Abstract

The issues in this research include first, how is the protection for the traditional-cultural expression recently done in Sleman Regency? Second, how is the attempt of Department of Culture and Tourism of Sleman Regency towards the legal protection to the traditional cultural expression in Sleman Regency? This is a juridical-empirical research by taking the primary data from the research field through observation and interview done to the informants (Department of Culture and Tourism of Sleman Regency and Ministry of Law and Human Rights, Regional Office of Special District of Yogyakarta) and supported with the secondary data. The result of this research concluded that first the protection given by the Local Government related to the obligation mandated by regulation of Copy Right is through the inventory, documentation and other activities regarding the cultural affair of speciality of Yogyakarta. Second, the further attempt to give the protection for the traditional culture expression in Sleman Regency is by making the database of culture based on the information system; thus, it can be accessed by all parties and as a media to promote the tourism in Sleman Regency.

Abstract

Legal protection for culture is important because Indonesia has a diversity of cultures which serve as valuable assets. The problems of this study were first, why is the arrangement of Traditional Cultural Expressions in DIY needed in order to provide protection? Second, what is the legal protection of traditional cultural expressions according to UNESCO World Heritage Center? This study aimed to find out about the reasons why the protection for TCE is important and the TCE protection according to UNESCO World Heritage Center. This was a normative legal research using both primary and secondary data. The result of this research concludes that Yogyakarta has carried out efforts to protect and maintain culture because this region has a diversity of cultures so there is a possibility that the ownership of these cultures is claimed by other parties. The local government of Yogyakarta has carried out inventory and documentation efforts, but these efforts are not yet optimal. UNESCO through its World Heritage Center has also performed inventory and documentation on Indonesian cultures. Preventive measures through inventory and documentation are needed to prevent Indonesian cultures from being claimed and exploited without permission by other countries. Until the present time, there are 19 (nineteen) Indonesian cultures that have received UNESCO’s recognition.

Abstract

There is a rather large presence of Small and Medium Enterprises (SMEs) as part of creative industry in Yogyakarta, yet the Intellectual Property Rights management is still very minimum. The problems in this study are, first, why the protection of Intellectual Property Rights is important for small and medium business entities as creative industries in the Special Region of Yogyakarta. Second, how is the role of the regional government of the Special Region of Yogyakarta in order to provide legal protection for Intellectual Property Rights to small and medium businesses in the special Region of Region Yogyakarta. This paper applies a juridical-empirical approach by using primary data. This study concludes that firstly, the potential market for creative industries has a tendency to develop continuously, since SMEs in Yogyakarta contribute 59% of Gross Domestic Revenue in Special Region of Yogyakarta hence the protection of IPRs on creative economic products to guarantee the economic rights of the creators is crucial. Secondly, the role of local governments at the moment in the context of providing IPR protection for SMEs is carried out by establishing an Intellectual Property Management Center (BPKI), and developing a website to provide IPR services, namely "JogjaKI".

Abstract

Saat ini UMKM telah menjadi bagian penting dalam perekonomian di Daerah Istimewa (DI) Yogyakarta. Keberadaan UMKM menjadi salah satu pilar utama penggerak perekonomian di Daerah Istimewa Yogyakarta. Beberapa masalah utama yang dihadapi UMKM adalah kemampuan teknologi, kualitas sumber daya manusia (SDM), akses pemasaran, akses permodalan, dan kualitas produk. Salah satu permasalahan UMKM yang akan diangkat dalam topik penelitian ini adalah dari akses pemasaran. Dinas Perindustrian Perdagangan, selanjutnya disebut Disperindag Provinsi DI Yogyakarta, telah berupaya berperan dalam mempromosikan produk UMKM yang ada di wilayah Yogyakarta, dengan membuat kebijakan penggunaan co-branding untuk produk UMKM di DI Yogyakarta. Penelitian ini bertujuan mengetahui strategi pemasaran dalam konsep co-branding untuk memberikan perlindungan Merek bagi UMKM sesuai yang diamanatkan dalam Undang-undang Merek dan Indikasi Geografis Nomor 20 Tahun 2016. Penelitian ini merupakan penelitian Yuridis Normatif. Hasil dari penelitian ini menyimpulkan bahwa saat ini Pemerintah Daerah DI Yogyakarta telah memiliki regulasi yang akan mengatur mengenai merek dan budaya tradisional yang berasal dari DI Yogyakarta. Adanya strategi pemasaran co-branding tersebut memang tidak berdampak langsung pada perlindungan merek dagang seperti yang diamanatkan dalam Undang-undang Merek, namun dengan menggunakan fasilitas co-branding tersebut secara tidak langsung produk-produk yang diajukan merek tersebut akan terdaftar sebagai produk yang berasal dari Yogyakarta. Strategi pemasaran dengan menggunakan dua merek atau lebih (co-branding) itu diharapkan bisa melindungi, melestarikan, dan mendokumentasikan produk-produk asal Yogyakarta dengan prosedur yang mudah. Kata kunci: Merek, UMKM, Co-Branding, Perlindungan Hukum

Abstract

Abstract In making this article to get an overview of the protection and management of royalty rights in Government Regulation No. 56 of 2021, which guarantees protection and legal certainty for the economic rights of creators, copyright holders, and related rights owners to songs and / or music, is needed. there is a royalty management mechanism that is transparent, high quality, and right on target as well as through the means of Information Technology. Therefore music is one of the most important parts in human life. Based on the existing reality that music is the most important part of life, it is hoped that this information on classical music can meet the needs of society and the classical music community. In carrying out musical activities, the concept of Elegance of melody is used which can create a space for a combination of romantic and contemporary times that can create a spatial atmosphere that seems classic, romantic, but incorporates a contemporary color. Number 28 of 2014 concerning Copyright, especially Article 15 where Royalty Rights for creators, copyright holders, and related rights owners who are not known and / or have not been a member of an LMK are kept and announced by LMKN for 2 (two) years for the creators to know , copyright holders, and voters related rights. Within the LMKM always strives to increase royalty revenue for the use of songwriting and music in Indonesia and distribute Royalties for the use of songwriting and music works to rights owners through LMK in a fair, transparent and accountable in accordance with applicable regulations. AbstrakDalam pembuatan artikel ini untuk mendapatkan suatu gambaran tentang perlindungan dan Pengelolahan Hak Royalti di dalam Peraturan Pemerintah No 56 Tahun 2021 dimana untuk menjamin Perlindungn dan kepastian hukum terhadap hak ekonomi pencipta, pemegang hak cipta,dan pemilik hak terkait atas lagu dan/atau musik, dibutuhkan adanya mekanisme pengelolahan Royalti yang transparan, berkualitas, dan tepat sasaran serta melalui sarana Teknologi Informasi. Oleh karena itu musik merupakan salah satu bagian terpenting dalam kehidupan manusia. Berdasarkan realita yang ada bahwa musik menjadi bagian yang terpenting dalam kehidupan, maka penerangan tentang suatu musik klasik ini diharapkan dapat memenuhi kebutuhan masyarakat dan komunitas musik klasik dalam melakukan aktivitas bermusik.Dalam perencanaan ini digunakan konsep Elegance of melody (keanggunan melodi) yang dapat menciptakan ruang adanya penggabungan zaman romantik dan kontemporer yang dapat menciptakan suasana ruang yang terkesan klasik, romantik, tetapi adanya penggabungan suatu warna yang kontemporer.Didalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta khususnya Pasal 15 dimana Hak Royalti untuk pencipta, pemegang hak cipta, dan pemilik hak terkait yang tidak diketahui dan/atau belum menjadi anggota dari suatu LMK disimpan dan diumumkan oleh LMKN selama 2 (dua) tahun untuk diketahui pencipta,pemegang hak cipta, dan pemilik hak terkait. Didalam LMKM senantiasa berusaha untuk meningkatkan pendapatan Royalti atas penggunaan Karya Cipta Lagu dan musik di Indonesia dan mendistribusikan Royalti atas penggunaan Karya Cipta Lagu dan musik kepada para pemilik hak melalui LMK secara adil, transparan, dan akuntabel sesuai dengan peraturan yang berlaku.
