Abstract

The aims of this research is to know that certificate as a letter of evidence that is valid as strong evidence regarding the physical data and juridical data contained in it, as long as the physical data and juridical data are in accordance with the data contained in the letter of measurement and the book of land rights in question. But in reality, the certificate can still be sued by the subject of the right who feels he has the right to the land. This research used a normative legal research with qualitative descriptive data analysis. Based on the results of the study indicate that land registration activities include the collection and processing of physical data, proof of rights, bookkeeping, and issuance of certificates. With the issuance of a certificate of land rights, the owner has legal certainty and legal protection. However, in reality, land rights certificates can be sued in court. This shows the existence of legal uncertainty, because at any time the rights subject who feels he has a right or feels that his rights have been violated by another party can file a lawsuit against another party whose name has been registered in a certificate.

Abstract

Merdeka Belajar Kampus Merdeka (MBKM) adalah program pembelajaran pendidikan tinggi yang mandiri dan serbaguna yang dirancang untuk menciptakan komunitas pembelajaran kreatif yang tidak membatasi yang memenuhi kebutuhan mahasiswa Penelitian ini bertujuan untuk untuk melihat dampak dan persepsi penerapan Merdeka Belajar Kampus Merdeka (MBKM) kepada seluruh mahasiswa di perguruan tinggi swasta dengan tujuan untuk melihat sejauh mana pemahaman dan persepsi mahasiswa dan dampak dari penerapan program Merdeka Belajar Kampus Merdeka (MBKM) yang ada di Perguruan Tinggi. Penelitian ini merupakan penelitian deskriptif dengan pendekatan kuantitatif dengan metode survei. Data diperoleh dari populasi yakni 279 responden yang merupakan mahasiswa Program Studi Ilmu Hukum Fakultas Hukum Universitas Flores. Data dikumpulkan melalui kuesioner. Teknik analisis data dimulai dari pengumpulan data kemudian dianalisis menggunakan analisis deskriptif. Hasil dari penelitian survei ini menunjukan bahwa mahasiswa pada Program Studi Ilmu Hukum, Fakultas Hukum, Universitas Flores memberikan respon yang positif terhadap program Merdeka Belajar Kampus Merdeka (MBKM).

Abstract

Abstrak Sertifikat hak milik atas tanah diperoleh dari perbuatan hukum, yakni dengan mendaftarkan hak atas tanah di Kantor Pertanahan. Dengan mendaftarkan hak atas tanah maka akan diterbitkan surat tanda bukti hak yang berlaku sebagai alat pembuktian yang kuat atas kepemilikan tanah bagi pemegang hak. Sesuai dengan Pasal 32 Ayat (1) Peraturan Pemerintah Nomor 24 Tahu 1997 tentang Pendaftaran Tanah menegaskan bahwa sertifikat diterbitkan untuk kepentingan pemegang hak yang bersangkutan sesuai dengan data fisik dan data yuridis yang telah didaftar dalam buku tanah sebagai tanda bukti hak yang berlaku untuk alat pembuktian yang kuat atas kepemilikan tanah. Sertifikatmerupakan tanda bukti hak yang bersifat mutlak apabila memenuhi unsur-unsur secara kumulatif, yaitu sertifikat diterbitkan secara sah atas nama orang atau badan hukum, tanah diperoleh dengan etikad baik, tanah dikuasai secara nyata dan dalam waktu 5 tahun sejak diterbitkannya sertifikat itu tidak ada yang mengajukan keberatan secara tertulis kepada pemegang sertifikat dan Kepala Kantor Pertanahan Kabupaten atau Kota setempat ataupun tidak mengajukan gugatan ke Pengadilan mengenai penguasaan tanah atas penerbitan sertifikat (Pasal 32 Ayat (2)Peraturan Pemerintah Nomor 24 Tahun 1997 tentang Pendaftaran Tanah). Kata Kunci:Hak milik, sertifikat, tanda bukti hak. Abstract Land title certificates are obtained from legal actions, namely by registering land rights at the Land Office. By registering land rights, a certificate of proof of rights will be issued as a strong evidence of land ownership for rights holders. In accordance with Article 32 Paragraph (1) Government Regulation Number 24 of 1997 concerning Land Registration confirms that the certificate issued for the benefit of the right holder concerned is in accordance with the physical data and juridical data that has been registered in the land book as proof of rights applicable to evidence strong over land ownership. Certificate is proof of absolute rights if it fulfills the elements cumulatively, namely the certificate is legally issued in the name of a person or legal entity, the land is obtained in good faith, the land is in real possession and within 5 years of the issuance of the certificate nothing has been issued. file a written objection to the certificate holder and the Head of the local Regency or City Land Office or not file a lawsuit to the Court regarding land control over the issuance of the certificate (Article 32 Paragraph (2) Government Regulation Number 24 Year 1997 concerning Land Registration).

Abstract

The execution of chil adoption in Indonesia each district one differing from other district since done legalistic of custom going into effect in pertinent district. One of thet district is ini Desa Pemo. Thought of generally in java with society which have system of familiarity patrilineal with system of child adoption done do not bodly and do not in cash,however in this didtrich is child adoption conducted by bold and cash. This research target is to know execution of child adoption in endowment is Desa Pemo and to know legal consequences of child adoption in endowment in Desa Pemo. Used by research method is method qualitative since in this research depicted by an event as things have panned out, that is hit execution of child lifting and domicile foster child of acocoding to customary low in Desa Pemo. This research use method of empirical apporoach yuridis that is aim to comperehend that law is do not solely as an a set the legislation order having the character of mere normatif, however law comperehended by as society behavior wihich symptom in life socialize, always have the interaction and relate to social aspect. Pursuant to research result earn taken by a conclucion that is child adoption in Desa Pemo executed boldly and the chas that is done according to customary law in Kabupaten Ende well-held almost always in klan of hand in glove big family according to line of familiarity patrilineal
