Abstract

The Article 51 of Law No. 5 of 1960 on the Basic Agrarian Law states decisivelythat only property right, right to use and the right to use a building that can beused as collateral for debt with burden of mortgage. In principle, the object ofmortgages is the right to land that complete the requirements which is must beregistered (to qualify for publicity) and it can be proclaimed (to facilitate theimplementation of debt payments guaranteed repayment). In the other hand, thedepelopment of credit currently provides the possibility related to the right usedas an object of mortgage and it strengthened by Law No. 4 of 1996 on the Rightsof the land and items related to land although it is not explicitly regulated in theUUPA.Keywords: use right as mortgage object

Abstract

Land is one important element for humans. That is how importance of land, the government needs to make special arrangements regarding use of the land. In general, land arrangements are regulated in Law Number 5 of 1960 concerning Basic Rules on Agrarian Matters, which stipulates that the authority in the field of land is the authority of the central government. In addition, Indonesia as a unitary state also adheres to the principle of decentralization, it means that the central government gives authority to the regions to regulate their own regional affairs, including of land matters. The regulation regarding of land authority for regional governments is described in Act Number 23 of 2014 concerning Regional Government. However, the application of its authority is not yet optimal, because there is no balance of relations between the central government and regional governments in regulating land. The problem discussed in this study is how the division of authority between the central government and regional government of land matters. The approach used in this research is normative juridical. In the other word, this study examines the problem based on applicable laws and regulations, especially regulations regarding land. The data is collected by using literature study, then analyzed and described systematically. The result showed a norm conflict in the division of land authority in the UUPA and the Regional Government Law. Therefore, it is hoped that there is a clear division of authority between the central and regional governments which is not only contained in the Regional Government Law.

Abstract

Pelaksanaan Nagari Di Kabupaten Pasaman sebelumnya mengacu kepada Peraturan Daerah Nomor Daerah Nomor 2 Tahun 2007 tentang Pokok-Pokok Pemerintahan Nagari, akan tetapi setelah diundangkannya Undang-undang Nomor 6 Tahun 2014 tentang Desa maka berubah pula Pelaksanaan Pemerintahan Nagari di Kabupaten Pasaman. Berdasarkan hasil penelitian dan observasi di lapangan telah didapatkan hasil berupa Implikasi Positif Pelaksanaan Undang-Undang Nomor 6 tahun 2014 tentang Desa terhadap Keberadaan Nagari di Kabupaten Pasaman. Implikasi positif tersebut dapat dilihat dan ditandai dengan adanya langkah yang dilakukan oleh Pemerintah Kabupaten Pasaman untuk memaksimalkan pelaksanaan Undang-Undang Nomor 6 tahun 2014 tentang Desa. Kebijakan pemerintah Kabupaten Pasaman untuk mencapai Implikasi positif tersebut dibuktikan berdasarkan kebijakan pemerintah Kabupaten Pasaman melalui Peraturan Bupati Pasaman Nomor 21 Tahun 2017 tentang Pembentukan Nagari Persiapan di Kabupaten Pasaman. Pembentukan Nagari Persiapan tersebut disambut baik oleh masyarakat kabupaten Pasaman, sehingganya berdasarkan peraturan Bupati nomor 21 tahun 2017 tersebut dilakukan Penataan Desa atau Nagari yang mana jumlah nagari persiapan yang diajukan oleh Pemerintah Kabupaten Pasaman adalah sebanyak 25 Nagari Persiapan, yang mana seluruh Nagari Persiapan tersebut sudah siap dengan aparaturnya untuk menunjang dan memajukan Pemerintah Kabupaten Pasaman.
