<![CDATA[Penelitian bertujuan untuk : 1) Untuk mengetahui dan menganalisis efektivitas penuntutan terhadap tindak pidana ujaran kebencian (hate speech) di Kejaksaan Negeri Makassar, dan 2) Untuk mengetahui dan menganalisis faktor yang mempengaruhi efektivitas penuntutan terhadap tindak pidana ujaran kebencian (hate speech) di Kejaksaan Negeri Makassar. Tipe penelitian ini adalah yuridis empiris. Hasil Penelitian penulis mendapatkan bahwa: Penuntutan terhadap tindak pidana ujaran kebencian (hate speech) yang dilakukan oleh Jaksa Penuntut Umum terhadap perkara tindak pidana ujaran kebencian (hate speech) di Kejaksaan Negeri Makassar telah terlaksana dengan baik sesuai dengan tugas dan kewenangan Jaksa Penuntut Umum selaku Penuntut Umum. Proses penuntutan yang dilakukan oleh penuntut umum telah sesuai dengan ketentuan undang-undang ITE. Dalam penuntutan Jaksa Penuntut umum menerapkan Pasal 28 Ayat 2 serta Pasal 45 Ayat 2 serta KUHAP sebagai pedoman hukum acara Jaksa Penuntut Umum dalam melaksanakan tugas dan kewenangannya. Faktor yang mempengaruhi penuntutan terhadap tindak pidana ujaran kebencian (hate speech) di Kejaksaan Negeri Makassar oleh jaksa penuntut umum antara lain: substansi hukum, struktur hukum dan budaya hukum. The research aims to: 1) To find out and analyze the effectiveness of prosecution against hate speech at the Makassar District Prosecutor's Office, and 2) To find out and analyze the factors that influence the effectiveness of prosecution against hate speech at the State Prosecutor's Office. Makassar. This type of research is juridical empirical. The results of the research the authors found that: Prosecution of hate speech crimes committed by the public prosecutor for hate speech cases at the Makassar District Prosecutor's Office has been carried out properly in accordance with the duties and authorities of the Public Prosecutor as the Public Prosecutor. The prosecution process carried out by the public prosecutor is in accordance with the provisions of the ITE law. In prosecution, the public prosecutor applies Article 28 Paragraph 2 and Article 45 Paragraph 2 as well as the Criminal Procedure Code as a guideline for procedural law for the Public Prosecutor in carrying out his duties and authorities.
