Abstract

The issue of Intellectual Property Rights has not been discussed or even described by classical fiqh scholars in-depth and thoroughly. One aspect that has not been studied is the issue of the period of copyright protection. The assumption is that if copyright protection is not limited in time, it will lead to a monopoly of creation by a few people. Therefore, the purpose of this study is to clearly describe and compare the terms of copyright protection in the Copyright Act and Islamic Law using the Maqashid Syariah perspective. The method used is a qualitative study (library research) with a comparative approach. The results of the study indicate that the period of copyright protection according to Islamic law, for the type of moral rights is valid forever, while for the type of economic rights it applies trade (willingness of the heart) with the provision that the shorter (reasonably) is, the better as long as it does not harm the creator. In addition, the State can determine the period of copyright protection through its regulations according to the country's ability.

Abstract

The purpose of this study is to find out the management of zakat conducted by the district of magetan district by using the swot method of analysis. Which later in swot analysis uses matics and swot analysis diagrams so that it can be known in the upper quadrant of zakat LAZISNU's management in the diagram. The study employed qualitative methods of fieldwork and employed qualitative approaches. The data-collection techniques that are done are interviews, observations, and documentation. Research shows that LAZISNU has performed some zakat management activities such as planning, organization, execution and surveillance strategies. Swot analysis using mattices and diagrams indicates that zakat LAZISNU's management was in the first quadrant. In the diagram it shows that the first quadrant is between chance and strength. The strategy that supported LAZISNU is an aggressive strategy by maximizing the remaining forces to achieve the odds. However, when this strategy is employed incorrectly, it reduces the weaknesses and threats found in LAZISNU Tujuan penelitian ini adalah untuk mengetahui manajemen zakat yang dilakukan oleh LAZISNU Kabupaten Magetan dengan menggunakan metode analisis SWOT. Yang nantinya dalam analisis SWOT menggunakan matrik dan diagram analisis SWOT sehingga dapat diketahui dalam posisi kuadran manakan manajemen zakat LAZISNU dalam diagram. Penelitian ini menggunakan metode kualitatif penelitian lapangan dan menggunakan pendekatan kualitatif. Teknik pengumpulan data yang dilakukan adalah wawancara, observasi, dan dokumentasi. Hasil penelitian menunjukkan bahwa LAZISNU telah melakukan beberapa kegiatan manajemen zakat seperti perencanaan, pengorganisasian, strategi pelaksanaan dan pengawasan.. Hasil analisis SWOT menggunakan matrik dan diagram menunjukkan bahwa manajemen zakat LAZISNU berada di kuadran pertama. Dalam diagram ditunjukkan bahwa kuadran pertama berada di antara peluang dan kekuatan. Strategi yang mendukung LAZISNU adalah strategi agresif yaitu dengan memaksimalkan kekuatan yang ada untuk meraih peluang yang ada. Namun, jika strategi ini dapat dilakukan dengan baik secara tidak langsung akan mengurangi kelemahan dan ancaman yang ada di LAZISNU.

Abstract

This paper attempts to analyze customer protection practices in non-cash transactions in Indonesia and explore the perspective of al-dharuriyyat al-khams on the protection of Muslim customers in non-cash transactions. The trend of non-cash transactions in Indonesia has become increasingly widespread since 2014 when Bank Indonesia socialized the National Non-Cash Movement. However, along with these developments, there are several weaknesses and questions related to customer protection in general and Muslim customers in particular. Some security cases include loss of electronic money cards, failed transactions, sudden decrease in balance and the imposition of additional e-money fees, and several other cases. This type of research is literary research that uses a variety of library information (library research). While the approach used is a qualitative approach which refers to the data normatively. The results of the study conclude: first, the position of consumers/customers in non-cash transactions in Indonesia, even though the legal instruments are quite complete, are practically not sufficient to protect them properly. Second, based on the five principles of maintaining al-dharuriyyat al-khams, namely the protection of religion, soul, mind, lineage and property, it is clear that efforts to protect Muslim customers in non-cash transactions have been carried out but in a security system in transactions, customer data security systems, and socialization of important information related to customers still needs to be improved.

Abstract

The product development strategy is an effort carried out by the company through the introduction of market opportunities, improvements in the technical aspects of production with innovation with the aim of increasing consumer or customer satisfaction. As is the case with the UMKM Sumber Waras in Tahunan Village, Tegalombo District, Pacitan Regency, whose products are superior in the Tahunan Village which are able to increase income, because UMKM Sumber Waras always develops their products continuously. The purpose of this study was to find out how the product development strategy was implemented in Sumber Waras UMKM, the product development modification strategy in Sumber Waras UMKM, and the impact of the development modification strategy on Sumber Waras UMKM. In preparing the thesis, the writer uses a qualitative descriptive research method, which is a problem-solving procedure by describing the situation based on the facts that appear as they are. Data collection techniques used are interviews and documentation.The results of this study can be concluded that the implementation of product development strategies carried out by UMKM Sumber Waras continues to strive to improve the quality of its products so that people's buying interest will increase. In the product development strategy based on the principles of Islamic economics, the Sumber Waras MSME still pays attention to several halal products, product quality, and product benefits. The strategy for modifying product development carried out by UMKM Sumber Waras is by maximizing promotions through social media, developing everything from packaging, product variants and product types. For this type of product, apart from making instant herbal medicine, Sumber Waras UMKM also makes other preparations, namely chips and processed milk. It aims to provide maximum value for consumers and win company competition by selecting innovative products. The impact after modifying product development is that the total income has increased compared to before. The main thing to increase revenue is from modifying product packaging, besides functioning to maintain product quality, product packaging can also provide information about products, and provide product security.

Abstract

Introduction: This research discusses applying the characteristics of STAF (Siddiq, tabligh, Amanah, and fathanah) in Afifah Honeybee marketing to strengthen consumer decisions in buying Afifah Honeybee products. The nature of STAFF is viral among scholars but still needs to be widely applied in the business world; for this reason, this study intends to examine the application and impact of the nature of STAF in the business world. Research Methods: The research will produce qualitative descriptive data by using qualitative research methods and field research. Interview, observation, documentation techniques, data models, and drawing conclusions collected data. Results: The study results show that Afifah Honeybee's marketers have tried to apply the characteristics of STAF even though it could be more optimal. Conclusion: This application significantly positively impacts consumers' decisions to buy Afifah Honeybee's products.
