan hukum pengambilan dan pemanfaatan sumberdaya agraria selain tanah. Akibatnya, terjadikesesatan berfikir dalam mamaknai hak dan ijin sebagai bentuk hubungan hukum. Kesesatan berfikir ini harus diakhiri di dalam RUUPertanahan yang akan disusun. RUU Pertanahan itu harus jelas mengatur bahwa hubungan hukum tenurial dengan tanah haruskonsisten dibangun sejak penguasaan awal dalam bentuk okupasi (occupation), penguasaan dan pemunyaaan (possession), danpemilikan (ownership) oleh Kementerian ATR/BPN. Hubungan tenurial dengan tanah disebut dengan konsep hak atas tanah.Selanjutnya, perlu dikonfirmasi dalam RUU Pertanahan tersebut bahwa hubungan pengambilan dan pemanfaatan kekayaan alamdikonfirmasi sebagai ijin, yang tidak dapat dijadikan sebagai dasar untuk menggunakan tanah sebagai permukaan bumi. Reklamasiyang dilakukan pemegang ijin untuk memulihkan areal tambang, tidak dapat dijadikan sebagai “pintu masuk” bagi terjadinya hak atastanah.Kata kunci: hubungan hukum, hak atas tanah, ijin

Abstract

Land Consolidation (LC) is land policy concerning settlement return the domination and land use as efforts of landacquisition for development interest, to enhance the environment quality and preservation of natural resources by activelyinvolving the community participation. In this case government needn’t to provide compensation with a very large fund due theprinciples used in LC is building without displacing. The LC participants provide Land Contribution for the Development (STUP)that will be used for public and social facility and for the KT implementation fund. KT that mostly conducted in Indonesia is UrbanLand Consolidation (ULC) namely LC which carried out in urban or outskirt. Several countries have implemented this in handlingland acquisition and arrangement issues, such as Japan, Germany and Thailand. This study using case study’s approach which aimto get the comprehensive knowledge about KTP. The ULC is a program that upholds the justice and participatory principle. Thecommunity will receive a decent environment completed with public and social facility, in addition the community is also asked todirectly involve in the activity process start from its planning up to development. Beside that others various public facility whichusually obtained by land acquisition can be fulfilled by the community participation in ULC.Key Words: Urban Land Consolidation, Land Acquisition, Public Interest

Abstract

Abstract: What land registration concept is suitable for Tanah Ulayat (Petuanan Land)? This question is relevant to be answered when the actual conditions of tenurial of the Petuanan Land have undergone an individualization process. The above question is answered by applying the concept of land registration to the actual conditions of customary land tenure. For Petuanan Land which is still intact containing public authority and private right, the proper concept of land registration is only limited to the Land Register. Furthermor, Petuanan Land that has undergone the process of individualization into Tanah Marga or Soa and individual land, the concept of land registration can be carried out up to the issuance of certificates as proof of land rights. Thus, the portion of Petuanan Land that can be the object of Complete Systematic Land Registration in Maluku Province is Petuanan Land that has undergone a process of individualization, can be land that is possessed or owned  by traditional village (although very rare), clan or soa. Intisari: Pendaftaran Tanah yang bagaimanakah yang tepat bagi Tanah Ulayat (Tanah Petuanan) di Maluku? Pertanyaan ini dipandang relevan untuk dijawab ketika kondisi aktual penguasaan Tanah Ulayat (Tanah Petuanan) itu sudah mengalami proses individualisasi. Pertanyaan di atas dijawab dengan cara menerapkan konsep pendaftaran tanah terhadap kondisi aktual penguasaan tanah ulayat. Bagi Tanah Petuanan yang masih utuh berisi kewenangan publik dan privat, konsep pendaftaran tanah yang tepat hanyalah sebatas Daftar Tanah. Selanjutnya, Tanah Petuanan yang sudah mengalami proses individualisasi menjadi Tanah Marga atau Soa dan Tanah Individual, maka konsep pendaftaran tanah dapat dilakukan sampai pada penerbitan sertipikat sebagai bukti hak atas tanah. Dengan demikian, bagian dari Tanah Petuanan yang dapat menjadi objek Pendaftaran Tanah Sistematik Lengkap di Provinsi Maluku adalah Tanah Petuanan yang sudah mengalami proses individualisasi, dapat berupa tanah yang dikuasai oleh negeri (meskipun sangat jarang), tanah yang dikuasai marga atau soa, dan tanah yang dikuasai oleh perorangan.

Abstract

Abstract: Regulation of Agrarian and Spatial Planning Minister/Head of National Land Agency Number 17 of 2016 on Land Tenure Management of Coastal dan Small islands (Permen ATR 17/2016) was stipulated to be a legal instrument for practicing tenurial aspect in coastal and small islands. After several years of enactment, the implementation of Permen ATR 17/2016 has been deemed ineffective. This research attempts to determine the cause of ineffectiveness of Permen ATR 17/2016. This research obtains data by using in-depth interviews, conducting some focus group discussions, doing observation, and exploring some documents. The results show that the ineffectiveness of Permen ATR 17/2016 caused by (a) the legal substance has not been accommodative enough as regulation of land rights; (b) the legal structure, officers in Land Registry Offices, cannot implement Permen ATR 17/2016 due to inadequate facilities, (c) there is community awareness to fill “empty-space” in ius positum for land tenure in alluvion (aanslibbing) in coastal areas, which is not fully in accordance with provisions and spirit of  National Land Law.   Keywords: ineffective regulation, land tenure,  land structuring.                                                                                                                       Intisari: Peraturan Menteri ATR/Kepala BPN Nomor 17 Tahun 2016 tentang Penataan Wilayah Pesisir dan Pulau-Pulau Kecil (selanjutnya disebut Permen ATR 17/2016) diharapkan menjadi instrumen hukum untuk  melakukan penataan pertanahan Wilayah Pesisir dan Pulau-Pulau Kecil (WPPPK) di Indonesia. Namun, setelah beberapa tahun berlakunya, implementasi Permen ATR/Ka BPN tersebut dipandang belum efektif. Penelitian ini mengkaji penyebab ketidakefektifan Permen ATR 17/2016. Data diperoleh dari wawancara, diskusi kelompok terfokus, observasi, dan studi dokumen. Hasil penelitian menunjukkan bahwa ketidakefektifan Permen ATR 17/2016 disebabkan oleh: (a) substansi hukum yang belum akomodatif; (b) struktur hukum dalam hal ini para sumberdaya manusia yang berwenang masih memiliki keraguan dalam melaksanakan, dan sarana penegakan hukum yang belum memadai;  (c) adanya kesadaran hukum masyarakat untuk mengisi “ruang-kosong” hukum positif dalam penguasaan dan pengusahaan tanah timbul di wilayah pesisir, namun tidak sepenuhnya sesuai dengan ketentuan dan semangat Hukum Tanah Nasional. Kata Kunci: Ketidakefektifan hukum, penguasaan tanah, penataan pertanahan.
