Abstract

Indonesia is a country that implements a presidential system and a multi-party system jointly. The implementation of general elections has been regulated in the 1945 Constitution of the Republic of Indonesia. The presidential threshold is a concept used in proposing candidates for President and Vice President. Proposals are made by political parties or joining political parties by general election participants. This article analyzes the application of the presidential threshold after the Constitutional Court decision Number 114 / PUU-XI / 2013. The purpose of this writing is to determine the application of the Presidensitial threshold after the Constitutional Court decision Number 14 / PUU-XI / 013, and to determine the impact of the Constitutional Court decision number 14 / PUU-XI / 2013 on political parties. The research method used is qualitative and conceptual normative research methods. Based on this article, it is known that the application of the presidential threshold in which political parties must obtain seats 20% of the number of seats in the DPR or 25% of the valid votes nationally in the previous DPR elections, so that making new or small parties will not be able to nominate the President and Vice President themselves, but parties can form a coalition.

Abstract

In the life of the state, where there is a relationship between humans and humans, there are always rules that bind it, namely the law. Law regulates human rights and obligations. The purpose of this study is to find out what factors can hinder the process of resolving tax disputes. This research uses type. This study uses a type of normative juridical research sourced from primary and secondary materials, which were analyzed qualitatively by descriptively describing the results of the existing data. The results of this study indicate that the factors that hinder the process of resolving tax disputes are factors in the administration sector, namely the existence of the first obligation of the Taxpayer to pay 50% (fifty percent) of the total tax payable. Then in the field of justice, namely regarding the obligation of judges to present the appellate party or defendant in examination at trial.

Abstract

Penelitian ini bertujuan untuk mengetahui Implementasi Tindakan Administratif Keimigrasian Oleh Pejabat Adminstrasi Negara Di Kantor Imigrasi Kelas I Makassar dan apa saja kendala-kendala yang menghambat Tindakan Administratif Keimigrasian terhadap orang asing yang melakukan pelanggaran Keimigrasian Tipe penelitian ini adalah merupakan tipe penelitian yuridis normatif dan yuridis empiris . Yuridis normatif dilakukan dengan cara mengkaji atau menelaah peraturan perundang-undangan dan teori-teori yang berkaitan dengan hukum Keimigrasian .Sedangkan penelitian yuridis empiris dilakukan dengan melihat kenyataan-kenyataan (di lapangan) yang temukan dikantor Imigrasi Kelas I Makassar.Jenis data yang digunakan adalah data primer dan sekunder dengan teknik pengumpulan data yakni studi kepustakaan, teknik wawancara dan observasi langsung. Subjek dalam penelitian ini adalah orang asing yang melakukan pelanggaran keimigrasian dibawah wilayah kerja kantor imigrasi kelas I Makassar dari bulan januari sampai dengan bulan Desember tahun 2018 yang berjumlah 19 pelanggaran. Hasil penelitian menunjukkan tindakan Administratif keimigrasian belum efektif dalam meminimalisir pelanggaran keimigrasian yang dilakukan oleh orang asing namun jika ditinjau dari segi waktu dan biaya, pelaksanan tindakan Tindakan Administratif keimigrsian lebih efisien dibandingkan tindakan pro justitia. Kendala-kendala dalam pelaksanaan tindakan Administratif keimigrasian yaitu Sumber Daya Manusia (SDM) fasilitas sarana dan prasarana , Standard Operational Procedure (SOP) dan Alokasi Sumber Daya Anggaran. Oleh karena itu diperlukan pengaturan, bentuk tindakan dan mekanisme penindakan yang lebih tegas. Perbaikan terhadap sarana prasarana, sementara untuk meningkatkan kinerja petugas imigrasi diperlukan , pelatihan khusus, meningkatkan fasilitas operasional, adanya SOP penindakan, dan Alokasi sumber daya anggaran.

Abstract

The ambiguity of the Deputy Regent's position in local government makes the Deputy Regent's position often underestimated. The Deputy Regent is perceived as a subordinate of the Regent even though the Regent and Deputy Regent are both directly elected by the people. This study aims to reconstruct the Deputy Regent's position in order to optimize regional autonomy while at the same time embodying the values ​​of democracy and justice. This research is doctrinal research, prioritizing conceptual and statutory approaches. The results of the study confirmed that the weak position of the Deputy Regent compared to the Regent in carrying out his duties was caused by two factors, namely the juridical factor in the form of the absence of special arrangements regarding the duties and powers of the Deputy Regent, and from non-juridical factors, which is a political factor that placed the Deputy Regent as the Regent's subordinate. Efforts to realize the values ​​of democracy and justice for optimizing regional autonomy can be carried out by reconstructing the authority of the Deputy Regent by strengthening the proportional distribution of authority between the Regent and Deputy Regent.
