Abstract

Zakat is an important element in Indonesian society and is one of the Islamic instruments used for the distribution of income and wealth. To realize this goal zakat requires an effective system of administration and must be organized by an institution that manages the collection and distribution affairs. Without an organized institution, the implementation of zakat will not be able to run smoothly and will realize a real difference in living standards among the community. The results showed that the Bazda charity institution had an effective role in channeling the productive zakat program and materially assisting in the social sector in the district of Muaro Jambi. In terms of income, there is an increase in the amount of zakat collection within 2 years since the establishment of Bazda in Muaro Jambi Regency. This indirectly shows that the increase in the number of zakat payers is increasing from time to time, but this increase is still not comparable to the number of Islamic communities who have the right to pay zakat. It is hoped that Bazda will look for alternatives so that in the following years it can collect other types of zakat to increase the amount of zakat funds and the need for programs that are right on target and efficient for the rightful zakat recipients. The factor of distribution of zakat is an influential factor and has a real impact in efforts to alleviate poverty and become an effective financial instrument in the problem of community capital in Muaro Jambi Regency.

Abstract

This study aims: 1) To find out and analyze the form of responsibility of illegal beauty clinic business actors in Jambi City for consumer losses. 2) To find out and analyze dispute resolution for consumer losses arising from illegal beauty clinics in Jambi City. The formulation of the problem studied: 1) What is the form of responsibility of business actors for consumer losses due to illegal beauty clinics in Jambi City? 2) How to resolve disputes over consumer losses arising from illegal beauty clinics in Jambi City?. The research method used is empirical juridical research. The results of the first study that the responsibility for the legal relationship between business actors and consumers at beauty clinics was born from the Consumer Protection Act, in article 19 of the UUPK states that business actors are responsible for providing compensation for damage, pollution, and or consumer losses due to consuming goods or services. services produced or traded, the responsibility of business actors, namely accountability in the form of beauty health care services in accordance with the types of complaints submitted by patients as consumers. The two settlements between the beauty clinic business actors and consumers are still carrying out non-litigation settlements. Abstrak Penelitian ini bertujuan:1) Untuk mengetahui dan menganalisis bentuk tanggungjawab pelaku usaha klinik kecantikan ilegal di Kota Jambi terhadap kerugian konsumen.2) Untuk mengetahui dan menganalisis penyelesaian sengketa atas kerugian konsumen yang timbul akibat klinik kecantikan ilegal di Kota Jambi. Rumusan masalah diteliti:1) Bagaimana bentuk tanggung jawab pelaku usaha terhadap kerugian konsumen akibat klinik kecantikan ilegal di Kota Jambi?; 2)Bagaimana penyelesaian sengketa atas kerugian konsumen yang timbul akibat klinik kecantikan ilegal di Kota Jambi?. Metode penelitian yang digunakan ialah penelitian yuridis empiris. Hasil Penelitian pertama bahwa tanggungjawab hubungan hukum antara pelaku usaha dan konsumen pada klinik kecantikan lahir dari adanya Undang-Undang Perlindungan Konsumen, pada pasal 19 UUPK menyebutkan bahwa pelaku usaha bertanggung jawab memberikan ganti rugi atas kerusakan, pencemaran, dan atau kerugian konsumen akibat mengkonsumsi barang atau jasa yang dihasilkan atau di perdagangkan, pertanggungjawaban pelaku usaha, yakni pertanggungajawaban berbentuk pelayanan perawatan kesehatan kecantikan sesuai dengan jenis keluhan yang disampaikan oleh pasien selaku konsumen. Kedua penyelesaian antara pelaku usaha klinik kecantikan dan konsumen masih melakukan penyelesaian secara non litigasi.
