Abstract

In Law Number 22 Year 2009 regarding Traffic and Road Transportation, regulates road vehicle inspections and enforcement in the form of a ticket is accompanied by forfeiture of evidence. The foreclosure can be a vehicle and motor vehicle papers as evidence relating to the violation. Police investigators and civil servants in the field of Traffic has the authority to conduct the investigation. Police investigators have authority over the confiscation of objects/evidence in a traffic violation, according to the prosecution examination of motor vehicles on the road. The seizure may be made to the letters of a motor vehicle such as driver's license, vehicle registration and motor vehicles. However, in the elaboration of the Government Regulation No. 80 Year 2012 on the Motor Vehicle Inspection Procedures governing the relationship between the physical evidence seized by the violations. The traffic police are expected to behave professionally in confiscating objects or items of evidence in accordance with violations.

Abstract

The crimes that arise in the Aru Islands district due to the consumption of alcoholic drinks (sopi) have been increasing lately, so efforts must be made to resolve them so that no more crimes occur. This study aims to examine and discuss what crimes are caused by consuming alcoholic beverages (sopi) in the Aru Islands district. The type of research used in this research is empirical-juridical or sociological-juridical. The data sources used are primary data and secondary data. Techniques for collecting legal materials through interviews, documentation studies, and qualitative analysis of legal materials. The results of the study show that the factors causing the occurrence of criminal acts caused by consuming alcoholic beverages (sopi) are many, including unemployment, excessive alcohol consumption, and the fact that most people still use alcoholic beverages (sopi) as an outlet. The efforts made by the Aru Islands Police include conducting campaigns among teenagers as well as carrying out operations and enforcing the law against perpetrators of the distribution of alcoholic beverages (sopi).

Abstract

ABSTRACT: The crime of illegal binary option investment is very disturbing to the public by committing tricks and causing economic losses to victims of fraud which in turn makes victims report it and perpetrators such as influencers who carry out investment fraud under the guise of binary options. The purpose of this study is to discuss the application of rules and criminal sanctions for unscrupulous influencers who commit investment fraud under the guise of binary options. This research is a normative juridical research carried out using statutory, conceptual and case approaches. Fraudulent crimes committed by influencers to gain profit by offering binary option applications to the public who end up experiencing large losses, of course, must be sanctioned according to applicable regulations, from this the rules and criminal sanctions for influencers who commit fraud, have been listed in the Criminal Code Article 378 and Article 45 paragraph (2) of the ITE Law Jo Article 27 paragraph (2) regarding gambling content of the ITE Law. And also Article 45A paragraph (1) Jo Article 28 Paragraph (1) regarding fake news that harms consumers ITE Law No. 19 of 2016 concerning Amendments to Law No. 11 of 2008 concerning Information and Electronic Transactions, for this reason, based on a series of investigative investigations up to a decision at the district court level and the district high court, in the end, the judge handed down a verdict, the influencers, namely Doni Salamanan & Indra Kenz, were also subject to imprisonment with a sentence of 8 years in prison for influencer Doni Salmanan and 10 years in prison for influencer Indra Kenz for being proven to have committed fraud that harmed consumers, namely people who trade on binary option applications.
