Abstract

The provisions of Article 22 paragraph (1) of the 1945 Constitution is the cornerstone of the constitutional President in determining Government Regulation in Lieu of Law (decree). However, in practice, the right of the President establishes decree can not be measured objectively about matters of urgency requirement that force. Whereas decree degree and have the same legal force with the Act. It is therefore necessary limits of determination decree by the President in order to avoid abuse of power. It is important, from the point of a government based on the Constitution (constitutionalism), with a tap on the point of fixing restriction decree pursuant to Article 22 paragraph (1) of the 1945 Constitution which should only regulate in the public administration (administratiefrechtelijk). Moreover, the restrictions implemented by applying the mechanism of checks and balances between the organs of state institutions, namely strengthening the supervisory function of the House of Representatives of the establishment decree by the President in accordance with Article 22 paragraph (2) and (3) of the 1945 Constitution.

Abstract

The purpose of this study is to analyze the juridical, philosophical and sociological basis of the Regional Head establishing discretion in disaster management in the City of Bima and to analyze the implementation of the regional head's discretion in disaster management in the City of Bima. This research is an empirical normative with a statutory approach and a conceptual approach. The results of the study show the juridical basis, philosophical and sociological basis of the Regional Head determines the discretion referring to Law Number 30 of 2014 concerning Government Administration, Law Number 24 of 2007 concerning Disaster Management, Law Number 36 of 2009 concerning Health, Regional Regulations Number 7 of 2020 concerning Handling of Infectious Diseases, Mayor's Regulation Number 1 of 2022 concerning Amendments to Mayor of Bima's Regulation Number 49 of 2020 concerning General Guidelines for Handling Corona Virus Disease 2019 Based on Healthy Villages in Bima City, the philosophical basis is Pancasila and the Preamble to the 1945 Constitution of the Republic of Indonesia, while the sociological basis is in the context of safeguarding and protecting the community from all natural and non-natural disasters. The implementation of discretion in handling non-natural disasters at the City Government of Bima refers to the Regional Regulation of the Province of West Nusa Tenggara Number 7 of 2020 concerning the Handling of Infectious Diseases and the Regulation of the Mayor of Bima Number 1 of 2022 concerning Amendments to the Mayor's Regulation Number 49 of 2020 concerning General Guidelines for Handling Corona Virus Disease 2019 Based on Healthy Urban Village in Bima City, for the implementation of natural disaster discretion, it refers to the Bima Mayor Decree Number 188.45/783/3660/11/2021 concerning the Extension of the Emergency Status for Flood Disaster Management in Bima City in 2021.

Abstract

Penelitian ini bertujuan untuk mengetahui dan menganalisa Sumber kewenangan Dewan Perawakilan Rakyat (DPR) dalam memberhentikan hakim Mahkamah Konstitusi dan prosedur pemberhentian Hakim Mahkamah Konstitusi oleh Lembaga Pengusul. Penelitian ini merupakan jenis penelitian hukum normatif dengan menggunakan pendekatan undang-undang, pendekatan konseptual dan pendekatan kasus. Hasil penelitian ini bahwaDewan Perwakilan Rakyat tidak memiliki kewenangan dalam memberhentikan Hakim Mahkamah Konstitusi. kewenangan yang dimiliki oleh DPR hanya sebatas pengajuan calon Hakim Konstitusi bersama-sama dengan usulan dari Presiden dan Mahkamah Agung yang selanjutnya ditetapkan oleh Keputusan Presiden sesuai dengan amanat Pasal 18 Ayat (1) UU No. 23 Tahun 2004 yang menyatakan bahwa Hakim Konstitusi diajukan masing-masing 3 (tiga) orang oleh Mahkamah Agung, 3 (tiga) orang oleh Dewan Perwakilan Rakyat, dan 3 (tiga) orang oleh Presiden untuk ditetapkan dengan Keputusan Presiden. Adapun prosedur pemberhentian Hakim Mahkamah Konstitusi oleh Lembaga Pengusul tidak diatur dalam UU No. 7 Tahun 2020 tentang Perubahan Ketiga Atas UU No. 23 Tahun 2004 tentang Mahkamah Konstitusi. Proses pemberhentian hakim konstitusi hanya diatur dalam Pasal 23 UU tersebut, yang menyatakan bahwa pemberhentian dapat dilakukan dengan cara pemberhentian secara terhormat dan pemberhentian secara tidak terhormat. Pemberhentian hakim konstitusi ditetapkan dengan keputusan presiden atas permintaan ketua mahkamah konstitusi sesuai dengan Pasal 23 ayat (4) Undang-Undang Nomor 7 Tahun 2020 Perubahan Ketiga Atas Undang-Undang Nomor 23 Tanun 2004 tentang Mahkamah Konstitusi.
