Abstract

Perkembangan pasar modal syariah di Indonesia sudah dimulai sejak tahun 1997 dengan adanya peluncuran Danareksa syariah oleh PT Danareksa Investment Management (DIM). Pengaturan hukum tentang efek syariah pada pasar modal syariah di Indonesia dikeluarkan oleh Dewan Syariah Nasional Majelis Ulama Indonesia (DSN-MUI) sebagai lembaga yang berwenang untuk menfatwakan hukum-hukum yang berkaitan dengan lembaga ekonomi dan keuangan syariah. Kekurangan dalam pengaturan hukum efek syariah pada pasar modal syariah di Indonesia bahwa fatwa DSN-MUI tidak termasuk dalam tata urutan perundang-undangan sehingga sampai saat ini penerbit-penerbit produk keuangan syariah sebenarnya mempunyai keleluasaan untuk tidak mengikuti fatwa DSN, karena fatwa DSN bukanlah sumber hukum yang mengikat di Negara Republik Indonesia. Oleh karena itu, Perlunya pengaturan hukum tentang pasar modal syariah atau efek syariah dalam bentuk peraturan perundang-undangan yang berlaku di Indonesia seperti Undang-undang agar menjamin kepastian hukum bagi para investor yang akan menginvestasikan modalnya di Pasar modal syariah di Indonesia.

Abstract

Shareholders in the Islamic capital market find it difficult to monitor whethersharia principles have been implemented by the company issuing the shares of sharia.Supervision of the company that has issued shares of sharia has become crucial to ensurethat the term sharia is not just a mere label, but it must animate every activity of thecompany. Abstract

The state is obliged to ensure that health services are provided for women, especially family planning (KB) services, pregnancy, childbirth, postpartum or exclusive breastfeeding. It cannot be denied that until now there are still many offices / companies and Malls that ignore the existence of lactation rooms. Whereas the obligation of work organizers to provide lactation space has been regulated in the Republic of Indonesia Minister of Health Regulation Number 15 of 2013. The regulation of procedures for providing breastfeeding space aims to provide protection to mothers in exclusive breastfeeding and fulfill children's rights to receive exclusive breastfeeding. The provision of this breastfeeding corner facility is devoted to meeting the needs of mothers and babies who still have to breastfeed, and at the same time aims to increase exclusive breastfeeding for babies as one of the main nutrients. This step also plays a role in reducing infant mortality, because the baby's immunity will increase through breast milk. However, the reality on the ground says differently. So the problem is what is the legal arrangement for lactation room facilities in shopping centers (Malls) in Medan City? and What are the legal consequences for the unavailability of lactation space in shopping centers (Malls) in Medan City? This type of research used in this research is normative legal research. Normative legal research is also called doctrinal legal research because this research is carried out by analyzing written laws from library materials or secondary data which are better known as names and reference materials in the field of law or reference materials in the field of law

Abstract

The restorative justice approach is a diversion in the handling of criminal acts which in the criminal justice procedure are centered on imposing criminal sanctions which are transferred to a communication and mediation process that presents the perpetrators, victims, families of the perpetrators/victims, and other related parties to come together to realize a form of agreement. for the handling of criminal acts that are fair and proportional to the victims who are harmed and the perpetrators by prioritizing repairs such as initial conditions and restoring a harmonious interaction model in society. It is this restorative justice approach that will be used in the investigation, investigation and examination stages in courts of insults, considering that the enforcement of criminal law against insult cases that occur in the community has not given satisfactory results. The regulation of defamation offenses whether carried out offline or online with social media refers to the provisions of the Criminal Code (KUHP) and the Information and Electronic Transactions Law, which in these two provisions contain criminal sanctions against the perpetrators. The purpose of the restorative justice approach in dealing with insults offenses is the restoration of victims who suffered as a result of the humiliation by providing compensation, imposing social work on the perpetrators and matters mutually agreed upon by the parties.
