Abstract

Penerapan new normal yang diatur dalam Keputusan Menteri Kesehatan Nomor HK.01.07/MENKES/328/2020 tentang Panduan Pencegahan dan Pengendalian Covid-19 di Tempat Kerja Perkantoran dan Industri dalam Mendukung Keberlangsungan Usaha pada Situasi Pandemi. Metode Riset yang digunakan dalam penelitian menggunakan penelitian normatif, yaitu sebuah penelitian kepustakaan dengan cara meneliti bahan pustaka terkait objek yang diteliti.Pemerintah menerapkan beberapa fase dalam menghadapi new norman Fase 1 (1 Juni 2020) Industri dan jasa dapat beroperasi dengan protokol kesehatan Covid-19 Mall belum boleh beroperasi, kecuali toko penjual masker & fasilitas kesehatan Fase 2 (8 Juni 2020) Toko, pasar dan mall diperbolehkan pembukaan toko namun dengan protokol kesehatan Fase 3 (15 Juni 2020) Mall tetap seperti fase 2, namun ada evaluasi pembukaan salon, spa, dan lainnya. Tetapi degengan protokol kesehatan Covid-19 Sekolah dibuka namun dengan sistem shift Fase 4 (6 Juli 2020) Pembukaan kegiatan ekonomi dengan tambahan evaluasi untuk pembukaan secara bertahap restoran, cafe, bar, dan lainnya dengan protokol kebersihan yang ketat Kegiatan ibadah diperbolehkan dengan jumlah jamaah dibatasi Fase 5 (20-27 Juli 2020) Evaluasi untuk 4 fase dan pembukaan tempat-tempat atau kegiatan ekonomi dan kegiatan sosial berskala besar Akhir Juli/awal Agustus 2020 diharapkan seluruh kegiatan ekonomi sudah dibuka dan beroprasi dengan normal.Situasi Pandemi yang melanda dunia termasuk indonesia saat ini masih belum memiliki kejelasan terkait tentang regulasi yang mengatur secara jelas karena peraturan Pemerintah Nomor 21 Tahun 2020 yang mengatur tentang Pembatasan Sosial Berskala Besar ( PSBB). Tidak mengatur secara menyeluruh tentang penerapan New Normal (Kenormalan Baru)

Abstract

Land disputes in Indonesia are still very high, including land disputes that occur on ulayat lands. In the settlement of land disputes in court, sometimes indigenous peoples have to lose in defending their rights due to the weakness of the legality factor of land ownership rights on ulayat land. To minimize customary land disputes, regulations are needed that guarantee legal protection and certainty for the customary lands of indigenous peoples. The research method used is normative legal research. In this study using a statutory approach. The analysis used is descriptive qualitative analysis. The ulayat land of the customary law community unit has received recognition regarding its existence as long as the fact is that it still exists. The acknowledgment of this existence has been stated in Article 3 of the Basic Agrarian Law, but in the implementing regulations there is still a legal vacuum that results in weak aspects of protection and legal certainty for the existence of ulayat land. The existence of customary law institutions that do not yet have legality becomes a barrier for customary law community units in defending their rights in ulayat land disputes. The existence of ulayat lands cannot be separated from the recognition of customary law communities who are part of the existence of ulayat lands. Legal certainty in providing protection for ulayat lands of customary law community units is very necessary to maintain the existence of ulayat lands.

Abstract

Law enforcement in Indonesia, especially in each region, is strongly influenced by culture and culture in social life, in cases of criminal acts of corruption in particular, the community has a very important role both as justice collaborators in disclosing the occurrence of an act of criminal acts of corruption, terrorism, narcotics, laundering money, human trafficking and other organized criminal acts. As we know, a justice collaborator is defined as a perpetrator of a particular crime, but not the main actor who admits his actions and is willing to be a witness in the judicial process, and can play an active role in the legal process as a witness. The problem approach used in this study is a normative research approach and an empirical research approach. The normative research approach is an approach that is carried out through a study of laws, regulations, theories, concepts, views, and aspects related to the issues discussed. In addition, the approach in this study is also supported by an empirical research approach, namely an approach through field research by conducting interviews with the public and legal practitioners, carried out in order to find out the reality in the form of research, opinions, attitudes, related to efforts and implementation of witness protection. criminal acts of corruption, terrorism, narcotics, money laundering, trafficking in persons and other organized criminal acts.
