Abstract

Abstract Diversity implementation by law enforcers is based on the authority of law enforcers called the dis-cretion or discretion of children as the potential of the State in the context of the survival and glory of the nation, is how the government’s commitment to make children a top priority in the development of juvenile judges and courts as the last stronghold in the process settlement of children who are fac-ing law in the Court. The police and the community must synergize and develop the same perception of diversion and restorative justice. Parents must participate in providing protection for children by fulfilling children’s rights, protecting the interests of children and further increasing supervision of the environment and where children play. Abstract

Copyright is very important part of Intelectual Property Right. That is particularly in the field creation of Copyright about song and music, its offence extremely concerned and serious in Indonesia. Copyright is the exclusive right or special right which has meaning that other people cannot take all advantages on the right as from creator economy for its creatures without any license creator or copyright holders legitimate. The Consequences are in every utilization of music for Commercial Business activities and or for purpose relates with business/aims commercial such as Café, Hotel, restaurant and others, must request permission first to the creator and or copyright holder over the use of creation in regards about the song and music. Abstract

Hak Cipta merupakan bagian yang sangat penting dari Hak Kekayaan Intelektual, khususnya di bidang karya kreatif musik dan lagu; pelanggaran tersebut sangat memprihatinkan dan serius di Indonesia. Hak Cipta adalah hak eksklusif atau hak khusus yang berarti bahwa orang lain tidak dapat memanfaatkan hak ekonomi pencipta atas ciptaannya tanpa persetujuan terlebih dahulu dari pencipta atau pemegang hak cipta yang sah. Konsekuensinya dalam setiap penggunaan musik untuk usaha komersial dan/atau kepentingan yang berkaitan dengan kegiatan usaha/tujuan komersial seperti kafe, hotel, restoran dan lain sebagainya harus terlebih dahulu meminta persetujuan pencipta atau pemegang hak cipta atas penggunaan ciptaan musik tersebut. Penelitian ini dibuat dan disusun dengan menggunakan metode penelitian normatif yuridis yang mengacu pada norma-norma hukum yang terdapat dalam peraturan perundang-undangan. Konsekuensi hak cipta (musik dan lagu) sebagai suatu hak yang eksklusif (khusus) adalah bahwa setiap orang yang ingin memanfaatkan hak ekonomi pencipta atas ciptaannya penggunaan yang bersifat komersil diwajibkan menurut hukum untuk meminta izin kepada pencipta atau pemegang hak ciptanya yang sah. Akibat hukum penggunaan karya cipta (musik dan lagu) tnpa izin dari pencipta atau pemegang hak ciptanya yang sah adalah gugatan ganti rugi secara perdata melalui Pengadilan Niaga dan tuntutan pidana berupa tindak pidana pelanggaran hak cipta yang menurut undang undang merupakan suatu jenis tindak pidana aduan. Kata Kunci: Lisensi, Karya Cipta, Musik, Lagu, Akibat Hukum.
