Abstract

This research was conducted in Kendari City, Southeast Sulawesi Province.The purpose of this study is (1) To know and analyze the level of understanding of community law of Kendari city especially the application of the customary law of inheritance, Islam or Western Civil. (2) To find out and analyze the tendencies of Kendari City community to the application of the customary law of adat, Islam and Western Civilization.Data collection from population 200 people doing the application of the customary law of adat, Islam or Western Civilization, using random sampling technique (simple random) then collecting using interview and questionnaire method with frequency analysis method to the respondent.The results showed that the level of understanding of community law Kendari is still very low, both understanding the inheritance law of Adat, Islam, and Western civil law. Then the tendency of the Kendari City community to the application of customary, Muslim, and Western civil waris law is more likely to choose Islamic inheritance law because it is considered as a guidance and religious instruction is believed to give benefit and justice rather than customary law or western civil inheritance law.

Abstract

Dalam ajaran agama Islam, Seseorang boleh menyerahkan/menghadiahkan atau memberikan harta miliknya kepada seseorang diwaktu ia masih hidup atau ia boleh menyatakan pemberiannya diwaktu ia masih hidup, tetapi pelaksanaan pemindahan milik itu boleh dilakukan setelah ia meningal dunia. atau ia memberikan kepada seseorang sesudah ia mati melalui surat wasiat. Hukum Islam membenarkan kedua cara ini, tetapi penyerahan inter vivos tidaklah ada batas mengenai jumlahnya, sedangkan penyerahan dengan surat wasiat terbatas pada sepertiga dari harta peninggalan yang bersih. Hukum Islam mengizinkan seseorang, memberikan sebagai hadiah semua harta miliknya ketika hidupnya, tetapi hanyalah sepetiga dari harta benda itu dapat diberikan dengan surat wasiat. Pertimbangan hukum Islam nampaknya ialah untuk menghalangi seseorang yang meninggalkan surat wasiat mencampuri cara pembagian harta peninggalannya antara ahli-ahli warisnya menurut hukum, sesungguhnya ia dibolehkan memberikan suatu bagian yang tertentu, sebanyak-banyaknya sepertiga, kepada orang lain diluar keluarganya. Tetapi juga ternyata bahwa yang memegang harta milik, dalam batas-batas yang tertentu, dapat mengalahkan pelaksanaan ketentuan-ketentuan hukum dengan jalan memberikan, seluruhnya atau sebagai manapun juga dari harta miliknya ketika hidupnya kepada salah seorang dari anak lelakinya,asal saja ia memenuhi beberapa syarat yang tertentu.

Abstract

The Konawe people have a unique tradition of early marriage. Research from a critical Islamic perspective has yet to be widely studied in this tradition. This study investigated the initial legitimacy process as an ethnic tradition in early marriage. A legal ethnographic case study design was used in this study. Thirteen individuals participated in the study, including four community leaders, three indigenous peoples, two academics, and four parents of early marriage doers. In-depth interviews and observation were used to collect the data. Reduction, presentation, and interpretation are all used in data analysis methods. The study revealed three key findings: First, the chieftain decides on early marriage in the Tolakiness community. Second, decisions and agreements must be followed and upheld by everyone in the community. Thirdly, different legal systems—such as Islamic, Indonesian, or Western civil law—impact these judgments and agreements, which alters the relationship between law and freedom. This article argued that the Tolakian community needs to undergo cultural reconstruction to accommodate women's rights and freedoms and avoid coercive judgments from tribal chiefs.
