Abstract

Islamic boarding school is an educational institution which is unique and also dynamics. Unique, since Islamic boarding school is still able to survive among a rapidly changing environment. Islamic boarding school’s response towards such changes is made through adaptation, accommodation and adoption in a smart and wise manner. Islamic boarding school does not lose its-own identity as a tfaqquh fiddin institution. This paper attempts to make a critical review on various studies and papers on Islamic boarding school in relation to social mobility. Review is also conducted on the level of concept which underlies the discourse and theoretical frame above which it is built various explanations and conclusions on Islamic boarding school phenomenon, especilally those related to its mobility in social political arena

Abstract

This article discusses the development and diversity of thought and practice of Islamic law Muslims in Indonesia, particularly in the areas of family and inheritance. In discussing Islamic law (shari'a or fiqh), the main focus of this paper is the position and contribution of Islamic law in the context of the national legal system. To that end, the proposed law reform and successfully passed will be used as the unit of analysis, in particular two of the New Order government legislation, namely marriage law in 1974 and 1991 Compilation of Islamic Law.DOI: 10.15408/sdi.v4i4.765

Abstract

This paper analyzes the influence of the ideology of Pancasila and developmentalism against Islamic law and its institutions, especially the judiciary Islam, during the New Order.During the New Order has many legal provisions that adopt Islamic law as national positive law. It is not limited to the field of law that has traditionally been a part of the Muslims, which is related to the family, but also the wider field: the new Law on Religious Education at every level of formal education, and Law no. 7/1992 on Banking. The latter recognizes the institution mudarabah (an agreement to share in the profit and loss of a business) as one of the functions of commercial banks in Indonesia. To set the new banking activities, has issued Government Regulation no. 72/1992 in which the new Shari'ah formally used as a reference. Abstract

Child rights has become global concern, indicated from several law instruments which legislated by several countries in the world. In international context, United Nations has created several laws, including protocols and resolutions to protect rights of children. Those laws have consisted of soft-law which sometimes having no hard sanctions. In Indonesian context, there are a number of law instruments protecting child rights such as Law of Child Protection. However, the Law have not fully covered the implementation of Islamic law in Aceh. A number of Qanun (bylaws) in Aceh have not specifically protected child rights. There are still a lot of norms in Islamic criminal law not defining child rights. In Islamic law, Al-Quran and the Prophet Muhammad PBUH have paid serious attention on children rights. Islamic law has given greatest care to safeguarding all that is needed to guarantee a wholesome psychological climate for the rearing of children, an environment wherein they learn about the world formulate their norms and behaviour. Abstrak: Hak-hak anak telah menjadi perhatian global, sebagaimana ditunjukkan oleh instrumen-instrumen hukum yang telah disahkan di beberapa negara di dunia. Dalam konteks internasional, PBB telah menciptakan beberapa undang-undang, termasuk protokol dan resolusi untuk melindungi hak-hak anak. Undang-undang tersebut terdiri dari hukum lunak, yang terkadang tidak memiliki sanksi berat. Dalam konteks Indonesia, terdapat beberapa instrumen hukum yang melindungi hak-hak anak, contohnya: Hukum Perlindungan Anak. Namun, Undang-undang (UU) tersebut belum sepenuhnya mencakup pelaksanaan hukum Islam di Aceh. Beberapa Qanun di Aceh belum secara khusus melindungi hak-hak anak. Selain itu, masih banyak norma dalam hukum pidana Islam yang tidak mendefinisikan hak anak. Dalam hukum Islam, Al-Quran dan Nabi Muhammad SAW telah memberikan perhatian serius terhadap hak-hak anak. Hukum Islam telah memberikan perhatian besar untuk melindungi semua yang memerlukan perlindungan, demi menjamin iklim psikologis yang sehat untuk membesarkan anak-anak di lingkungan di mana mereka belajar tentang dunia yang merumuskan norma dan perilaku mereka. Kata kunci: Hak Anak, Hukum Islam, Hukum Islam di Aceh
