Abstract

Abstract: Panglima laot is a traditional institution that has the authority to settle cases of minor crimes according to Aceh Qanun Number 10 of 2008. There are three types of cases that can be resolved by Panglima laot, namely disputes, adat laot cases, and violation cases. There are three problem formulations in this study, first: what are the types of minor crimes that occurred in Mesjid Raya District, Aceh Besar District, second, how is the settlement of minor crimes by Panglima Laot in Mesjid Raya District, Aceh Besar District, and third how is the review Islamic law against the settlement of minor crimes by Panglima Laot. This research is field research that uses a descriptive analysis method with a qualitative approach, namely by looking at the role of Panglima Laot in resolving disputes that occur at sea, which is then explained systematically about the data obtained in the study based on a review from the formulation of the problem. The results of this study are that there are three types of minor crimes that occurred in Mesjid Raya District, Aceh Besar Regency, namely: beating cases, peupok jaloe cases, and the case of a Padang cement ship hitting a fishing boat. Furthermore, the role played by the Panglima laot in resolving disputes at laot by peaceful means and deliberation, and if there are parties who do not agree to be resolved by adat laot, it will be delegated to the police. In Islamic law, the punishment imposed on people who commit minor crimes of beating is qishash diyat. Qishash as the main punishment and diyat as a substitute punishment, namely one hundred camels, and the punishment has been determined by syara'. Abstrak: Panglima Laot merupakan sebuah lembaga adat yang mempunyai kewenangan menyelesaikan kasus tindak pidana ringan menurut Qanun Aceh Nomor 10 Tahun 2008. Ada tiga jenis perkara yang dapat diselesaikan oleh Panglima Laot yaitu perkara perselisihan, perkara adat laut dan perkara pelanggaran. Ada tiga rumusan masalah dalam penelitian ini, pertama: apa saja jenis-jenis tindak pidana ringan yang terjadi di Kecamatan Mesjid Raya Kabupaten Aceh besar, kedua, bagaimana penyelesaian tindak pidana ringan oleh Panglima Laot di Kecamatan Mesjid Raya Kabupaten Aceh Besar, dan ketiga bagaimana tinjauan Hukum Islam terhadap penyelesaian tindak pidana ringan oleh Panglima Laot. Penelitian ini merupakan penelitian lapangan (field research) yang menggunakan metode deskriptif analisis dengan pendekatan kualitatif, yaitu dengan cara melihat peran Pangima Laot dalam menyelesaikan bentuk perselisihan yang terjadi di laut, yang kemudian dijelaskan secara sistematis mengenai data-data yang diperoleh dalam penelitian berdasarkan tinjauan dari rumusan masalah. Adapun hasil dari penelitian ini adalah ada tiga jenis tindak pidana ringan yang terjadi di Kecamatan Mesjid Raya Kabupaten Aceh Besar yaitu: kasus pemukulan, kasus peupok jaloe dan kasus kapal semen padang menabrak perahu nelayan. Selanjutnya peran yang dilakukan oleh Panglima Laot dalam menyelesaikan perselisihan di laut dengan cara damai dan musyawarah, dan apabila ada pihak yang tidak setuju di selesaikan secara adat laut, maka akan dilimpahkan kepada kepolisian. Dalam hukum Islam hukuman yang dijatuhkan terhadap orang yang melakukan tindak pidana ringan pemukulan adalah qishash diyat. Qishash sebagai hukuman pokok dan diyat sebagai hukuman pengganti yaitu seratus ekor unta dan hukuman nya sudah di tentukan oleh syara’.

Abstract

Home Safe is a temporary residence that is used to provide protection against victims in accordance with the prescribed standards. Safe house strongly is needed immediately to be built in accordance with the provisions of the law because the victim can tell and feel safe in the safe house. Integrated service center women and Children Empowerment have the task and function to prevent and handle domestic violence that the victims suffer. The problem formulation in this research is that it has not fulfilled the protection of domestic Violence as it has not been formed a safe house in Aceh province. In the discussion of researchers use the type of normative administrative research that is library Research (library) and field research (field) and use qualitative method of data derived from interviews, report notes, documents and others. Based on the research can be obtained the following results: the form of domestic violence that is the cause is economic factors in the family, factors of infidelity, drug factors, the innate factors of the perpetration itself, and Relationship between a married couple who is not balanced. While the P2TP2A effort in reducing domestic violence is to do socialization to Gampong-Gampong to the public about the laws of PKDRT law so that people know about the realm of law that occurs over violence Women. It can be concluded that domestic violence has decreased with the socialization and other performance of the P2TP2A institutions and is advised to immediately build safe houses for victims of domestic violence.

Abstract

In implementing Special Autonomy, various provinces in Indonesia compete to increase their Regional Levies. These efforts have encouraged the governments to create regulations that can add value to their provinces. However, these regulations sometimes experience disharmony and asynchronous with the higher regulations, both in terms of contents and technically. This issue has resulted in an increasing number of Regional Regulations being annulled or revised after being evaluated by the Ministry of Home Affairs. At least 7500 Regional Regulations since 2002, originating from all regencies/cities and provinces in Indonesia, have been evaluated by the Ministry of Home Affairs. Nearly half of these Regional Regulations were annulled because they contradicted the principles of the formation. It is assumed that this number will continue to rise with the increasing legislative process in the regions. Abstrak: Dalam upaya pelaksanaan otonomi khusus, berbagai provinsi di Indonesia bersaing dalam upaya peningkatan retribusi daerahnya masing-masing. Hal ini telah mendorong provinsi-provinsi untuk membuat peraturan (regulasi) yang dapat mendatangkan nilai tambah bagi provinsinya. Peraturan tersebut kadangkala mengalami ketidakharmonisan dan ketidaksinkronan dengan regulasi yang lebih lebih tinggi baik dari segi materi muatan maupun dari segi teknis pembuatannya. Hal ini mengakibatkan meningkatnya jumlah peraturan daerah yang dibatalkan atau yang perlu di revisi kembali setelah diuji oleh Departemen Dalam Negeri. Hingga saat ini, Depdagri telah mengevaluasi sedikitnya 7500 perda sejak 2002, yang berasal dari seluruh kabupaten/kota dan provinsi di Indonesia. Dari jumlah tersebut, hampir setengah dari jumlah perda tersebut dibatalkan karena bertentangan dengan prinsip pembentukan perda. Jumlah tersebut diasumsikan akan terus bertambah seiring dengan semakin meningkatnya proses legislasi di daerah. Kata Kunci: Retribusi Daerah, Peraturan Daerah, Eksekutif Review.
