Abstract

Penelitian ini bertujuan untuk menguji dan menganalisis secara kritis apakah secara historis ideologi ijtihād tradisional dapat dibuktikan kebenarannya atau sebaliknya tidak dapat dipertanggungjawabkan, kesimpulan kajian ini, antara lain: (1) ideologi ijtihād tradisional hanyalah sebatas “mengeluarkan hukum” (ikhrāj al-h̟ūkm) dari teks-teks al-Qur’ān dan al-Sunnah yang menyebabkan munculnya sikap taqlid, sehingga umat Islam cenderung meniru dan menerima begitu saja tanpa analisis kritis dan terjebak pada logika pengulangan serta pembenaran (logic of repetation and justification) sesuatu yang sudah ada sebelumnya. (2) wilayah ijtihād klasik sangat terbatas pada masalah praktis (‘Amaliyah: z̟anni) bukan dalam segala bidang (al-h̟ūkm al-‘ilm; qat̟’i), sehingga wilayah ijtihādnya sangatlah terbatas. Oleh karena itu kajian ini menawarkan untuk reformulasi ideologi ijtihād tradisional, dengan: (1) menjadikan ijtihād sebagai proses berfikir dalam menemukan hukum baru secara independen untuk segala bidang dan tidak terbatas pada masalah praktis (‘amaliyah: z̟anni), (2) perlu reformulasi syarat mujtahid yang sudah ditetapkan ulama’ klasik (3) ijtihād kolektif lebih dibutuhkan untuk era sekarang dibandingkan dengan ijtihād personal (fardi).

Abstract

The purposes of this research were to (1) describe the practice of the Jember Fashion Carnival (JFC), which is held in Jember, Indonesia, and (2) explain how the practice of the Jember Fashion Carnival (JFC) is regarded from the perspective of Islamic law. This research is included in the qualitative-descriptive and literature research category. In conclusion, (1) the Jember Fashion Carnival (JFC) is a cultural event as well as a carnival that is held every year with a specific theme; this spectacular activity attracts foreign tourists and helps to boost the economy, among other things; and (2) the entire event contained in the Jember Fashion Carnival (JFC) is a good culture that does not conflict with Islamic law. As a result, it is feasible and may be implemented as a normal culture within the local community. No action taken at the Jember Fashion Carnival (JFC) activity violates Islam, nor does it ban something permissible, nor does it cancel something compulsory, invalidate the meaning of benefit, nor does it foster the growth of evil.
