Abstract

The thesis research was motivated by the existence of bad loans that occurred in Indonesian Islamic Banks and also the settlement of mortgage guarantees which did not only occur in conventional banks but also occurred in Islamic banks. The discussion in this thesis is the regulatory mechanism and efforts to resolve the bad loans that occurred at Bank Syariah Indonesia. This research is a normative study to determine the procedure for resolving bad credit disputes with mortgage guarantees at Islamic banks. The discussion in this thesis is to discuss the arrangements and ways of resolving bad credit disputes so that these problems can be resolved in the future. The conclusion that can be drawn from this paper is the arrangement for the settlement of bad loans with mortgage guarantees at Islamic banks, efforts to overcome bad loans that can be done in 2 ways, namely litigation and non-litigation. Efforts to prevent bad loans at Bank Syariah Indonesia can be carried out by applying the precautionary principle and the 5C principle. This principle is a guideline used by banks to give approval to a credit application.

Abstract

Indonesia is one of the countries that prosper its people by providing guarantees provided by the government, namely the Old Age Security (JHT), this guarantee for formal workers who have entered an unproductive age, protection for workers, especially PPPK, and guarantees that Old Age Security (JHT) participants get money to cash in case of retirement, permanent total disability, or death in the ASN Law. The formulation of these problems, including Regarding the arrangements related to the Old Age Security Rights (JHT) for Government Employees with Work Agreements (PPPK) and Related to the mechanism of providing Old Age Security Rights (JHT) for Government Employees with Work Agreements (PPPK) In this study is normative legal research with a statutory approach and legal concept analysis approach. This research concludes that the regulation related to Old Age Security Rights (JHT) for PPPK is regulated in Article 106 paragraph (1) of Law no. 5 of 2014 concerning State Civil Apparatus, Article 75 PP No. 49 of 2018 concerning Management of Government Employees with Work Agreements and the Mechanism of Granting Old Age Security (JHT) for PPPK is regulated in Article 106 of Law no. 5 of 2014 concerning State Civil Apparatus.

Abstract

Tourism industry is a collection of interrelated tourism businesses, which aim to meet the needs of tourists in the administration of tourism. Of course, in an effort to meet the needs of tourists for the purpose of organizing tourism, cooperation from various parties is needed, both the local community, government, local government, and tourism entrepreneurs. The local community plays a particularly important role in the development of the tourism industry. In fact, in the provisions of Article 5 of Law Number 10 of 2009 concerning Tourism, principles of tourism implementation are regulated, one of which is empowering local communities. The problem that then arises is that sometimes the development of the tourism industry is not directed at the development of sustainable tourism. This is indicated by the existence of several tourism supporting facilities that are built not in accordance with their designation. This research is an empirical legal research that uses primary and secondary data with the aim of revealing the role of community-based tourism development models in realizing sustainable tourism in Bali. The results of the research show that the community-based tourism development model puts emphasis on the active role or participation of the community in the development of tourism. Furthermore, one of the goals of the community-based tourism is to realize sustainable tourism development. The local community plays a very important role in realizing sustainable tourism. Roles of the government, local governments, and tourism entrepreneurs are also of great importance in the context of realizing sustainable tourism.
