Abstract

Indonesia is an archipelago with a waters area that is larger than the land area. The vast area of these waters certainly produces abundant marine wealth for Indonesia. Marine wealth is a strategic potential for national economic development. Besides that, Indonesia is often faced with various security problems and law violations in Indonesia's territorial sea. Nowadays there are many cases of foreign vessels carrying out illegal fishing in Indonesian waters. Illegal fishing is an irresponsible fishing activity that has resulted in a drastic decrease in fish stocks. This is a big challenge for Indonesia in maintaining its territorial waters. Indonesia as a subject of international law certainly has the highest authority within its territorial boundaries. Therefore, it is necessary to review illegal fishing cases both from the perspective of international law and Indonesian national law.

Abstract

Anak merupakan bagian dari manusia, dan seperti diketahui bersama, setiap manusia memiliki hak-hak dasar yang harus dipenuhi. Sama halnya dengan anak, anak memiliki hak yang wajib untuk dilindungi. Namun, hingga saat ini, masih marak ditemukan kasus-kasus tindak pidana yang melibatkan anak, salah satunya adalah perdagangan anak (child trafficking), tentu hal tersebut mengindikasikan bahwa pelanggaran hak anak masih kerap terjadi. Tentu muncul pertanyaan, mengapa kejahatan semacam itu dapat terjadi. Berangkat dari hal tersebut, munculah tulisan ini, yang mana paper bertujuan untuk membahas terkait bagaimana tanggung jawab orang tua terhadap anak sebagai korban perdagangan anak (child trafficking) di Indonesia. Adapun metode pendekatan yang digunakan oleh penulis dalam paper ini yakni yuridis normatif, dengan spesifikasi penelitian deskriptif analitis, dan sumber data berupa data sekunder, yang mana data tersebut dikumpulkan dengan teknik studi dokumen (bahan pustaka), yang kemudian hasilnya di analisis dengan metode kualitatif, hingga akhirnya disajikan dalam bentuk paper. Adapun dalam paper ini mendapatkan hasil, bahwa perdagangan anak (child trafficking) disebabkan oleh beberapa faktor, salah satunya adalah adanya kelalaian dan kesengajaan dari orang tua dalam memberikan persetujuan atas anak untuk dieksploitasi, orang tua dapat melakukan hal demikian karena orang tua merupakan pihak yang memegang kendali atas anak. Namun, orang tua yang melakukan tindakan tersebut, akan dikategorikan melanggar hukum, mengingat bahwa tanggung jawab dan kewajiban orang tua dalam memberikan perlindungan terhadap anak telah diatur dalam berbagai ketentuan di Indonesia.

Abstract

Abstrak Islamic State of Iraq and Syria (ISIS) tidak hanya mengancam Indonesia, melainkan sudah menjadi masalah bagi dunia. Ketika ISIS mengalami kekalahan, dunia mulai membicarakan bagaimana nasib para militan ISIS dan anggota keluarganya yang pernah bergabung di dalamnya. Mulai dari status kewarganegaraanya, hak-hak fundamental yang masih melekat, hingga bahaya dan ancaman apa yang ditimbulkan jika mereka dipulangkan ke negara asal. Tujuan dari penelitan ini adalah untuk mengetahui kebijakan apa yang seharusnya diambil pemerintah dengan mempertimbangkan aspek hukum dan situasi yang ditimbulkan khususnya jika Warga Negara Indonesia (WNI) eks-ISIS dipulangkan ke Indonesia. Metode yang digunakan dalam penelitian ini berupa yuridis-normatif, adapun data-data di dalamnya diperoleh dari berbagai sumber baik cetak maupun online. Penelitian ini menegaskan bahwa pemulangan WNI eks-ISIS dapat menimbulkan potensi ancaman masalah dalam segi keamanan negara. Sementara dalam konteks hak asasi manusia negara juga memiliki tanggung jawab untuk menghargai, melindungi, dan memenuhi hak setiap manusia. Tulisan ini mengajukan bagaimana solusi alternatif agar kepentingan kedaulatan dan hak asasi manusia dapat berjalan dengan beriringan. Kata kunci : Hak asasi manusia; ISIS; Keamanan Abstract The Islamic State of Iraq and Syria (ISIS) does not only threaten Indonesia, but has become a problem for the world. When ISIS suffered defeat, the world began to talk about the fate of ISIS militants and their family members who had joined it. Starting from their citizenship status, the inherent fundamental rights, to the dangers and threats caused if they are returned to their country of origin. The purpose of this research is to find out what policies the government should take by considering the legal aspects and the situation that arises, especially if ex-ISIS Indonesians are returned to Indonesia. The method used in this research is juridical-normative, while the data in it are obtained from various sources, both print and online. This research confirms that the repatriation of ex-ISIS Indonesians can pose a potential threat to problems in terms of state security. Meanwhile, in the context of human rights, the state also has the responsibility to respect, protect and fulfill the rights of every human being. This paper proposes alternative solutions so that the interests of sovereignty and human rights can go hand in hand. Keywords: Human rights; ISIS; Security

Abstract

The profession of arbitrator in Indonesia is a profession that has bright prospects for the present and the future. Based on Article 1 point 7 of Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution, the arbitrator profession is one or more persons who are chosen by the parties to the dispute or appointed by the District Court or by the arbitration institution, to give a decision regarding a particular dispute. which has been resolved by arbitration. An absolute requirement for an arbitrator is a professional, this is closely related to the ethics of the legal profession in carrying out its duties and authorities. The professional position of the Arbitrator is as a private party who is given rights and obligations, authorities and responsibilities by the state (AAPS Law No. 30 of 1999). In this paper, the author uses the juridical-normative method with a statute approximation approach or a study of legislation. This paper reviews more deeply about the Arbitrator Profession within the scope of the Legal Profession. Profesi Arbiter di Indonesia menjadi profesi yang mempunyai prospek cerah untuk masa sekarang hingga masa mendatang. Berdasarkan Pasal 1 angka 7 UU No.30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa, profesi arbiter merupakan seorang atau lebih yang lebih yang dipilih oleh para pihak yang bersengketa atau yang ditunjuk oleh Pengadilan Negeri atau oleh lembaga arbitrase, untuk memberikan putusan mengenai sengketa tertentu yang diserahkan penyelesaiannya melalui arbitrase. Syarat mutlak dimiliki seorang arbiter adalah profesional, hal ini berkaitan erat dalam etika profesi hukum dalam melaksanakan tugas dan wewenangnya. Kedudukan profesi Arbiter adalah sebagai pihak swasta yang diberikan hak dan kewajiban, wewenang dan tanggung jawab oleh negara (UU AAPS). Dalam tulisan ini penulis menggunakan metode yuridis-normatif dengan pendekatan statute approch atau studi perundang-undangan. Tulisan ini mengulas lebih dalam tentang Profesi Arbiter dalam ruang lingkup Profesi Hukum.

Abstract

Third party resistance (derden verzet) as an extraordinary legal effort given to parties outside the litigation who feel deprived of their rights by the execution of the Court, in the civil justice system in Indonesia is still a recognized means to provide protection for third parties in office as a true opponent to suspend executions. The author conducted a study on Decision Number 118/Pdt.G/2020/PA.Kds of the Holy Religious Court regarding the derden verzet related to the execution confiscation. This study aims to find out the reasons for the resistance, to know the judge's judgment in rejecting the resistance and to know the legal protection provided for the auction winner in the presence of third party resistance. The authors examine this case using juridical-sociological research methods. Based on the research, the Author obtained the result that the Council of Judges accepted some of the lawsuits and suspended some with the consideration that the opponent was the right opponent, but in this case opponent I who confiscated the bail that had previously sold the land to the opponent by Opponent II and this is not known. by Pelawan.

Abstract

Based on Law no. 23 of 2014 in Article 42 paragraph 1 C provides a mandate that the Regional House of Representatives (DPRD) supervises Regional Regulations, Regional Head Decrees, Regional Government policy packages, and the implementation of APBD in regional development plans, as well as international cooperation in the regions in the context of actualization. DPRD function. The function of the DPRD is very vital in evaluating the implementation of development in the region by supervising each stage starting from the planning stage, the ratification stage, the implementation stage, to the accountability stage by the Regional Government. In addition, the supervisory function of the DPRD can minimize fraudulent actions by the Regional Government to avoid being hampered or stalled by regional development. empirical juridical method, which is an approach that examines secondary data first and then continues by conducting primary data research in the field. The results of this study are the implementation of the supervisory function is very important, the DPRD must optimize its supervisory function by minimizing obstacles such as technical constraints, constraints on the interests of the parties, infrastructure constraints, and even the lack of community participation in order to create a good supervisory function for the sake of support regional development.

Abstract

The right to get a job and a decent life is a basic right of every citizen that has been mandated by the constitution. However, in its application there are various problems in employment, one of which is related to the right to wages. Wage problems occur because existing regulations have not been able to provide protection for their rights. Therefore, the Government must act to make changes and harmony in realizing the rights of citizens to just and constitutionally decent wages. In this paper, the author uses juridical-normative research with a statue approach in finding and analyzing the Law on Employment and Job Creation. Abstract

AbstractDigital breakthroughs in addressing societal concerns as a solution and sovereignty for the security of virtual asset owners underlie the idea of forming a Central Bank Digital Currency or CBDC. Using a normative juridical method based on literature research, complemented by deductive thinking analysis, as well as a descriptive method with supporting data from primary and secondary sources. The aim is to examine the existence of circulating cryptocurrencies in the presence of CBDC. The result of this research is the need for technology infrastructure readiness and governance to establish a central bank capable of supervising the movement of virtual money in Indonesia, preventive actions related to legal protection are necessary to ensure justice, security, and civility in the nation. However, conflicts arise from Article 2 of Law No. 7 of 2011, Article 34 letter a of Regulation No. 18/40/PBI/2018, Article 62 of Regulation No. 20/6/PBI/2018, and POJK 13 of 2018 refer to the prohibition of using other types of currency as a medium of exchange. In the end, CBDC is positioned to monitor risks to financial stability, monetary stability, and the global financial system. AbstrakKetidakadaan otoritas yang bertanggung jawab, membuat cryptocurrency digunakan sebagai sarana kejahatan seperti pencucian uang, kejahatan siber, kejahatan ekonomi, dan lain sebagainya. Terobosan digital dalam menjawab keresahan di masyarakat sebagai solusi dan kedaulatan bagi keamanan pemilik uang virtual, mendasari gagasan pembentukan Central Bank Digital Currency atau CBDC. Dengan menggunakan metode yuridis normatif didasarkan penelitian kepustakaan, dilengkapi analisis pikir deduktif serta metode deskriptif dilengkapi data-data pendukung dari sumber primer dan sekunder. Bertujuan untuk melihat eksistensi mata uang kripto yang beredar dengan adanya CBDC. Hasil dari penelitian ini adalah dibutuhkan kesiapan infrastruktur teknologi dan tata kelola untuk membentuk bank sentral yang mampu mengawasi pergerakan uang virtual di Indonesia. Dianggap hanya sebagai barang komoditas, seiring dengan perkembangan zaman dan berkaca dari beberapa negara pendahulu yang memberikan ruang bagi penggunaan cryptocurrency, maka tindakan preventif terkait perlindungan hukum agar rasa keadilan, keamanan, dan keadaban tetap terjaga dalam berbangsa dan bernegara. Namun, pertentangan dari Pasal 2 UU No. 7 Tahun 2011, Pasal 34 huruf a PBI 18/40/PBI/2018, Pasal 62 PBI 20/6/PBI/2018, dan POJK 13 Tahun 2018 merujuk pada larangan penggunaan jenis mata uang lain untuk dijadikan sebagai alat tukar. Pada akhirnya, CBDC diposisikan untuk memantau risiko terhadap stabilitas keuangan, stabilitas moneter, dan sistem keuangan global.

Abstract

The case of espionage or spying by Australia against Indonesia is not the first time, but there have been several attempts of espionage against Indonesia. This espionage act is an act of secretly collecting intelligence data in international relations in a country. In this paper, we discuss the wiretapping case and its resolution. This paper uses normative legal research with a qualitative approach. This paper examines the chronology of cases of tapping by Australia against Indonesia, wiretapping in human rights and international law, as well as the final settlement of tensions between Indonesia and Australia through an agreement on the Code of Conduct to normalize bilateral relations between the two countries.
