Abstract

Demokrasi ekonomi adalah konsep diterangkan pendiri negara Indonesia yaitu mencari bentuk ekonomi yang sesuai dengan karakteristik bangsa Indonesia. Tidak mudah membentuk sistem perekonomian Indonesia yang khas, oleh karena itu penerapan konsep ini masih terus dilacak dan dikembangkan untuk mengikuti perkembangan zaman. Dasar hukum yang mengatur penerapan prinsip demokrasi pada perbankan nasional adalah dalam UURI No. 7 Tahun 1992 untuk Bank dan UURI No. 10 Tahun 1998 UURI UU No. 21 Tahun 2008 untuk Bank Umum Syariah. Pada dasarnya, Perbankan Syariah didirikan di Indonesia sejak tahun 1983 dan paket Desember 1983 (Pakdes 83) diterbitkan. (Tingkat bunga nol) Tingkat bunga menyusul perkembangan tersebut, Menteri Perbendaharaan Radius Prawiro melakukan serangkaian langkah di bidang perbankan, seperti terlihat dalam paket Oktober 1988 (Pakto 88). Prinsip kehati-hatian adalah keyakinan bahwa bank harus sangat berhati-hati dalam melakukan bisnis yang baik dengan penghimpunan, terutama dalam menyalurkan dana kepada masyarakat umum. Tujuan dari prinsip kehati-hatian ini adalah untuk memastikan bahwa bank selalu beroperasi dalam keadaan sehat dan mematuhi peraturan bank dan norma hukum yang menjadi system hukum perbankan syariah di Indonesia.

Abstract

Cooperatives are based on principles of kinship is one form of business entity that plays a role in the development of Indonesia's economy. Cooperative essentially contains two objectives , namely economic goals and social goals. Cooperative is a system and we know this system is a set of components or parts that are interrelated together serve achieve goals. The values on which the cooperative is independence, responsible, democracy, equality, justice, and solidarity . Ethical values are believed to be members is honesty, keterbukaan, social responsibility, and concern for others. Operative principle is an integral and inseparable in the life of cooperatives. By implementing the overall principles of the cooperative manifesting itself as a business entity as well as people's economic movement of social character. The cooperative principle is the basic essence of cooperative work as a business entity and it is typical and cooperative identity that sets it apart from other business entities. The responsibility of the board of the co-operative principles are still not implemented optimally. There are still many cooperatives that violate cooperative principles. The legal consequences of the violation of the principles of the cooperative form of dissolution actions undertaken by the government.

Abstract

Implementation of Land Registry According to Government Regulation No. 24 of 1997, basically aims to provide legal certainty both the certainty of the subject and its object. But in the implementation there are still obstacles such as easurement and posted announcements by the measuring officers suddenly come other people who recognize. The far location of the object of the land resulted in the registration fee of land. Indicators become problematic implementation of land registration so that land registration has not been able to realize legal certainty in its implementation. Even the factors of non-implementation of land registration that protect the rights of the community above are exacerbated by the issuance of false certificates as well as double certificates.

Abstract

This research is an analytical descriptive research that is a research that describes and describes the existing situation or facts about how the implementation of internet domain name registration related to brand rights in Indonesia and how the settlement of internet domain name dispute related to brand rights in Indonesia. The data were analyzed by normative juridical approach, meaning that the data have been compiled systematically and completely and then analyzed qualitatively with the research location in Palangka Raya City and on line. The results of the study concluded the registration of Internet Domain Name in Indonesia using the principle of first-come-first-served service, meaning that who register first then he is entitled to the internet domain name, this is not only regulated in international agreements, but also regulated in Article 23 paragraph (1) of Law No. 11 of 2008 on Information and Electronic Transactions. Internet Domain Name Dispute Resolution Related to Trademark Rights in Indonesia consists of resolving a generic domain name dispute settled with an international arbitration body registered by ICANN. Dissatisfaction with the outcome of the decision of this arbitration body may be submitted to the District Court or Dispute Settlement Body, where the competent jurisdiction is in accordance with paragraph 1 of the Uniform Domain Name Dispute Resolution. The dispute resolution of country internet domain names (ccTLDs) uses the mechanisms set forth in article 75 of Government Regulation No. 82 of 2012 on the Implementation of Electronic Transactions and Systems. Regarding Internet Domain Name Registration in Indonesia, especially generic domains that do not have special requirements in its registration, to strengthen the legality and domain name of the internet to immediately register the domain name as a brand in Indonesia; 2. Dirjen HKI as a place of registration of brands and Registrar and PANDI as the container of domain name registration in order to synergize in drafting a legislation, so it becomes clear the process of registration until the settlement of internet domain name dispute related to brand rights.

Abstract

The birth of Supreme Court Regulation Number 5 of 2019 concerning Guidelines for Trialing Applications for Dispensation of Marriage is certainly a legal instrument as a means of achieving justice, certainty and benefits for justice seekers, especially as a condition for marriage under the minimum age limit for marriage after the revision of the marriage law. The purpose of this study is to examine the position of Supreme Court Regulation Number 5 of 2019 concerning Guidelines for Trialing Applications for Dispensation of Marriage. This research uses normative method. The background findings of Supreme Court Regulation Number 5 of 2019 concerning Guidelines for Trying Marriage Dispensation Applications to complete the legal vacuum after the revision of the Marriage Law in providing a legal umbrella for the process of adjudicating applications for marriage dispensation which so far have not been clearly regulated in laws and regulations. Position of Supreme Court Regulation Number 5 of 2019 Regarding Guidelines for Adjudicating Applications for Marriage Dispensation, judges must ensure that children's statements are heard in court as an effort to prevent violations of children's rights.
