Abstract

AbstrakSebagian masyarakat Indonesia melaksanakan kewarisan sebelum ada yang meninggal, umumnya ketika orang tua masih hidup dengan menggunakan usaha alternatif berupa hibah. Hal ini telah diberikan legalisasi dengan terumuskannya Pasal 211 KHI, yang seakan-akan memberikan legalisasi terhadap praktik kewarisan dengan menabrak ortodoksi kewarisan Islam. Oleh karena itu, hal tersebut menarik untuk ditelaah lebih lanjut apa yang melatarbelakangi penyusunan dan substansi hukum pada pasal tersebut. Tulisan ini berusaha untuk memahami substansi dan menakar nilai-nilai hukum yang tersimpan pada Pasal 211 KHI dengan menggunakan pendekatan “hermeneutika hukum”. Pembahasan dalam tulisan  ini berdasarkan pada kajian pustaka dengan pendekatan yuridis. Kajian bersifat kualitatif dengan menggunakan analisa deduktif. Berdasarkan kajian yang penulis lakukan dapat disimpulkan bahwa perumusan pasal 211 KHI tersebut tidak terlepas dari kajian sejarah yang melatarbelakanginya, serta menjelaskan nilai-nilai hukum yang terkandung di dalamnya. Di samping nilai-nilai hukum yang termuat di dalamnya, pasal 211 KHI mempunyai relevansi terhadap perkembangan hukum di Indonesia yang berupa integrasi konsep keadilan hukum dan kemanfaatan hukum Kata kunci: Waris, Kompilasi Hukum Islam, Hermeneutika Hukum Abstract a portion of society Indonesia implement inheritance before anyone died, generally when the parents are still living with the use of alternative businesses in the form of grants. This has given the legalization of terumuskannya with Article 211 GENGHIS , which seem to give the legalization of the practice of inheritance with bumping Islamic inheritance of orthodoxy. Therefore, it is interesting to analyzed further what aspects influenced the formulation and substance of the law in such article. This paper seeks to understand the substance and take the necessary legal values stored in sections 211 GENGHIS by using the approach of "legal hermeneutics". The discussion in this paper is based on a review of the literature with juridical approach. Study of qualitative nature by using deductive analysis. Based on the study that the author did it can be concluded that the formulation of article 211 of the GENGHIS is inseparable from the history of the study of melatarbelakanginya, as well as explaining the legal values contained therein. In addition to legal values contained therein, article 211 GENGHIS had relevance to the development of law in Indonesia which consists of the integration of the concept of Justice and benefit of law law. Keywords : Inheritance, compilation of Islamic law, Legal Hermeneutics

Abstract

Abstract: Development is a thing that will happen to human life in its various aspects to complement the needs of human being as individual and social beings. Therefore, necessary to establish religious education human personality perfectli capable of mastering technology and science by sticking to religious doctrines as a measure of ethics in everyday life. However, it will not be separated from the role of the family as an institution beggining in shaping a person’s character. Abstract

Abstract: Islam teaches to no dichotomy between the world of knowledge with knowledge of the afterlife. however, Islam is more likely to emphasize his people to gain the knowledge to keep both scientific study. this indicates that Islam educate his people to always learn, both in terms of vertical worship to the Creator or social structuring in social life. One of the institutionalization of worship that have educational value of learning in public life is “sholat”. In this paper the authors try to find educational value contained in the institutionalization of “sholat”, Which was known by some Muslims as a nuanced vertical worship alone. Abstract

Marriage in the Islamic legal study in Indonesia introduces a discussion of mixed marriages. In the understanding of classical fiqh, when dealing with the term of mixed marriage, the paradigm will lead to the understanding of different religion marriage. However, along with the development and the increasingly existing Islamic law in Indonesia based on the theory of legal existence, mixed marriage is not only limited to a marriage due to religious differences, but there is also a marriage due to citizenship differences as defined in the Marriage Law.[Perkawinan dalam kajian studi hukum Islam di Indonesia memperkenalkan pembahasan tentang perkawinan campuran. Dalam pemahaman fikih klasik apabila berhadapan dengan term perkawinan campuran maka paradigmanya akan mengantarkan pada pemahaman perkawinan beda agama. Abstract

The inheritance of wealth is to be experienced by every Muslim family. Essentially, in Islamic inheritance implemented as heir had died. However, in the lives of the people of Indonesia held a lot going on heritage heir, who in this case the parents to their children will still living with an alternative bussiness “grants”. It has been granted legalization to determined the article 211 KHI, which seemed to give the inheritance of the practice of Islamic ortodoxy hit. Therefore, it is interesting to analyze further what lies behind the preparation and legal substance to the article. This paper seeks to understand the substance and stored legal values in article 211 KHI by using the approach og “legal hermeneutics”. [Proses kewarisan harta kekayaan merupakan hal yang akan dialami setiap keluarga muslim. Pada dasarnya kewarisan dalam Islam dilaksanakan ketika pewaris telah meninggal dunia. Namun, dalam kehidupan masyarakat Indonesia banyak terjadi kewarisan yang dilaksanakan pewaris, yang dalam hal ini orang tua kepada anaknya ketika orang tua masih hidup dengan menggunakan usaha alternatif berupa hibah. Abstract

Family is the main foundation for character formation and the role of family members. In addition, the family also plays a major role in the patterns of interaction that exist in people’s lives.  However, the development and changes that occur in society can effect the pattern (role) of family life. Today, the development of science and technology is able to influence the shape of society’s life structure toward the “modern society”, one of the impact on family structure is the existance of madern family, which is characterized by the intensity of meetings among family members is increasingly “limit” due to the high level of activity outside the household, such as: children who are out of town school, husband and wife career, husband who works outside the city and see also. Moreover, because the development of communication, so this can be made as a means to build family resilience. Therefore, this article will try to examine communication systems as a significant element to build family resiliaence throught historical contex and sociological approaches, where the presentasion is by integrating, describing, and the analyzing social phenomena—modern family life patterns, changes and developments in technology, communication—using “nilai etik theory” through several rules of Islamic communication as the value of communicating in the family. So that, when viewed from “nilai etik theory” develop by Rahman, conclusions can be obtained, that there are several elements of a very close relationship to the principles of Islamic communication, development of family structure, and family resilience as a way to build a family that is a sakinah, mawaddan and rahmah.Dewasa ini, perkembangan ilmu pengetahuan dan teknologi mampu mempengaruhi bentuk struktur kehidupan masyarakat ke arah “masyarakat modern”, yang salah satu dampaknya berpengaruh terhadap struktur yang ditandai dengan terbatasnya tingkat intensitas pertemuan antar anggota keluarga karena tingginya aktivitas di luar rumah tangga, seperti; anak yang sekolah atau kuliah di luar kota, suami-istri yang berkarir, suami yang bekerja di luar kota, dan sebaliknya. Lebih lanjut, karena perkembangan alat komunikasi yang semakin maju, maka hal tersebut dapat  dijadikan sebagai salah satu sarana untuk membangun ketahanan keluarga. Oleh karena itu, artikel ini akan coba menelaah sistem komunikasi sebagai unsur yang signifikan untuk membangun ketahanan keluarga melalui pendekatan historis (historical contex) dan pendekatan sosiologis, di mana pemaparannya dengan cara memadukan, mendeskripsikan, dan kemudian menganalisis fenomena sosial—pola kehidupan keluarga modern, perubahan dan perkembangan teknologi, komunikasi—menggunakan teori nilai etik melalui beberapa kaidah komunikasi Islam sebagai nilai berkomunikasi di dalam keluarga. Sehingga, apabila ditinjau dari “teori nilai etik” yang dikembangkan oleh Rahman, dapat diperoleh kesimpulan, bahwa terdapat beberapa unsur hubungan yang sangat erat terhadap prinsip-prinsip komunikasi Islam, perkembangan struktur keluarga, dan ketahanan keluarga sebagai jalan untuk membangun keluarga yang sakinah, mawaddah dan rahmah.

Abstract

This article describes the analysis of divorce decisions on the grounds of parental intervention to a family of young couples in the Religious Court of Demak regency. The method of data collection is in-depth interviews and documentation, surely as important instruments, so that the subject matter of this research can be revealed properly, both in the process of divorce proceedings and judges' consideration in their decisions. This research, than, suggests one lesson food for thought that in social life within community, parent’s role has an important meaning in the lives of their son’s or daughter’s household in their position as mediator (hakam) and giving advice when conflicts occur in the family of son or daughter. Likewise, married couples must know the limitations and responsibilities of each in relation to their parents, so as to create healthy family relationships without intervention

Abstract

Through legal references review, the present study aimes at finding out the concept of ummah in the Medinah Charter and the concept of nation state in the Jakarta Charter (Indonesia’s 1945 Constitution) along with the correlation between the two. The conclusion is that, as constitution, the Medinah Charter is as sililar as the Jakarta Charter or the 1945 Constitution in the context of Indonesia, which has a feature of equations. From the historical point of view, both were grew out of a plural society which then formed a whole community in one melting pot, that is governance or state. In its values, ​​both contains the recognition of plurality of society and the principles of equality, unity, justice in one community

Abstract

Religious reform and renewal of knowledge are common to the lives of religious and state people. The relationship between the two in the modern era is a matter of concern in the world of politics, so that the study of Islamic politics has developed quite significantly, which includes the study of the relationship between Islam and the State, as well as the impact of that relationship which leads to democracy and its concepts, human rights, and the movement of the ulama (Muslim scholars) towards religious reform. Therefore, one of the Muslim leaders, namely Mohammed Abid Jābirī who is one of the phenomenal figures of revolutionary Islamic thinkers with his theses on various real advances in human life, both in his studies of: the social environment or the development of sacred texts Muslims, which in this case is specifically in the study of the relationship between Religion and the State, Democracy, Khilafah Theory, and Religious Reform through renewal of knowledge. That is what later became the main and interesting discussion to be examined through the relationship approach between Religion and the State through the framework of a fundamental, secular and substantive school of thought. The analysis of MA Jābirī's views on religious reform and knowledge renewal focused on the relationship between Religion and the State in the Modern Age, which was then analyzed by the author using a combination of Al-Mawardi's views in Al-Ahkam Al-Sulthaniyyah, Agus Maftuh Abegebriel and Ahmad Yani Abeviero through his paper Negara Tuhan; The Thematic Encyclopaedia, and the development of democratic issues in the Islamic and Western world as an inseparable relationship when discussing Religion and the State as substantic.

Abstract

In the study of Islamic marriage law, the law of carrying out walimat al-‘ursy is sunnah muakkad. However, in connection with the Covid-19 Pandemic Virus, it was banned temporally by the government, even through a circular number; P-004/DJ.III/ Hk.007/04/2020, issued by the Ministry of Religion. By literature research known that Prohibition and prevention aimed at gathering people in large groups, both in terms of ibadah and muamalat is an attempt to break the chain of the spread of the COVID-19 virus pandemic. Therefore, further studies on prevention, especially prevention of the implementation of the walimat al-‘ursy during the COVID-19 virus pandemic will be examined through the analysis of sad adz-dzari'ah.
