Abstract

This study analyzes the importance of the first time registration of the land for the owner of the land that have not been registered and the government (BPN) and also the problems that occur at this time related to the first time registration of the land for the land owners who have not been registered. The registration of the land for the first time is very important, because the parcels of the land that already registered will recieve a certificate and have the legal certainty. Today, Percentage of ownership certificates of registration of land parcels for the first time in Indonesia is still low. Whereas, people can use their land as a supporting certificate to obtain that money as collateral to obtain credit in the banking institutions as well as to reduce the space for middlemen, speculators and land manifulator. The problem in this study is what is the significance of the land registration for the first time and what issues is related to the land registration for the first time. This study is analytical descriptive with the normative juridical approach and using secondary data obtained from literature studies, studies dan references documents that have been published by the author. Secondary data systematically compiled and analyzed in a qualitative. The conclusion of this study is the systematic land registration is very expected to provide the legal certainty for the land owner that have not been registered, primarily for the middle income people.ABSTRAKPenelitian ini menganalisis pentingnya pendaftaran tanah untuk pertama kali bagi pemilik tanah yang belum terdaftar dan Pemerintah (BPN) serta permasalahan yang terjadi saat ini terkait pendaftaran tanah untuk pertama kali bagi pemilik tanah yang belum terdaftar. Pendaftaran tanah untuk pertama kali sangat penting, karena bidang tanah yang sudah terdaftar akan mendapat sertifikat serta memiliki kepastian hukum. Sekarang ini, prosentase kepemilikan sertifikat bidang tanah dari pendaftaran tanah untuk pertama kali di Indonesia masih rendah. Padahal masyarakat dapat menggunakan sertifikat tanahnya sebagai pendukung untuk memperoleh uang yakni sebagai jaminan memperoleh kredit di lembaga perbankan serta untuk mengurangi ruang gerak para tengkulak, spekulator dan manifulator tanah. Permasalahan dalam penelitian ini adalah apa arti penting pendaftaran tanah untuk pertama kali serta permasalahan apa yang terjadi saat ini terkait pendaftaran tanah untuk pertama kali. Permasalahan Penelitian ini bersifat deskriptif analitis dengan pendekatan yuridis normatif dan menggunakan data sekunder yang diperoleh dari studi kepustakaan, studi dokumen serta referensi yang telah dipublikasikan oleh penulisnya. Data sekunder disusun secara sistematik dan dianalisis secara kualitatif. Kesimpulan dari penelitian ini adalah pendaftaran tanah sistematik yang memberikan kepastian hukum sangat diharapkan bagi pemilik bidang tanah yang belum terdaftar terutama bagi masyarakat berpenghasilan menengah kebawah.

Abstract

The State control of the land dose not mean that the State owns the land, but rather the State regulate land use through the development of which is directed to achieve prosperity for all citizens. Land acqusition for development is one way to increase prosperity for the people, but the avaible land is extremely limited. Goverment policies as legal foundation to acquire the land has not been effective and no longer appropiate to solve the problem for the implementation of land acqusition for development. These problems include the concept of public interest must clearly type that devoted to the interests of the people and the market value of land should be the basic for calculating damages in the process of land acqusition for development. It is time uor country has a higher legal foundation for regulating the provision of land for development to improve people’s welfare. The author in the process of the Draft Law on Land Acquisition for Development Interest.
