Abstract

Historically, efforts to reform Family Law in parts of the Islamic world began to be realized in the late 19th century AD. The reality of Islamic legal reforms carried out in Islamic countries in North Africa, the Middle East, Central Asia, and Southeast Asia gave rise to unprecedented changes in the last century. These changes occur both in the justice system and in the system applied. Changes to family law were first carried out by Turkey, then followed by Lebanon in 1919, Jordan in 1951, and Syria in 1953. Muslim countries in the world, in their context with the renewal of family law, are divided into three categories. First, an Islamic state that does not carry out any renewal and still enforces family law as stipulated in the books of fiqh. Secondly, an Islamic state that has completely abandoned Islamic family law and adopted European civil law. Third, countries that are trying to enforce Islamic family law but after making reforms here and there. This paper tries to discuss one of the reforms carried out by one Muslim country, namely Turkey, which is related to the reformation (reform) of family law that starts from the history of reform, legislation, renewal, and legal material. The author chose Turkey because it is the first Muslim country to make changes to family law.

Abstract

We cannot separate the law from people's lives, so to talk about the law we also cannot be separated from talking about it in the context of human life, it can be said that there is no human being on this earth who lives alone, far away and separated from life together. “Humans cannot stand outside or without society. On the other hand, society cannot exist without humans. Examining the influence of law on social change means questioning whether the law can drive and direct social change, which means can the legal aspect function as a tool or a means of reforming society or law as a tool of social engineering, then what is the actual function of law as a means of reform in society? . In this study, the method used is a descriptive research method whose function is to describe ongoing phenomena or describe phenomena in the past. The function of law as a means of renewal in society is to direct society in a better direction so that order is created in society. Law can be a means of renewal for the community if the law is accepted by the community and the law accepted by the community is certainly a law that was born on the needs of the community.Keywords: law as a tool of social engineering, Society. Abstrak Hukum tidak bisa kita lepaskan dari kehidupan masyarakat, maka untuk membicarakan hukum kita juga tidak dapat lepas membicarakannya dalam konteks kehidupan manusia, dapatlah dikatakan bahwa tidak ada seorang manusia di mukabumi ini  yang hidup seorang diri terpencil jauh dan lepas dari kehidupan bersama. “Manusia tidak mungkin berdiri diluar atau tanpa masyarakat. sebaliknya masyarakat tidak mungkin ada tanpa manusia. Menelaah pengaruh hukum pada perubahan social berarti mempertanyakan apakah hukum dapat menggerakkan  dan mengarahkan perubahan social yang berarti dapatkah aspek hukum befungsi sebagai alat atau sarana dalam melakukan pembaharuan terhadap masyarakat atau law as a tool of social engineering, lalu bagaimanakah sebenarnya fungsi hukum sebagai sarana pembaharuan dalam masyarakat. Dalam penelitian ini metode yang digunakan adalah metode penelitian deskriptif yang mana fungsinya untuk menggambarkan fenomena yang masih berjalan maupun mendeskripsikan fenomena di masa lampau. Fungsi hukum sebagai sarana pembaharuan dalam masyarakat adalah untuk mengarahkan masyarakat ke arah yang lebih baik agar terciptanya ketertiban dalam masyarakat. Hukum dapat menjadi sarana pembaharuan bagi masyarakat apabila hukum itu diterima oleh masyarakat dan hukum yang diterima masyarakat tentulah hukum yang lahir atas kebutuhan masyarakat.Kata Kunci: Hukum, Sarana Pembaharuan, Masyarakat.
