Abstract

ABSTRAKPutusan progresif Mahkamah Konstitusi Nomor 73/PUU-IX/2011 dengan mengabulkan sebagian permohonan pemohon atas Undang-Undang No. 32 Tahun 2004 tentang Pemerintahan Daerah cukup melegakan bagi penyidik kepolisian dan kejaksaan untuk memberantas tindak pidana korupsi oleh pejabat daerah. Putusan tersebut menghilangkan frase “persetujuan tertulis Presiden atas permintaan penyidik” dan “jangka waktu 60 (enam puluh) hari” pada Pasal 36 UU Pemerintahan Daerah masing-masing ayat (1) dan ayat (2). Prinsip negara hukum (legal state) di antaranya bercirikan equality before the law dan independent judiciary akan terganggu manakala proses penyelidikan dan penyidikan bagi pejabat daerah harus melalui izin tertulis dari Presiden. Paradigma hukum progresif adalah salah satu pendekatan yang dapat membantu aparat hukum dalam upaya pemberantasan tindak pidana korupsi, termasuk yang dilakukan oleh pejabat daerah. Penulis menilai positif putusan Mahkamah Konstitusi Nomor 73/PUU-IX/2011 sebagai kontribusi bagi pemberantasan tindak pidana korupsi di Indonesia. Kata kunci: hukum progresif, tindak pidana korupsi, Mahkamah Konstitusi, pejabat daerah.ABSTRACTThe Progressive Decision Number 73/PUUIX/2011 of the Constitutional Court which approves several petition of Law Number 32 of 2004 on Regional Government has become a relief for police investigators and prosecutors in efforts of eradicating corruption committed by local officials. The decision eliminates the phrase “written approval by the President at the request of the investigator” and “period of 60 (sixty) days” in article 36 of Law on Local Government, in each paragraph (1) and paragraph (2). The principles of Legal State, which are the equality before the law and an independent judiciary, will be disturbed when the investigation of local officials must first pass a written permission of the President. The progressive law paradigm is one of the approaches used by law enforcement agencies in efforts of eradicating corruption which include corruption committed by local officials. The author considers positively to the Constitutional Court’s Decision Number 73/PUU-IX/2011 as a contribution to the efforts of corruption eradication in Indonesia.
